RESOLUTION NO. 382 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A REQUESTED ZONE CHANGE AND RECOMMENDING THE GRANTING OF A VARIANCE.TO ALLOW CERTAIN R-3 USES UNDER SPECIFIED CONDITIONS ON THE PROPERTY AT 2515 SOUTH SIXTH AVENUE. WHEREAS, there was filed with this Commission on the 17th day of June, 1960, the application of Earl R. Wragg, as owner, for a change of zone from Zone R-2 to Zone R-3 for property located at 2515 South Sixth Avenue in the City of Arcadia, County of Los . Angeles, State of California, described as follows: The southerly 56 feet of Lot 8, Tract No. 11382, as shown on map recorded in Book 240, page 45, of Maps, records of Los Angeles County; and, \~HEREAS, after notice required by Ordinance No. 760 of said City, as amended, a public hearing was duly held on the matter by and before this Commission on the 12th day of JUly, 1960, which hearing was duly continued to July 26th, at each of which times all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That subject property, presently zoned R-2, . lies between property on the east and north zoned for and developed to R-l uses and property on the south which is zoned R-3; that its R-2 zoning has served as a buffer between the R-l and R-3 zones. That although its rezoning to R-3 uses, with the type and number of multiple dwellings that could then be constructed thereon, would be detrimental to the single-family residences in the neighborhood, certain restrictions would still allow the property to serve as a buffer zone between property zoned R-l and property zoned R-3 -1- 382 . . . without such detriment to neighboring single-family residences. SECTION 2. That plans for subject property show a pro- posed street at the north side which would act as a buffer to the R-l property at the north. That all property on the west side of Sixth Avenue between Live Oak Avenue and the proposed street with the exception of subject property is zoned either C-2 or R-3. That the foregoing constitutes an exceptional condition that does not ap- ply generally to property in the same vicinity. That the granting of a variance for specified multiple-family uses with the restrictions hereinafter recommended will not only afford the relief necessary for the preservation of a substantial property right of the appli- cant, but will not be materially detrimental to the surrounding prop- erty nor will it adversely affect the comprehensive general plan. SECTION 3. That for the foregoing reasons, this Commis- . sion recommends to the City Council of the City of Arcadia that the foregoing application for a zone change be denied, but that a vari- ance be granted to allow no more than eight dwellings units on sub- ject property, subject to all the regulations of Zone R-3 and that all plans shall be submitted to the Planning Commission for approval as to plot plan, architectural treatment, wall and landscaping be- fore issuance of a building permit. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be forwarded . to the City Council of the City of Arcadia.
