RESOLUTION NO. 371 A RESOLUTION OF THE CITY PLANNING COlVIMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE CLASSIFICATION OF THE BUSINESS OF CONSTRUCTING, MAINTAINING AND OPERATING A DEMONSTRATION HOME AS A USE PERMISSIBLE IN ZONE C-M UNDER ORDINANCE NO. 760 OF THE CITY OF ARCADIA. vrnEREAS, Miller Myers, a building contractor, has requested a classification under Ordinance No. 760 of the City of Arcadia of the business of constructing, maintaining and operating a demonstra- tion home; and, vrnEREAS, ambiguity has arisen concerning the appropriate classification of such use within the meaning and intent of Ordinance . No. 760 of the City of Arcadia; and, WHEREAS, Section 15-A-l of said Ordinance No. 760 provides in part ", . . if ambiguity arises concerning the appropriate classi- fication of a particular use within the meaning and intent of this Ordinance . . it shall be the duty of the City Planning Commission to aScertain all pertinent facts concerning said use and by resolu- tion of record set forth its findings and the reasons therefor. ."; and, WHEREAS, at a regular meeting of the City Planning Commis- sion said Commission ascertained all pertinent facts concerning the business for which classification has been requested. . NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA DOES HEREBY FIND, DETERMINE, RESOLVE AND RECOMMEND AS FOLLOWS: SECTION 1. That the business of constructing, maintain- ing and operating a demonstration home be classified as a use per- missible in Zone C-M under Ordinance No. 760 of the City of Arcadia, subject to the following conditions: -1- 371 . . . 1. That the demonstration home shall not be used as liv- ing quarters or for business purposes other than the demonstration or sale of a home to be constructed elsewhere. 2. That the demonstration home shall be constructed on concrete piers rather than a continuous concrete foundation. 3. That the demonstration home shall not be connected to a water supply or to the sanitary sewer or any other sanitary facility. 4. That notwithstanding any contrary regulations con- tained in the Building Code, a demonstration home may be constructed of any materials approved by the Building Code. . 5. That no demonstration home may be constructed less than five (5) feet from any property line. SECTION 2. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 12th day of April , 1960, by the following vote: AYES: Commissioners Forman, Golisch, Michler, Norton and Acker NOES: None ABSENT: Commissioners Davison and Stout /~4~~~~ / .
