RESOLUTION NO. 370 A RESOLUTION OF THE CITY PLANNING COMMISSION OF T}ffi CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A ZONE VARIANCE AND/OR SPECIAL USE PEm~IT TO ALLOW THE CONSTRUCTION AND OPERATION OF A FIFTY-SEVEN BED CONVALESCENT HOME. . WHEREAS, there was filed with this Commission on the 23rd day of February, 1960, the application of Sophia P. Johnson and Orlando Clarizio, requesting a zone variance and/or special use per- mit to allow the construction and operation of a fifty-seven bed convalescent home upon the fOllowing described property located at 1601 South Baldwin Avenue in the City of Arcadia, County of Los Angeles, State of California, to wit: The North 138.286 feet of Lot 4, Block G, Santa Anita Land Company's Tract, as shown on map recorded in Book 6, page 137, of Maps, Records of Los Angeles County, ex- cepting the westerly 150 feet thereof; and, WHEREAS, after notice required by Ordinance No, 760 of said City, as amended, a publiC hearing was duly held on the matter by and before this Commission on the 22nd day of March, 1960, at which time all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLO,vS: SECTION I. That there were numerous oral protests to the . granting of the requested zone variance and/or special use permit, all from neighboring property owners. That only the attorney for applicants and a member of the American College for Hospital Ad- ministrators spoke in favor of the application. -1- 370 " I .- . . SECTION 2. That subject application is but a revision of ... a previous similar request, denied by the Planning Commission on denie'd November 10, 1959 by Resolution No. 350, and later/by the City Coun- cil on December 15, 1959 by Resolution No. 3199. That although this application does show some changes in the architectural plans that would make the building more desirable and allow for more parking, the basic reasons for denying the previous application in November 1959 still remain, That the question is not whether there is need for more convalescent facilities in this City or whether the plans presented are desirable, but rather the use of property at the particUlar location for the purpose of a convalescent home, SECTION 3. That the rezoning of Annexation 14 and Annexa- tion 17-A is presently under consideration by the City Council; that ... the granting of a variance and/or special use permit for a convales- cent home at the above location at this time could well be materi- ally detrimental and injurious to the property and improvements in the vicinity in which the property is located. That the planned widening of Baldwin Avenue to provide means of travel between major freeways and to handle peak periods of vehicular travel becomes ever more important as the plans for the freeway develop, and the granting of the requested variance and/or special use permit would affect the comprehensive general plan. SECTION 4. That it was not shown at the time of the pre- vious application nor in connection with the present application that there are exceptional or extraordinary circumstances or condi- ... tions applicable to the property involved or to the intended use of the property that do not apply generally to other property in the same zone or vicinity, nor that such variance and/or special use permit is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other -2- 370 . ~ , . . . property in the same zone or vicinity; nor that the granting of such variance and/or special use permit will not be materially detrimental to the public health and welfare. That it has not been shown there is any change in the conditions applicable to subject property since the first application was filed. SECTION 5. That for the foregoing reasons, this Commis- sion recommends to the City Council that the requested variance and/or special use permit for the construction and operation of a fifty-seven bed convalescent home on the above described property be denied. SECTION 6. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be for- . warded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 12th day of April , 1960, by the following vote: AYES: Commissioners Forman, Golisch, Michler, Norton and Acker NOES: None ABSENT: Commissioners Davison and Stout Chairman ATTEST: "1 I . -3- 370
