NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: SECTION 1. That there were several oral protests to the granting of the requested zone variance and eighteen property owners signed a petition as opposing it. SECTION 2. That on June 16, 1953, the Arcadia City Coun- cil granted a zone variance to permit this property and other prop- erties on the west side of Baldwin Avenue, all zoned R-l, to be used for the construction of one-story apartment houses upon speci- all fied conditions and/development in the entire block upon which the initial variance was granted has been with one-story apartments; thus the granting of the requested variance would affect the com- . prehensive general plan in the area. That subject property is zoned R-l with a lot area of 108.06 feet by 220 feet, containing 23,773 square feet, and the plan submitted by applicant does not even meet the requirements of the present R-3 zoning ordinance which requires 1500 square feet of lot area per family and 1-1/2 parking spaces per unit, each 10 feet wide. SECTION 3. That it was not shown that there are excep- tional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to other property in the same zone or vi- cinity; nor was it shown that such zone variance is necessary for the preservation and enjoyment of a substantial property right of . the applicant possessed by other property in the same zone or vi- cinity, particu1ary in view of the variance heretofore granted with respect to subject property, which relief is still available to applicant. That it was not shown that the granting of the re- quested zone variance will not be materially detrimental to the -2- 368 ,.. - . . pUblic health and welfare or injurious to the property or improve- . ments in the same zone or vicinity in which the property is located; that the granting of applicant's request would permit the use of subject property in a manner totally different from and detrimental to similar adjacent properties. SECTION 4. That for the foregoing reasons, this Commis- . sion recommends to the City Council that the requested zone variance for the construction and operation of a 16 unit, two-story apartment house on the above described property be deni~d.
