RESOLUTION NO. 360
A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, RECOMMENDING THE
GRANTING OF A VARIANCE TO PERMIT
THE ESTABLISHMENT AND OPERATION OF
A MINIATURE GOLF COURSE AT 131-137
EAST LIVE OAK AVENUE.
vffiEREAS, there was filed with this Commission on Janu-
ary 15, 1960 the application of Russell H. Uhl, as Lessee, for a
zone variance to permit the establishment and operation of a minia-
.
ture golf course upon the following described property located at
131-137 East Live Oak Avenue in the City of Arcadia, County of Los
Angeles, state of California, to wit:
Lots 1 and 43, Tract No. 12915, as shown on map
recorded in Book 270, page 10, of Maps, records
of Los Angeles County;
and,
WHEREAS, after notice required by Ordinance No. 760 of
said City, as amended, a public hearing was dUly held on the matter
by and before this Commission on the 26th day of January, 1960, at
which time all interested persons were given a full opportunity to
be heard and to present evidence;
NOW, THEREFORE, THE CITY PLANNING Cm-lMISSION HEREBY DETER-
MINES AND RESOLVES AS FOLLOWS:
SECTION 1. That there were no oral or written protests
to the granting of the requested variance.
SECTION 2. That subject property is zoned R-3 but is in
... an area in which this Commission has recommended commercial zoning
upon compliance with certain conditions; that the property to the
east is zoned C-O and to the west there is an existing medical center.
SECTION 3. That the granting of a variance upon the con-
ditions hereinafter recommended will not be materially detrimental

to the public health or welfare or injurious to the property or im-
. provements in the same zone or vicinity in which the property is
located. That such variance is necessary for the preservation and
enjoyment of substantial property rights of the applicant possessed
by other property in the same zone and general vicinity. That the
requested variance will not be inconsistent with good planning
practice nor with the present or prospective development of the
neighborhood in which the property is located.

SECTION 4. That for the foregoing reasons, this Commis-
sion recommends to the City Council of the City of Arcadia that a
variance be granted to permit the establishment and operation of
a miniature golf course located upon the above described property
upon the following terms and conditions:
a. That a 6-foot concrete block wall shall be constructed
along the north line of the property.
b. That the north 5 feet of the property shall be land-
scaped and maintained.
c. That the south 20 feet of the north 25 feet of the
property shall be used for parking purposes only.
d. That the south 20 feet of the north 45 feet of the
property shall be dedicated.for a~ley purposes and fully improved
with concrete gutter and asphaltic pavement.
e. That the south 20 feet of the north 65 feet of the
property shall be used for parking purposes only.
f. That the only use authorized by reason of the vari-
ance hereby granted is the establishment, maintenance and operation
of a miniature golf. course, and shall not include any other uses
customarily associated with or conducted in connection with or in-
cidental to a miniature golf course.
g. That no loudspeaker or public address system shall
be installed on the premises or used in connection with the minia-
ture golf course authorized by the variance hereby granted.

h. That all exterior lights on the subject property in-
cluding signs, shall be so installed and operated that they do not
shine upon or directly illuminate any adjacent property.
i. That the conduct or use of the miniature golf course
shall not be permitted between the hours of 12:00 o'clock midnight
and 8:00 o'clock A.M. of any day.
j. That the owner and operator of the miniature golf
course shall prohibit and prevent both the possession and consump-
tion of beer, wine and alcoholic liquor on the subject property so
long as the miniature golf course is maintained or operated thereon,
and shall prohibit and preclude the sale of beer, wine and alco-
holic liquor on subject property, so long as the miniature golf
course is maintained or operated on the subject property.
k. That all buildings on the site shall meet all re-
quirements of buildings in No.1 Fire District.
1. That the development of the property shall conform
substantially with the ~lot plan submitted.
m. That each of the foregoing conditions shall continue
throughout the entire time that the miniature golf course is main-
tained or operated on subject property.
SECTION 5. That the violation of anyone or more of the
above conditions shall constitute grounds for the modification or
revocation of the variance hereby recommended.
SECTION 6. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Planning Commission held on the
9th day of February , 1960, by the following vote:
