RESOLUTION NO. 366
.
A RESOLUTION OF Trill CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, RECOMMENDING THE DENIAL
OF A ZONE VARIANCE FOR THE
CONSTRUCTION AND OPERATION OF A
SERVICE STATION AT THE CORNER OF
HUNTINGTON BOULEVARD AND SUNSET
BOULEVARD IN SAID CITY.
WHEREAS, there was filed with this Commission on the 1st
day of February, 1960, the application of P. L. McNutt, John A.
Marshall and Prudence M. Marshall, as owners, for a zone variance

to permit the construction and operation of an automobile service
station on property located at the southwest corner of Huntington
and Sunset Boulevards, in the City of Arcadia, County of Los Angeles,
state of California, described as follows:
Part of Lot 4, Tract No. 2731, as shown on map
recorded in Book 33, page 29, of Maps, records
of said County, beginning at the northeast
corner of said lot; thence south along the east
line 125 feet; thence west parallel with the
north line 112.88 feet; thence north 125 feet
to the north line; thence east thereon 112.88
feet to the point of beginning;
and,
WHEREAS, after notice required by Ordinance No. 760 of
said City, as amended, a publiC hearing was duly held on the matter
by and before this Commission on the 23rd day of February, 1960, at
which time all interested persons were given a full opportunity to
be heard and to present evidence;
NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER-
MINES AND RESOLVES AS FOLLOWS:

SECTION 1. That there were many oral protests to the
granting of the zone variance but only those directly interested fi-
nancially in the proposed use appeared to speak in favor of it.
SECTION 2. That except for the business area on the north
side of Huntington Drive between Cortez Road and flichillinda, most

of the property is now devoted to R-3 uses and has been developed
. with exceptionally fine apartment buildings; that all of the recent
development has been for R-3 uses and there are no exceptional or
extraordinary circumstances to prevent the owners from developing
subject property for a similar use. That at the time subject prop-
erty was purchased by the applicants in September of 1959 it was
zoned R-3 and the requested variance is not necessary for the pres-
ervation of any property right of the applicants.
SECTION 3. That the area is not in any particular need
of a service station as there are many within a mile radius; and the
granting of a variance on this southwest corner would open the way
for similar requests for the other three corners at this location,
which would be detr1mental to the property in the same neighborhood

and zone. That the granting of a variance for this particular lot
would in effect constitute spot zoning which would adversely affect
the comprehensive general plan.
SECTION 4. That for the foregoing reasons, this Commis-
sion recommends to the City Council that the requested variance
and/or special use permit for the construction and operation of an
automobile service station on the property hereinabove described
be denied.
SECTION 5. The Secretary shall certify to the adoption
of this resolution and shall cause a copy of the same to be for-
warded to the City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Planning Commission held on the
