RESOLUTION NO. 36l .A RESOLUTION OF THE CITY PLANNING COIIfMISSION OF THE CITY OF ARCADIA, C.ALIFORNIA, RECOMMENDING THE GRANTING OF A VARIANCE FOR THE CONSTRUCTION, MAINTENANCE AND OPERATION OF A CHURCH AND FOR CHURCH PARKING AT THE NORTHWEST CORNER OF SANTA fu~ITA AVENUE AND FOOTHILL BOULEVARD. WHEREAS, there was filed with this Commission on the 26th day of January, 1960, the application of the Shepherd of the Hills Evangelical Lutheran Church, as owners subject to escrow, signed by Herbert I. Chambers, Chairman, Site Committee, for a zone vari- ance to permit the construction of a churCh and for church parking upon the following described property located at the northwest . corner of Santa Anita Avenue and Foothill Boulevard in the City of Arcadia, County of Los Angeles, State of California, to wit: Lot 77, Tract No. 11074, as shown on map re- corded in Book 197, pages 28 and 29, of Maps, records of Los Angeles County; and, A portion of Lot 5, Tract No. 948, as shown on map recorded in Book 17, page 21, of Maps, records of Los Angeles County, described as follows: Beginning at the intersection of the west line of Santa Anita Avenue (100 feet wide) with the north line of Foothill Boulevard (80 feet wide); thence west along the north line of Foothill Boulevard 250 feet; thence north parallel with the west line of Santa Anita Avenue 250 feet; thence east parallel with the north line of Foothill Boulevard 250 feet to the west line of Santa Anita Avenue; thence south thereon 250 feet to the point of beginning; . and, WHEREAS, after notice required by Ordinance No. '60 of said City, as amended, a public hearing was duly held on the matter by and before this Commission on the 9th day of February, 1960, at Which time all interested persons were given a full opportunity to be heard and to present evidence; -1- 361 . . . . . NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOV1S: SECTION 1. That nwnerous property owners signed the peti- tion as favoring the requested variance and a majority of the audi- ence indicated they were in favor of the variance. Only one spoke against the granting of the requested variance. SECTION 2. That subject property has a frontage of 349.79 feet on Foothill Boulevard and 250 feet on Santa Anita Avenue. That a 250 foot square on the corner of Foothill Boulevard and Santa Anita Avenue is zoned C-2; that it has been represented that the ser- vice station now located thereon will ultimately be removed and the main church building erected at the expiration of the lease in ap- proximately 13 years. That Lot 77 is zoned R-O and has a frontage of 99.79 feet on Foothill Boulevard. That the rear portion of Lot 77 and the north portion of the C-2 property will be used for church parking. That the applicant is also acquiring Lot 78 which is zoned R-O, and upon which they plan to build a residence dwelling for the minister and which will act as a buffer between the church and the residential property to the west. SECTION 3. That the intended use of the property for a church and church parking constitute exceptional circumstances that do not apply generally to properties or classes of use in the same zone or vicinity. That the public welfare and convenience reasona- bly require the granting of the variance, and upon the conditions recommended said variance will not be inconsistent with good planning practice, nor with the present or prospective development of the neighborhood in which the property is located. SECTION 4. That for the foregoing reasons, this Commis- sion recommends to the City Council of the City of Arcadia that a -2- 36l - .. . . variance be granted to permit the construction, maintenance and op- . eration of a church and for church parking on the above described property upon the following conditions: a. That the entire development shall conform substan- tial1y with the plot plan submitted. b. That the parking lot shall be paved and separated from adjacent residential property by a 6-foot masonry wall and there shall be approximately 5 feet of landscaping installed ad- jacent to the wall. c. That a variance from the provisions of Fire Zone No. 1 be granted so that the construction of the church building may corre.spond with other churches outside the No. 1 Fire Zone. d. That the final plot and building plans shall be sub- . mitted to and first be approved by the Planning Commission before issuance of a building permit. SECTION 5. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia.
