RESOLUTION NO. 356-A A RESOLUTION OF THE CITY PLANNING CO~WITSSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRlINTING OF A REQUESTED ZONE RECLASSIFICATION FROM ZONE PR-l TO ZONES C-2 AND D OF CERTAIN PROPERTY LOCATED NEAR THE NORTHEAST CORNER OF FOOTHILL BOULEVARD AND SECOND AVENUE IN SAID CITY. WJiEREAS, there was filed with this Commission on the 21st day of October, 1959, the application of Elvin T. Wayment and others, as owners, for a zone reclassification from Zone PR-l to Zones C-2 and D (ArChitectural Overlay) of property located near the northeast corner of Foothill Boulevard and Second Avenue in the City of Arcadia, County of Los Angeles, State of California, de- scribed as follows: All of Lots 1, 2 and 3, Tract No. 12834, as shown on map recorded in Book 262, page 24, of Maps, records of said County, except the southerly 135 feet thereof; and, WHEREAS, after notice required by Ordinance No. 760 of said City, as amended, a public hearing was dUly held on the mat- ter by and before this Commission on the lOth day of November, 1959, which hearing was continued to November 24, 1959, for a re- port from the Zoning Committee, at each of which hearings all in- terested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMliJISSION HEREBY DE- TERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That there were no written protests to the granting of the requested zone change. That the signers of the application were owners of some portion of the property for which the change was requested, and only those directly concerned with the proposed use of the property for a grocery store spoke in favor of the change. -1- 356 -A . . . . . SECTION 2. That applicant can construct a building sub- stantially as proposed but entirely on property already zoned C-2, and provide the required off-street parking on subject property already zoned PR-1. That such construction would create a hazard- ous blind corner at the intersection of Second Avenue and Foothill Boulevard, would not prOVide for the best use or development of the property, and would provide ve~J little protection to adjacent residential properties to the north. That the reclassification of subject property as hereinafter recommended, and the imposition of the regulations hereinafter stated, will prOVide for the best use and development of the subject property, will afford the greatest protection and cause the least possible injury to adjacent resi- dential properties and improvements, and is amply justified by good zoning practice. SECTION 3. That for the foregoing reasons this Commis- sion recommends that all of the above-described property be classi- fied as and reclassified from Zones PR-l and C-2 to Zone C-2 and also Zone D (Architectural Overlay), and that the following re- strictions should be made applicable to all of said property under said Zone D (Architectural Overlay): a. The building height shall be limited to one story and not more than twenty (20) feet high at the north wall. b. No Signs shall be placed on the north wall of the building, except identification signs at the rear doors of the shops. c. The parking lot shall be separated from residential property by a masonry wall. d. All exterior lighting shall be directed away from resi- dential property. e. All storage of crates, bottles, trash, etc., shall be within the building. f. All air conditioning equipment shall be within the -2- 356-A . . building. . g. All construction and improvements upon the property shall conform with the elevation submitted by applicant and marked Exhibit "B" and in accordance with the revised plot plan submitted by applicant and marked Exhibit "C". All plans for any other or additional construction or improvements or changes in aforesaid elevation and revised plot plan shall be subject to the approval of and first be approved by either the Planning Commission or the City Council. The Planning Commission and the City Council retain authority to make minor modifications in any of the foregoing regulations, elevation and plot plan, if such modifications are necessary and desirable and will accomplish substantially the same results as will the strict adherence to the specified regulations, . plot plan and elevation. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be for- warded to the City Council of the City of Arcadia.
