RESOLUTION NO. 355 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOrllMENDING THE AMEND~mNT OF ORDINANCE NO. 760 OF SAID CITY BY THE RECLASSIFICATION TO ZONES C-2, C-3 AND D, UPON PERFORMANCE OF SPECIFIED CONDITIONS PRECEDENT, OF ALL THAT PROPERTY BOUNDED BY DUARTE ROAD, LOVELL AVENUE, CAMINO REAL AND BALDWIN AVENUE AND NOT ALREADY ZONED COMMERCIALLY. THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION l. That as the result of numerous applications requesting the reclassification of individual parcelS of property . in the area, this Commission did on the 14th day of JUly, 1959, under and pursuant to its Resolution No. 335, institute proceedings for the purpose of considering and making recommendations concern- ing the reclaSSification, from Zone R-l to Zones C-3 and D, from Zone R-2 to Zones C-3 and D, and from Zone R-2 to Zone C-2, of all that property in the City of Arcadia not already zoned for commer- cial uses and bounded on the north by Duarte Road, on the east by Lovell Avenue, on the south by Camino Real and on the west by Baldwin Avenue. That after due notice as required by Ordinance No. 760, as amended, a public hearing was duly held on the matter by and before this Commission on the 11th day of August, 1959, which . hearing was continued to August 25, 1959, still further continued to September 8, 1959, again continued to October 13, 1959, and still further continued to November lO, 1959, at each of Which times all interested persons were given a full opportunity to be heard and to present evidence. SECTION 2. That there were many protests, both oral and written, to the reclassification thus proposed, and there were -1- 355 . . . those who signed petitions and who also appeared to orally support the rezoning of certain parcels of said property, although there were no protests from residents on Naomi Avenue or the east side of Lovell Avenue. That none of the owners of property abutting Camino Real expressed any particular desire for commercial zoning at the hearing, although several property owners on the north side of Camino Real have since expressed a wish for C-3 zoning; and all the property owners on the south side of Camino Real objected to making Camino Real the dividing line between zones. SECTION 3. That if and when the proposed commercial zon- ing is granted on the north side of Camino Real, consideration should also be given to the south side of said street. That the development . of the area for commercial uses requires the opening of alleys and the dedication and widening of streets to handle traffic in the area. That certain screening and planting will be required to serve as a barrier between the commercial areas thus created and the adjacent residential uses, and such improvements should be installed before or concurrently with the zoning. That it would not be practical to do all such development in the entire area at one time, and for this reason the area proposed to be reclassified to commercial uses should be divided into smaller areas as hereinafter described. SECTION 4. That property zoned R-2 and presently occupied by a church, located at 1424 South Baldwin Avenue in the City of Ar- cadia, County of Los Angeles, State of California and described as follows: . Lot 1, except the North 50 feet and the East 100 feet, Tract No. 5907 as shown on map re- corded in Book 63, page 67, of Maps, records of said County, should be reclassified to Zone C-2. -2- 355 . . . SECTION 5. That property in the City of Arcadia, County of Los Angeles, State of California and described as follows: Lots 1 to 9, inclusive, Tract No. 8487, as shown on map recorded in Book 1l4, page 48, of Maps, records of said County, Lot 5 to 14, inclusive, and Lots 16 to 27, inclusive, Tract No. 4611, as shown on map recorded in Book 51, page 82, of Maps, re- cords of said County. The East lOO feet of Lots 1, 2 and 3, and all or Lots 4 to 9, inclusive, Tract No. 5907, as shown on map recorded in Book 63, page 67, of Maps, records of said County, should be reclassified to Zone C-3 upon the following conditions: a. Dedicate 12 feet ror the widening or Duarte Road. b. Dedicate the extension of the 30 foot alley south of Duarte Road into Lovell Avenue. . c. Dediate 12 feet on each side of Naomi Avenue for street widening. d. Dedicate 24 feet on the west side of Lovell Avenue for street widening. e. Provide a continuous north-south alley east of Bald- win Avenue from Camino Real to the present alley north of Naomi. f. Dedicate a 30 foot alley approximately midway be- tween Naomi Avenue and Camino Real from the north-south alley to Lovell Avenue. g. Dedicate 24 feet on the north side of Camino Real for street widening. h. The cost of the improvement of all of the above dedi- cations, except the paving of Duarte Road, to be borne by the prop- . erty owners. SECTION 6. That the property described in Section 5 here- inbefore should, concurrent with its classification as Zone C-3, be classified also as and placed in Zone D (Architectural Overlay) and that the ro1lowing restrictions should be made applicable thereto under said Zone D (Architectural Overlay) : -3- 355 . . . . . a. Screen the business development on Lovell Avenue from the street and the residential property to the east as follows: (1) Landscape and maintain the first 10 feet west of the new property line. (2) Construct an ornamental masonry wall, ranging from 4-1/2 to 5-1/2 feet in height, located lO feet west of Lovell Avenue. (3) The next 60 feet west of the wall to be devoted to public parking with no buildings to be constructed. b. Landscape and beautify the rront of the lots facing Naomi Avenue as follows: (l) No building to be constructed nearer than 15 feet from the new property line on Naomi Avenue (2) At least 9 feet of the above 15 foot setback to be landscaped and maintained. c. Landscape and maintain, construct wall and provide parking along the north side of Camino Real identically with that required along Lovell Avenue. d. No vehicular access to be allowed to the C-3 area from Lovell Avenue or Camino Real, except at the dedicated alleys. e. The southwest corner of Duarte Road and Lovell Avenue to have special spectacular landscape treatment. f. Signs to be limited to one square foot of area for each foot of building frontage. All signs to be mounted flat against the building and no flashing or roof signs to be allowed. g. All lighting of the area and the buildings to be directed away from adjoining residential property. h. All plans to be submitted to the Planning Commission for approval as to plot plan, architectural treatment, walls, land- scaping and signs before issuance of a building permit. -4- 355 . . SECTION 7. That the property described in Section 5 above . should be divided into four districts as hereinafter set forth, and that when all the requirements set out in Section 5 above have been complied with as to all parcels in anyone such district, the prop- erties in such district should be reclassified without further hear- ings. That said districts should respectively comprise the follow- ing property in the County of Los Angeles, State of California, to wit: District 1 Lots 1 to 9, inclusive, Tract No. 8487, as shown on map recorded in Book 114, page 48, of Maps, records of said County. District 2 . Lots 5 to 14, inclusive and Lot 16, Tract No. 4611, as shown on map recorded in Book 51, page 82, of Maps, records of said County. District 3 Lots 17 to 27, inclusive, Tract No. 4611, as shown on map recorded in Book 5l, page 82, of Maps, records of said County. District 4 East 100 feet of Lots 1, 2 and 3, and all of Lots 4 to 9, inclusive, Tract No. 5907, as shown on map recorded in Book 63, page 67, of Maps, re- cords of said County. SECTION 8. That this Commission and the City Council should retain the authority to make minor modifications in the spec i- fied areas and conditions, if such modifications are needed and de- sirable and will accomplish substantially the same results. That if, within two (2) years after date hereof, all of the conditions re- . quired by Section 5 hereinabove shall not have been fulfilled as to all of the properties in anyone district enumerated in Section 7 above, the properties within such district should again be reviewed by this Commission and by the City Council and appropriate action thereafter taken with respect thereto. -5- 355 . . . . . SECTION 9. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be for- warded to the City Council of the City of Arcadia.
