RESOLUTION NO. 344

A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, RECOMMENDING THE DENIAL
OF AN APPLICATION FOR CHANGE OF ZONE
FROM ZONE R-l TO ZONES C-2 AND D, ON
PROPERTY AT 2714 AND 2720 SOUTH
BALDWIN AVENUE AND ON THE REAR
PORTION OF PROPERTIES AT 541 AND 547
WO~ffiN AVENUE AND FROM ZONE R-l TO
ZONES PR-3 AND D ON THE REAR PORTION
OF PROPERTY AT 535 WORKMAN AVENUE IN
SAID CITY.
WHEREAS, there was filed with this Commission on JUly 29,
1959, the application of Bernard Berk, as optionee, and the appli-
cation of Ralph D. Stogsdill, as owner, for a change of zone from
Zone R-l to Zones C-2 and D on the lots at 2714 and 2720 South
Baldwin Avenue and on the rear portion of the properties at 541 and
. 547 Workman Avenue; also a change of zone from Zone R-l to Zones
PR-3 and D on the rear portion of the property at 535 Workman Ave-
nue in the City of Arcadia, County of Los Angeles, State of Cali-
fornia, to wit:
Lots 41 and 42, Tract No. 6641, as shown on
map recorded in Book 126, page 67, of Maps,
Records of Los Angeles County;
The North 101 feet of Lots 39 and 40, Tract
No. 6641, as shown on map recorded in Book
126, page 67, of Maps, Records of Los
Angeles County;
The North 41 feet of Lot 38, Tract No. 6641,
as shown on map recorded in Book 126, page
67, of Maps, Records of Los Angeles County;
and,

WHEREAS, after notice as required by Ordinance No. 760,
as amended, a public hearing was duly held on the matter by and be-
fore this Commission on the 11th day of August, 1959, which said
hearing was continued to August 25, 1959, for staff and zoning com-
mittee reports, at each of which times all interested persons were
given a full opportunity to be heard and to present evidence;

. NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER-
MINES AND RESOLVES AS FOLLOWS:

SECTION 1. That a petition containing seventy-seven sig-
natures of owners and residents in the area was presented to this
Commission, protesting the requested reclassification for reasons
therein set forth. That in addition, numerous oral protests and
arguments against the requested reclassification were made at the
hearing, based on the detrimental effect the requested reclassifi-
cation and the proposed improvement of the property would have on
adjacent residential properties.
SECTION 2. That all of subject lots on Workman Avenue,
as well as other adjacent Workman Avenue lots, are already devel-
oped with single-family residences of good quality. That the prop-
erty adjacent to the north, facing Las Tunas Drive, now has com-
mercial zoning, and the easterly portion thereof is now used for a
miniature golf course and a restaurant. That across Baldwin Ave-
nue, in territory recently annexed to the City, the lots are de-
veloped with apartments and single-family residences. That if
this request were approved, the C-2 zone would extend approximately
200 feet further south on the east side of Baldwin than the present
business use on the west side.
SECTION 3. That the applicant has not shown a pUblic
necessity for the change, but only stated that such a change would
complete the zoning in the block, with the exception of one lot,
and has referred to the widening of Baldwin Avenue to improve traf-
fic flow. That though the widening of the full length of Baldwin
Avenue is being considered, its rezoning to commercial uses for its
entire length is not necessarily contemplated. That applicant has
not shown that the requested reclassification would not be detri-
mental to residential property, and numerous owners in this vicinity

. state that in their opinion it would be detrimental. That the pres-
ent C-2 zoning on the east side of Baldwin Avenue is almost exactly
opposite the present commercial use on the recently annexed west
side. That the requested extension of the zone would create 165
feet more commercial zone directly across the street from residen-
tial property. That the property values of a good residential area
would, by the requested reclassification, be jeopardized for the
benefit of one property owner. That there is now sufficient com-
mercial zoning on this corner to act as a buffer between the com-
mercial development west of Baldwin Avenue and the residential de-
velopment to the east, and that any extension of the commercial zon-
ing either south or east will only tend to increase the problem that
always exists where commercial and residence zones abut. That the
. existence of more than a dozen large markets in the City of Arcadia
appears ample to serve the needs of the area, and it has not been
shown by applicant that the public necessity, convenience or general
welfare require the requested reclassification of subject properties.
SECTION 4. That for the foregoing reasons this Commission
recommends the denial of the requested reclassification of subject
properties.
SECTION 5. The Secretary shall certify to the adoption of
this resolution and shall cause a copy of the same to be forwarded

to the City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Planning Commission held on the
25th day of August, 1959, by the following vote:
