RESOLUTION NO. 343 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A REQUESTED ZONE VARIANCE TO PERMIT THE CONSTRUCTION OF AN ADDITIONAL DWELLING ON PROPERTY LOCATED AT 141 WEST COLORADO BOULEVARD. WHEREAS, there was filed with this Commission on July 16, 1959, the application of Roccie J. and Lorraine R. Schavoni, as owners, for a zone variance to permit the construction of an addi- tional dwelling upon the following described property located at 141 West Colorado Boulevard in the City of Arcadia, County of Los Angeles, State of California, to wit: That portion of Lot 1, Tract No. 949, as shown on map recorded in Book 17, page 13, of Maps, records of Los Angeles County, described as follows: Beginning at a point in the north line of Colorado Boulevard distant West thereon 471.34 feet from the northeast line of said lot; thence West on said north line 105 feet; thence North 457.35 feet to the northeast line of said lot; thence southeast thereon 134.04 feet; thence South 374.03 feet to beginning, containing one acre; and, WHEREAS, after notice required by Ordinance No. 760 of said City, as amended, a public hearing was duly held on the matter by and before this Commission on the 11th day of August, 1959, at which time all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: SECTION l. That while seven property owners in the neigh- borhood signed the application as not being opposed to the granting of the variance, no one spoke in favor of it at the hearing and , -1- 343 I .4., -, ' . . . there was one oral protest and a written protest from a property owner who had previously signed as not being opposed to the vari- ance. SECTION 2. That it was not shown that there are excep- tional circumstances applicable to subject property, nor that the variance is necessary for the preservation and enjoyment of sub- stantial property rights of the applicant possessed by other prop- erty in the same zone and vicinity. That it was not shown that the granting of the requested variance would not be injurious to property and improvements in the same vicinity and zone and would not adversely affect the comprehensive general plan. SECTION 3. That for the foregoing reasons, this Commis- . sion recommends to the City Council that the requested variance for the construction of an additional dwelling on the above de- scribed property be denied. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be for- warded to the City Council of the City of Arcadia. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Planning Commission held on the 25th day of August , 1959, by the following vote: AYES: Commissioners Acker, Davison, Forman, Michler, Norton and Wallin NOES: None .
