RESOLUTION NO. 338 A RESOLUTION OF THE CITY PLN~NING CO~4ISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE GRANTING OF A VARIANCE AND/OR SPECIAL USE PERMIT TO ALLOW THE INSTALLATION AND USE OF A 14-FOOT HIGH COMMERCIAL MASTER TELEVISION ANTENNA. WHEREAS, there was filed with this Commission on June 26, 1959, the application of Camden Wilshire Company and Southern Cali- fornia Fringe T.V. Company, the owner and lessee, for a zone vari- ance and/or special use permit to allow the installation and use of a 14-foot high commercial master television antenna upon the follow- ing described property in the County of Los Angeles, State of Cali- . fornia, to wit: Lot 3, Tract No. 23145, as shown on map re- corded in Book 631, pages 90-92, inclusive, of Maps, records of Los Angeles County; located at 2122 Canyon Road; and, WHEREAS, after notice required by Ordinance No. 760, as amended, a publiC hearing was duly held on the matter by and before this Commission on the 14th day of July, 1959, at which time all interested persons were given a full opportunity to be heard and to present evidence; NOirl, THEREFORE, THE CITY PLANNING COMr-USSION HEREBY DETER- MINES AND RESOLVES AS FOLLOirlS: SECTION l. That there were no protests, either oral or ~ written, to the granting of the variance and/or special use permit. SECTION 2. That the use of property for a commercial master antenna is omitted from the lists of uses specified as per- missible in the various zones designated in Ordinance No. 760 as amended. That after due application, this Commission has hereto- fore ascertained all pertinent facts concerning the use of property -1- 338 >' " , . . . . . for a commercial master antenna and, by its Resolution No. 334 adopted June 23,1959, has made its, determinations and recommenda- tions relative thereto; that thereafter the Arcadia City Council, by its Resolution No. 3152 adopted July 7, 1959, determined that the use of property for a commercial master antenna should be clas- sified as a special use under Section 17 of Ordinance No. 760 of the City of Arcadia, and that authority for the location and opera- tion of commercial master antennae should be granted only under the provisions of and upon compliance with the procedure outlined for variances. SECTION 3. That the City has recognized the unique char- acter of the use of property for which the within variance has been requested. That master television antennae must, by their very nature and purpose, be erected and operated at locations which will provide adequate television reception and cannot be arbitrarily confined to geographical zones. That this constitutes an excep- tional and extraordinary circumstance applicable to the intended use of subject property that does not apply generally to other property and class of uses within the City. That the requested variance and/or special use permit is necessary for the preservation and enjoyment of a property right possessed by other property owners in the City of Arcadia in that the construction and maintenance of a commercial master antenna to serve the fringe areas of the City of Arcadia is the only feasible method of providing adequate television reception to persons within such fringe areas. That the granting of the requested variance and/or special use permit will not be con- trary to good planning practice but rather that it will be in har- mony therewith as it will eliminate the necessity of individual property owners erecting a multitude of sizeable and unsightly tele- vision antennas for their individual use. -2- 338 .' <..... . . . . . SECTION 4. That for the foregoing reasons, this Commis- sion recommends to the City Council of the City of Arcadia that a variance and/or special use pernut be granted to permit the con- struction, maintenance and operation of a 14-foot high commercial master television antenna upon the above described property. SECTION 5. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia.
