A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING TIlE DENIAL OF A ZONE VARIANCE TO PERMIT THE PROPERTY AT 290 WEST FOOTHILL BOULEVARD TO BE USED FOR CHURCH PURPOSES. ~REAS, there was filed with this Commission on the 12th . day of May, 1959, the application of the Shepherd of the Hills Evan- gelical Lutheran Church, as owner, signed by the Reverend Ray E. Hansen, requesting a zone variance to permit the following described property located at 290 West Foothill Boulevard, in the City of Ar- cadia, County of Los Angeles, State of California, to wit: Lot 11, except the southerly 3 feet thereof, of Tract No. 20642, as shown on map recorded in Book 599, pages 77 and 78, of Maps, Records of Los Angeles County, to be used for church purposes; and, WHEREAS, after notice as required by Ordinance No. 760, as amended, a public hearing was duly held on the matter by and before this Commission on the 9th day of June, 1959, which said hearing was continued to June 23, 1959 pending a staff and zoning committee report, at each of which times all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, TH~ CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: SECTION 1. That in addition to numerous oral and written ~ protests, a petition signed by twenty-four property owners in the general neighborhood was filed opposing the requested variance on the grounds that the proposed church in a residential neighborhood would create traffic hazards and would reduce residential property values. That subject property and all other nearby property on the south side of Foothill Boulevard is zoned R-l and used for no other purposes, and that the property across the street on the north side of Foothill Boulevard is zoned R-O and used for no other purposes. That subject property is only slightly irregular in shape with a frontage of approximately 230 feet on Foothill Boule- vard and a depth of 377 feet along Burnell Oaks Lane and has an area of 2 acres. That subject property is presently improved with a large, two-story frame dwelling erected some 30 years ago, and with a guest cottage and a three-car garage. That though applicant's petition recites that subject property was acquired by the church on April 19, 1959, the transfer of ownership is not reflected on the tax rolls, the property has not claimed nor been given the tax exemp- tion commonly given to churches, and at the time of the hearings be- fore this Commission the property was in escro\~, the sale to applicant being contingent upon the granting of a variance permitting the use thereof for church purposes. SECTION 3. That subject property is zoned R-l. That ap- plicant has not shown that the variance is necessary for the enjoy- ment of any right of applicant possessed by other property in the same vicinity, nor that publiC necessity, convenience, general wel- fare or good zoning practice justify the requested variance, but rather that such a variance would be detrimental to the residential property in the neighborhood and would not be in the interest of good planning for the City as a whole, and that applicant has no interest therein other tha~ as a potential purchaser. SECTION 4. That for the foregoing reasons, this Commis- sion recommends to the City Council that the request for a variance to permit the above described property to be used for church pur- poses be denied. -2- 336 "';': .,... . . . . . SECTION 5. The Secretary shall certify to the adoption of this resolution and shall cause a copy of the same to be for- warded to the City Council of the City of Arcadia.
