RESOLUTION NO. 331
A RESOLUTION OF THE CITY PLANNING
COMMISSION, OF THE CITY OF ARCADIA,
CALIFORNIA, RECOMMENDING THE
GRANTING OF A VARIANCE TO PERMIT
THE ERECTION OF AN ADDITIONAL
DWELLING.
WHEREAS, there was filed with this Commission on April 29,
1959, the application of Earl H. Madinger and Edna V. Madinger, as
owners, for a zone variance to permit the erection of an additional
dwelling upon the following described property in the County of Los
Angeles, State of California, to wit:
The North 55 feet of the South 260.76 feet of
the West 93.85 feet of Lot 49, Tract No. 808,
as shown on map recorded in Book 16, pages 82
and 83, of Maps, records of said County;
. located at 910 South Fourth Avenue; and,
WHEREAS, after notice required by Ordinance No. 760, as
amended, a public hearing was duly held on the matter by and before
this Commission on the 12th day of May, 1959, at which time all
interested persons were given a full opportunity to be heard and to
present evidence.
NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER-
MINES AND RESOLVES AS FOLLOWS:
SECTION l. That there were no protests, either oral or
written, to the granting of the variance; that six of the nearest
neighbors signed the petition as favoring the variance and there
... were several who spoke in favor of it.
SECTION 2. That the property containing 10,323 square
feet with a 110-foot frontage on Fourth Avenue is zoned R-l. That
in 1947 it was divided into two 55-foot lots and is still assessed
as two lots for tax purposes and for the construction of the sewer

system although it was purchased as one lot by applicant in 1948.
That the plans for the proposed house show it to contain 999 square
feet exclusive of porches and garage, and to be located 25 feet
back from the front of the lot instead of the 35-foot setback re-
quired on Fourth Avenue.
SECTION 3. That the foregoing constitute exceptional con-
ditions that do not apply generally to property in the neighborhood
and that a variance is necessary for the preservation and enjoyment
of a substantial property right of the applicant possessed by other
property in the same zone or vicinity. That the granting of a vari-
ance upon the conditions hereinafter recommended will not be mate-
rially detrimental to the public health or welfare or injurious to
the property or improvements in the zone or vicinity where the
property is located, nor will it adversely affect the comprehensive
general plan.
SECTION 4. That for the foregoing reasons, this Commis-
sion recommends to the City Council of the City of Arcadia that a
variance be granted to permit the erection of an additional house
upon the above described property upon the following conditions:
1. That the proposed dwelling be erected at the required
35-foot front setback line.
2. That the proposed dwelling contain not less than 1,000
square feet exclusive of porches and garage.
3. That the applicant submit a revised plot plan to be
approved by the Planning Commission.
SECTION 5. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
