RESOLUTION NO. 322 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, MAKING CERTAIN FINDINGS AND RECOMMENDATIONS RELATIVE TO THE PROPOSED AMENDMENT OF SECTIONS 2, 4, 5, 6 AND 7 OF ORDINANCE NO. 760 OF THE CITY OF ARCADIA. ~1EREAS, pursuant to Section 16 of Ordinance No. 760 of the City of Arcadia, as amended, the City Planning Commission of the City of Arcadia did, on November 12, 1958, pass, approve and adopt its certain Resolution No. 317 entitled "A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, DE- CLARING ITS INTENTION TO INSTITUTE PROCEEDINGS FOR THE CONSIDERA- TION OF AND MAKING RECOMMENDATIONS CONCERNING THE AMENDMENT OF SEC- TIONS 2, 4, 5, 6 AND 7 OF ORDINANCE NO. 760 OF THE CITY OF ARCADIA", pursuant to which notice was duly published and given and a public hearing duly held on the 9th day of December, 1958, which hearing was duly continued to December 23, 1958, at each of which times all interested persons were given a full opportunity to be heard and to present evidence relative to the proposed amendment of Ordinance No. 760 of said City as prOVided in said Resolution No. 317j and, WHEREAS, said Planning Commission has fully reviewed and considered the subject generally; NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE, RESOLVE AND RECOMMEND AS FOLLOWS: SECTION 1. That the public necessity, convenience and general welfare require, and this Commission hereby recommends to the City Council of the City of Arcadia, that Section 2 - Definitions - of Ordinance No. 760 of said City be amended in the following par- ticulars: -1- 322 " - . . That the subsection thereof defining "Building Height" be . changed to read as follows: "BUilding Height: The vertical distance measured from the average level of the highest and lowest point of that portion of the site covered by the building to the highest portion of the roo:!,'." That the subsection thereof defining "Story, Half" be elimi- nated. SECTION 2. That Section 4 - "R-O" First One-Family Zone - of said Ordinance No. 760 be amended by changing Subsection "B - BuildinG Height" to read as follows: "B. BUILDING HEIGHT. No building hereafter erected, con- structed or established shall exceed two (2) stories or thirty- . five (35) feet in height except as provided in Section 15." SECTION 3. That Section 5 - "R-l" Second One-Family Zone - of said Ordinance No. 760 be amended by changing Subsection "B - Height" to read as follows: "B. BUILDING HEIGHT. No building hereafter erected, con- structed or established shall exceed two (2) stories or thirty- five (35) feet in height except as provided in Section 15." . SECTION 4. That Section 6 - "R-2" Two-Family Zone - of said Ordinance No. 760 be amended by changing Subsection "B - Height" to read as follows: "B. BUILDING HEIGHT. No building hereafter erected, con- structed or established shall exceed two (2) stories or thirty- five (3S) feet in height except as provided in Section 15." SECTION 5. That Section 7 - "R-3" Multiple-Family Zone - of Ordinance No. 760 be amended by changing Subsection "B - Height" to read as follows: -2- 322 . . . . . "B. BUILDING HEIGHT. No building hereafter erected, con- structed or established shall exceed two (2) stories or thirty- f:!.ve (35) feet in height except as provided in Section 15." SECTION 6. The Secretary shall certify to the adoption of this Resolution and shall cause a copy of the same to be forwarded to the City Council of the City of Arcadia.
