RESOLUTION NO. 320 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE DENIAL OF A ZONE VARIANCE TO ALLOW THE ERECTION OF A DOUBLE GARAGE WITH AN APARTMENT ABOVE SAME AT 614 SOUTH FIRST AVENUE. WHEREAS, there was filed with this Commission on Octo- ber 14, 1958, the application of Lillie Vetter, as owner, for a zone variance to permit the erection of a double garage with an apartment above the same on the rear portion of the following described prop- erty in the County of Los Angeles, state of California, to wit: Lot 3, Block 63, Tract No. 866, as shown on map recorded in Book 16, pages 198 and 199, of Maps, Records of said County, located at 614 South First Avenue; and, WHEREAS, after notice required by Ordinance No. 760 of said City, as amended, a public hearing was duly held on the matter by and before this Commission on the 28th day of October, 1958, which hearing was duly continued to November 12, 1958, at each of which times all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: SECTION 1. That while a number of the owners of property in the neighborhood signed a petition favoring the granting of the variance, the owner of the property to the east not only filed a written protest but appeared in person and by his attorney to pro- test the granting of the requested variance. SECTION 2. That subject property is zoned C-2 and the proposed plans do not meet the requirement of that zone in that one- half of the area of each building must be devoted to commercial /' ~ .....1 '. -1- 320 -.,I> . . . . - . . . purposes; that the building is proposed to be located in the 20- foot required rear yard and at the rear property line. That sub- ject property in in the No. 1 Fire Zone which requires masonry buildings and that the plans for the proposed building show a masonry wall on one side only. SECTION 3. That it was not shown that there are excep- tional circumstances applicable to subject property, nor that the variance is necessary for the preservation and enjoyment of sub- stantial property rights of the applicant possessed by other prop- erty in the same zone and vicinity. That the granting of the re- quested variance would be injurious to property and improvements in the same vicinity and zone and would adversely affect the com- prehensive general plan. SECTION 4. That for the foregoing reasons, this Commis- sion recommends to the City Council that the requested variance for the construction of a garage with an apartment above at the rear of the property described above be denied. SECTION 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy of the same to be for- warded to the City Council of the City of Arcadia.
