HomeMy WebLinkAbout0316 . . RESOLUTION NO. 316 . A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA. RECOMMENDING THE DENIAL OF A ZONE VARIANCE TO PERMIT THE CONSTRUCTION OF AN ADDITIONAL DWELLING AT 1320 SOUTH SECOND AVENUE. WHEREAS, there was filed with this Commission on March 31. 1958, the application of Philip C. Cain and Kathleen F. Cain, as owners, for a zone variance to permit the erection of one additional . dwelling on the rear portion of the following described property in the County of Los Angeles, State of California, to wit: The north 90 feet of the south 190 feet of the west 220 feet of Lot 29, Tract No. 808, as shown on map recorded in Book 16, pages 82 and 83. of Maps. Records of said County~ located at 1320 South Second Avenue; and, WHEREAS, after notice required by Ordinance No. 760 of said City, as amended, a public hearing was dUly held on the matter by and before this Commission on the 22nd day of April, 1958, which hearing was duly continued to May 13, 1958, at each of which times all interested persons were given a full opportunity to be heard and to present evidence, and at the close of Which hearings this Commission adopted its certain Resolution No. 291 on June 10, 1958, recommending the denial of the requested variance; and, WHEREAS, a written appeal from said decision dated June 16, 1958 was filed with the City Clerk pursuant to which a public hear- ing was duly fixed, noticed and held thereon before the City Coun- . cil on July 15. 1958 at which time all interested persons were given a full opportunity to be heard and to present evidence; that at the conclusion of said hearing said City Council referred the matter back to the Planning Commission without recommendation, in order that said Commission might consider and make recommendations concerning proposed changes in said application and in applicant's intended use of said property; and, .' WHEREAS, after notice required by Ordinance No. 760 of said City, as amended, a public hearing was duly held on the mat- ter by and before this Commission on October 14, 1958, which hear- ing was duly continued to October 28, 1958, at each of which times all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER- MINES AND RESOLVES AS FOLLOWS: SECTION 1. That although there were no oral protests, there were written protests opposing the variance. . SECTION 2. That there has been no substantial change in the facts or conditions concerning subject property since the Com- mission's determination contained in its Resolution No. 291, adopted June 10, 1958; that the amendment of the application has provided no substantial change in the intended use of the property from that shown in the original application. . SECTION 3. That it was not shown that there are excep- tional circumstances applicable to subject property, nor that the variance is necessary for the preservation and enjoyment of sub- stantial property rights of the applicant possessed by other prop- erty in the same vicinity and zone. That the granting of the re- quested variance would be injurious to property and improvements in the same vicinity and zone and would adversely affect the com- prehensive general plan. SECTION 4. That for the foregoing reasons, this Commis- sion recommends to the City Council that the requested variance for the construction of an additional dwelling at 1320 South Second Avenue be denied without prejudice. -2- 316 . . . . . SECTION 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy of the same to be for- warded to the City Council of the City of Arcadia.
