RESOLUTION NO. 308 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, RECOMMENDING THE RECLASSIFICATION OF CERTAIN REAL PROPERTY FROM ZONE R-3 TO ZONE C-2 AND ZONE D LOCATED ON THE NORTH SIDE OF LIVE OAK AVENUE IN SAID CITY. . WHEREAS, there was filed with this Commission on July 10, 1958, the application of Robert F. Williams and Louise W. Wordes, as owners, for the reclassification from Zone R-3 to Zone C-2 and Zone D of the following described real property in the County of Los Angeles, State of California, to wit: Lots 32, 33, 53 and 54, Tract No. 13217, as shown on map recorded in Book 264, pages 26 and 27, of Maps, Records of Los Angeles County, located on the north side of Live Oak Avenue between Third Avenue and Fourth Avenue; and, WHEREAS, after notice required by Ordinance No. 760 of said City, as amended, a public hearing was duly held on the mat- ter by and before this Commission on the l2th day of August, 1958; which hearing was duly continued to August 26, 1958, at each of which times all interested persons were given a full opportunity to be heard and to present evidence. NOW, THEREFORE, THE CITY PLANNING COMMISSION DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: . SECTION 1. That there were protests, both oral and writ- ten,to the requested and proposed reclassification, and there were those who spoke in favor of the change. SECTION 2. That property on the north side of Live Oak -l- 308 --, . . . . . Avenue has developed slowly under its present zoning; that three years ago the Planning Commission, by its Resolution No. 289, recommended zoning for light c'ommercial and professional uses upon certain conditions; and that such rezoning should be on a block basis. That the northeast corner of Live Oak Avenue and Second Avenue is zoned C-l; that the northwest corner of Sixth Avenue and Live Oak Avenue is zoned C-2; that for the most part the County strip on the south side of Live Oak Avenue is zoned commercial. SECTION 3. That for the foregoing reasons this Commis- sion recommends to the Arcadia City Council that the above de- scribed property be reclassified in the manner and upon the condi- tions hereinafter specified: a. That the southerly 70 feet of Lots 32 and 54 of said Tract No. 13217 be classified and placed in Zone C-2; b. That the remainder of Lots 32 and 54 and all of Lots 33 and 53 of said Tract No. 13217 be classified as and placed in Zone PR-3; c. That the foregoing classification be contingent upon the dedication and improvement for alley purposes of a 20-foot strip through the property recommended to be reclassified as and placed in Zone PR-3, the location thereof to conform to the pattern established by engineering drawings on file with this Commission, with portions of such PR-3 zone on each side of such alley, and upon the condition that the Easterly 12 feet of Lots 32 and 33 and the Westerly 12 feet of Lots 53 and 54 of said Tract No. 13217 be dedicated and improved as portions of Fourth Avenue and Third Ave- nue respectively. SECTION 4. That concurrent with the reclassification of aforesaid property as hereinbefore recommended, this Commission recommends that the above described property be also reclassified as and placed in Zone D (Architectural Overlay) in addition to the -2- 308 . L _ . . . basic zoning hereinabove recommended, and that the following re- strictions be made applicable to said property under said Zone D (Architectural Overlay): a. All commercial buildings shall face Live Oak Avenue; b. All businesses conducted on any portion of the above described property shall be conducted within a building; c. No entrances to buildings from side streets shall be permitted more than ten (10) feet from the front building line; d. Vehicular access to all portions of the above de- scribed property shall be by means of the alley hereinabove rec- ommended to be required and improved, as distinguished from the access by means of other curb cuts in Live Oak Avenue, Third Ave- nue or Fourth Avenue; . e. All billboards shall be prohibited; f. The parking lot layout, including walls, landscaping and adequate watering system, shall be in compliance with a plan to be submitted to and approved by the City Planning Commission; g. All flood lighting shall be directed away from all other properties; h. No building or structure shall exceed one story in " height. SECTION 5. The Secretary shall certify to the adoption of this Resolution and shall cause a copy of the same to be for- warded to the City Council of the City of Arcadia.
