A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA,
CALIFORNIA, RECOMMENDING THE
GRANTING OF A ZONE VARIANCE TO
PERMIT THE CONSTRUCTION OF AN
ADDITIONAL DWELLING AT 1208 SOUTH
SIXTH AVENUE.
WHEREAS, there was filed with this Commission on July 16,
195B, the application of W. H. Seimer and F. G. Seimer, as owners,
for a zone variance to permit the erection of one additional dwell-

ing with an attached garage on the front portion of the following
described property in the City of Arcadia, County of Los Angeles,
State of California, to wit:
The south 92.5 feet of the north IB5 feet of
Lot 62, Tract No. 80B, as shown on map re-
corded in Book 16, pages 82 and 83, of Maps,
Records of Los Angeles County,
located at 1208 South Sixth Avenue; and,
WHEREAS, after notice required by Ordinance No. 760 of
said City, as amended, a public hearing was duly held on the matter
by and before this Commission on the 12th day of August, 1958, at
which time all interested persons were given a full opportunity to
be heard and to present evidence;
NOW, THEREFORE, THE CITY PLANNING COMMISSION HEREBY DETER-
MINES AND RESOLVES AS FOLLOWS:
SECTION 1. That there was only one written protest to
the granting of the variance although there was a communication
. signed by several property owners in the immediate viCinity opposing
the granting of the variance until such time as the chickens and
non-conforming buildings are removed from the property.
SECTION 2. That subject property was purchased by appli-
cant at a time when it would have been permissible under R-I regu-
lations to add additional dwellings; that on August

applicants applied to the Modification Committee of the Plalliling
Commission for a modification of the applicable rear yard require-
ments in order to construct two additional houses, with attached
garages, to be located side by side at the front building line;
that the Modification Committee on February 11, 1957, approved said
application by modifying the applicable rear yard requirements so
as to permit the construction of two additional dwellings with at-
tached garages side by side at the front building line, and on
appeal to the City Planning Commission the said decision of the
Modification Committee was affirmed by the Planning Commission.
Said decision was then appealed to the City Council, and after pub-
lic hearings thereon on November 19, 1957, said application for
modification of the rear yard requirements was denied by the City
Council, but on December 3, 1957, permission was given by the City
Council to construct one additional dwelling on subject property
at the front building line, the same to comply with all applicable
yard requirements. That said permission lapsed by reason of non-
user on June 3, 1958.
SECTION 3. That there are many lots in the same vicinity
as subject property already developed with more than one house;
that within 300 feet of said property, almost 50% of the lots have
two or more dwellings thereon; that the granting of the variance
as hereinafter recommended is therefore necessary for the preserva-
tion and enjoyment of a substantial property right of the applicant
possessed by other property in the same zone and vicinity. That
the majority of the lots in the vicinity of subject property have
a dwelling constructed at or near the front building line; that
subject property is of sufficient size to permit an additional
dwelling thereon with reasonable distance between the dwellings
upon the property; and the construction of an additional dwelling
of no less size than the minimum prescribed for dwellings in Zone
R-l and located at the front building line will be harmonious to

and in accord with the development of the area, will not be detri-
mental to the public health or welfare, or injurious to the prop-
erty or improvements in the same zone or vicinity in which the
property is located and will not adversely affect the comprehensive
general plan. That the circumstances applicable to the property
are now the same as were applicable thereto at the time the City
Council granted permission for one additional dwelling upon the
property and the fact that the City Council after the adoption of
Ordinance No. 990 granted a modification to permit an additional
dwelling on subject property is an exceptional circumstance appli-
cable to the property involved that does not apply generally to the
property or class of use in the same zone or vicinity.
SECTION 4. That for the foregoing reasons, this Commis-
sion recommends to the City Council that a variance from the pro-
visions of Ordinance No. 760 as amended by Ordinance No. 990 be
granted insofar as is necessary to permit the construction of one
additional dwelling at the front building line upon condition that
such additional dwelling shall comply with all other applicable
requirements including required yards and size of dwelling.
SECTION 5. The Secretary shall certify to the adoption
of this Resolution and shall cause a copy of the same to be for-
warded to the City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of the City Planning Commission held on the
