RESOLUTION NO. 303
A RESOLUTION OF THE CITY PLANNING
COMMISSION OF THE CITY OF ARCADIA.
CALIFORNIA, RECOMMENDING THE
GRANTING OF A VARIANCE TO PERMIT
THREE ADDITIONAL DWELLINGS ON
CERTAIN REAL PROPERTY IN SAID CITY.
WHEREAS, there was filed with this Commission on the 10th
day of June, 1958 the application of Farley H. Archer and Elaine
Archer, as owners, for a zone variance to permit the construction
of one additional house on the front portion of the south half and
two additional dwellings on the north half of certain real prop-
erty in the County of Los Angeles, State of California, described
as follows:

The south 114.06 feet of the west 287.89
feet of Lot 20, F. A. Geier Tract, as
shown on map recorded in Book 23, page 40,
of Maps, Records of said County,
located at 1070 and 1080 South lOth Avenue; and,
WHEREAS, after notice required by Ordinance No. 760 of
said City, as amended, a public hearing was duly held on the matter
by and before this Commission on the 24th day of June. 1958, which
said hearing was duly continued to July 8, 1958, at each of which
times all interested persons were given a full opportunity to be
heard and to present evidence;
NOW, THK(jEFORE, THE CITY PLANNING COMMISSION HEREBY DETER-
MINES AND RESOLVES AS FOLLOV1S:

SECTION I. That there were no protests, either oral or
written, to the granting of the variance.
SECTION 2. That subject property is a lot 114.06 feet
wide and 287.89 feet deep, containing 32,836 square feet, with an
old nonconfOrming duplex on the north half and a single residence

on the rear portion of the south half, constituting exceptional
circumstances applicable to subject property that do not apply gen-
erally to property in the same zone or vicinity. That permission
to divide the property into two 57-foot lots was approved by the
Council on July I, 1958 under certain conditions, one of which was
the removal of the duplex on the north half of subject property.

SECTION 3. That at/present time there are ten lots on
the east side of 10th Avenue in this block, of which six now have
two or more houses, thus conforming to the 60 percent requirement
of Ordinance No. 990 for the erection of additional houses; how-
ever, after this property is divided and the duplex removed, there
will be eleven lots of which five have two or more houses thus no
. longer meeting the required 60 percent. That within 300 feet of
the subject property there are seventeen lots facing lOth Avenue
of which five now have two or more houses. That the requested vari-
ance is therefore necessary for the preservation and enjoyment of
substantial property rights of the applicant possessed by other

property in the same vicinity and zone.
SECTION 4. That the granting of the variance as herein-
after recommended will not be materially detrimental to the public
welfare or injurious to the property or improvements in the same
vicinity and zone and will not adversely affect the comprehensive
general plan.
SECTION 5. That for the foregoing reasons this Commission
recommends to the City Counc.il that the requested variance be grant-
ed to allow the construction of three additional dwellings upon the
following conditions:
a. That all of the conditions of the lot split approved
by the Coun~il on JUly 1, 1958 be complied with;

b. That the construction of the three new houses shall
be started within six months from the effective date of the vari-
ance and shall be completed within one year after start of con-
struction;
c. That all improvements shall comply with all the re-
quirements of all applicable ordinances.
SECTION 5. The Secretary shall certify to the adoption
of this Resolution and shall cause a copy of the same to be for-
warded to the City Council of the City of Arcadia.
I HEREBY CERTIfY that the foregoing Resolution was adopted
at a regular meeting of the City Planning Commission held on the
