A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT
TO UTILIZE CLASSROOMS FOR THE OPERATION OF A PRESCHOOL
AND OTHER RELIGIOUS SCHOOL CLASSES FOR TEMPLE SHAAREI
TIKVAH SYNAGOGUE (AKA FOOTHILL JEWISH TE~IPLE AND CENTER)
LOCATED AT 550 SOUTH SECOND AVENUE.
WHEREAS, on June 24, 1981 an application was filed by Temple
Shaarei Tikvah Synagogue (AKA Foothill Jewish Temple and Center), to
utilize classrooms for the operation of a preschool and other re-
ligious school classes, Planning Department Case No. C.U.P. 81-7, on
the property commonly known as 550 South Second Avenue, more par-
ticularly described as follows:
,A portion of Block &0, Santa Anita Tract, in the City of Arcadia
County.of Los Angeles,-State of California. as per Map recorded
in Book 34, Pages 41 and 42 of Miscellaneous Records in the Office
of said County Recorder.

HEREBY RESOLVES AS FOLLOWS:

provided will not be detrimental to the public health or welfare
or injurious to the property or improvement in such zone or vicinity.
2. The use applied for at the location indicated is properly
one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size and shape
to accommodate said use, including all yards, parking, loading, land-
scaping and other features required to adjust said use with the land
ahd uses in' the neighborhood.

4. The site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed
use.
5. The granting of such Conditional Use Permit will not adversely
'affect the General Plan.
6. The use applied for will not have a substantial adverse
impact on the environment.
Section 3. That for the foregoing reasons, subject to approval
of the City Council, this Commission grants a Conditional Use Permit
to utilize classrooms for the operation Df a preschool and other
religious school classes for Temple Shaarei Tikvah Synagogue (AKA
Foothill Jewish Temple and Center) upon the following conditions:
1. That the enrollment be limited to 30 students for the
preschool, 80 students for the afternoon religious classes,
and 100 students for the Sunday School.
2. That enrollment may increase only with the review and appro-
val from the Fire, Planning and Public Works Departments
to a maximum enrollment of 50 students for the preschool,
100 students for the afternoon religious classes, and 125
students for the Sunday School. The Applicant shall provide
to the City Departments any information required for their
review. Any increase in enrollment above the said maximum
shall result in a new application for a conditional use
permit. If the Applicant is denied an increase in enroll-
ment by staff, the Applicant may appeal to the Planning
Commission by filing for a new conditional use permit.
3.
That C.U.P. 81-7 shall not take effect until the applicant
and owner have executed a form available at the Planning
Department indicating awareness and acceptance of the
conditions of approval.
Section 4.
The Secretary shall certify to the adoption of
this Resolution.

regular meeting of the Planning Comirrission of the City of Arcadia

SUBJECT: PLANNING COMMISSION RESOLUTION NO. 1173
GENTLEMEN:
The Planning Commission at its August 11, 19.81 meeting voted 5 to 0,
with two members absent, to adopt Resolution No. 1173, granting a
Conditional Use Permit (C.U.P. 81-7) to utilize classrooms for the
operation of a preschool and other religious school classes for Temple
Shaarei Tikvah Synagogue (AKA Foothill Jewish Temple and Center)
located at 550 South Second Avenue.
The Commission at its pre-meeting of August 11 received a request
for a re-hearing. At said pre-meeting the Commission determined that
they had fully considered the school's impact and that the most
appropriate and expeditious action would be for anyone aggrieved by
the Commission's decision to appeal the Commission's decision to the
City Council.
The Temple has been conducting Sabbath and afternoon religious classes
since the Temple-Center was constructed seventeen years ago.
The Conditional Use Permit has been applied for in order to permit the
creation of a new preschool. The preschool would handle a maximum of
50 students between 2~ - 5 years of age from 8:45 a.m. to 12:15 p.m.,
daily. .
Attached for your consideration is Resolution 1173 and the staff
report. In addition the information submitted to the Commission at
its August 11, 1981 pre-meeting regarding the requested re-hearing
is provided.

HISTORY/PROPOSAL
In 1964 five of six single-family dwellings were demolisheq on the
subject site and the 21,500 square foot single-story Foothill Jewish
Temple-Center was constructed. The Temple-Center consists of a
4,608 square foot sanctuary, 6,180 square foot gynmasium/auditorium,
4,608 square foot kitchen, meeting hall and locker room facility,
and a 6,104 square foot classroom (9), lounge, nursery and office (4)
section.

After reviewing the construction plans on file in the Building Depart-
ment, each one of the above-mentioned sections is clearly differen-
tiated" from the others. The remaining 1,000 square foot single-
family dwelling, located off Third Avenue, is currently being used
as the residence for the caretaker. of the property.
The applicant has noted that tne Sunday ,School and afternoon religious
classe's have been in existence since the Temple-Center was buil t seven-
. teen years ago. Applying for the Conditional Use Permit was due to
the new preschool operation which requires State, City and Fire De-
partment approval. The following is a breakdown, which has been
reviewed and approved by both the Fire and Public Works Departments,
of each school use, hours of operation and maximum capacity desired
at this time.

A. Daily Preschool (2~ - 5 years old), 8:45 a.m. to 12~15 p.m.,
30 capacity.
B. Afternoon religious school three days a week, 4:00 p.m. to
6:00 p.m., 80 capacity.
C. Sunday School, 100 capacity.
Chris Cozen, Director of the school oeprations, would like the flex-
ibility to increase each school use before applying for another
conditional use permit on the condition that the increased capacity
be approved by the required licensing bureaus. The desired increase
in enrollment to 50 for the preschool, 100 for the afternoon religious
school, and 125 for the Sunday School has been reviewed by the Fire
Department and found to be appropriate only if any increase over the
present capacity {see A, B, and C above) be subject to the review and
approval of the Fire Department (Note: State approval will be required
for any increase in the preschool operations).
Initially, the' preschool will be a three-day operation expanding to
a planned, five-day operation in 1982-1983. Twenty will be the maximum
number of children utilizing the fully fenced 3,783 square foot play
area at anyone time. Surrounding the play area, adjacent to the
residential uses, is a five to six 'foot high block wall. Unloading
and loading of the children will be off-street at the rear of the
building adjacent to the play area (see attached plans).
ANALYSIS
.
The_zoning ordinance permits a school or a church in any zone with an
approved conditional use permit. Originally, the parking lot was
striped for 120,8'-0" wide parking spaces. Since then, the site has
been restriped to accomodate 94, 8'-6" wide parking spaces. Staff
feels that the 8'-6" wide spaces would be appropriate since the spaces
have the required 20'-0" in length and 25'-0" aisle width.

The flexibility requested by the applicant would allow for the logical
,~ expansi~n of the school. After dis:ussions with t~e Fire Department,
..' the maxlmum occupancy for the buildlng would be more than requested
'. for future operations. By allowing the applicant to expand with
approval from the Fire, Planning and Public Works Departments, constant
hearings would not be necessary for incremental increases in enroll-
ment. However, by placing a ceiling on' staff approvals the Commissiion
and the public would have the opportunity to review the church and
school use before the maximum occupancy is reached.
Find attached a site plan of the preschool operation, a site plan,
floor plan, and a letter in opposition (Mr. & Mrs. Wunderlin, Dallas,
Texas) . '
RECOMMENDATION
The Planning Department recommends apProval of C.U.P. 81-7 subject to
the following conditions:
1. That the enrollment be limited, to 30 students for the preschool,
80 students for the afternoon religious classes, and 100 students
for the Sunday School.
2.
That enrollment may increase only with the review and approval
from the Fire, Planning and Public Works Departments to a maximum
enrollment of 50 students for the preschool, 100 students for

To Whom It May Concern:
At this time we are waiting approval of our application
for a Conditional Use Permit to operate a preschool, afternoon
religious school, and Sunday religious school on the premises
of Temple Shaarei Tikvah, 550 S. Second Avenue, Arcadia.
The application states the capacity for which the permit
will be granted as 30 for the preschool, 80 for the afternoon
religious school, and 100 for the Sunday school. As the
possibility for a future increase in the student enrollment for
anyone or all of our programs exists, we would like to ask
that the C.U.P. application be granted with a recommendation
allowing for a flexible capacity limit to the extent of 50 in
the preschool, 100 in the afternoon religiuos school, and 125
in the Sunday religious school.
We fully recognize that increases in the capacity must
also be approved by other licensing bureaus and that should
we exceed the flexible capacity request an additional application
for a C.U.P. permit must be made.

6a. Increase in existing noise levels?
The use of the property for school purposes could create additional
noise from the children and traffic. However, this increase in
noise should not be of such an intensity to create a significant
problem.
1Ja. Generation of substantial additional vehicular movement?
The use of the site nor a school will possibly create
an increase in traffic when parents drop the children off and. pick
them up from school. This increase in traffic would be short term
during specific hours of the day. It is staff's opinion that
although there may be an increase in vehicular traffic during
certain times of the day, the increase will not be substantial
to create a vehicular hazard.

The following is the information which was
submitted to the Planning Commission
At its August 11, 1981 pre-meeting
regarding a request for,a re-hearing.

STATEMENT IN O~POSITION TO REOPENING THE PUBLIC HEARING IN
CONDITIONAL USE PERMIT NO. 81~7
We respectfully submit that the public hearing on
Conditional Use Permit 81-7 not be reopened. The public
hearing held on July 28, 1981 was a duly noticed public hearing
of the Arcadia City Planning Commission and the Commission in
approving the permit allowed us to proceed with our proposal.
To now halt the opening of our pre-school pending a rehearing
by the Commission will cause great personal and financial
hardship to the school, parents and their children. In effect,
we who have acted in good faith and in.accordance with the
Commission rules will be severely penalized because of the
negligence of individuals who failed to attend the proper
meeting. Our specific concerns are as follows:
1. Our application was timely filed to permit public
hearings well in advance of our scheduled September opening
date.

A rehearing before the Planning Commission will
require re-noticing and, although the earliest agenda available
would be August 25, considering normal time constraints,
September 8 would seem to be the earliest realistic date. If
we are again granted a permit, any subsequent appeal would not
be heard until either October 6 or October 20.
Realistically, this means that the pre-school could
not open until mid-November because:
a) State licensing cannot be completed without city
approval.
b) anticipated funding from the Jewish Federation
will not be forthcoming without a state license.
3. The basis for the request to reopen the hearing
is that the petitioners attended t~e wrong meeting. But it is
not equitable to penalize those who acted in good faith because
other individuals were negligent and unable to determine which
of two clearly marked meetings to go to. Equity requires that
if there is to be any further 'hearing', it should be by way of
appeal directly to the City Council by the negligent parties.
This is the only way that harm to the pre-school and its
families can be minimized.

4. We are aware of the concerns of only two of our
neighbors, and have met with them in order to address those
concerns. We are attaching for your review a letter sent to
all our neighbors dated June 10, 1981. Further, we are
attaching correspondence between ourselves and one of our
neighbors to show you our willingness to resolve any problems
which exist.

These letters are attached because we feel they show
we have consistently acted in good faith and should not now be
penalized.
5. The testimony phase of the permit process was
held on July 28. August 11 is the scheduled date to adopt the
resolution approving the conditional use permit. To now reopen
the hearing would be an extraordinary action, because there has
been no showing of a procedural or legal defect to warrant such
action.
We, therefore, respectfully request that the petition
to reopen the public hearing be denied. A denial of said
petition would not leave the neighbors without remedy or

matter to the City Council.
Considering all the ramifications of this particular
case, this is the only appropriate'course of action. It will
allow the neighbors to express their concerns in a public
forum and at the same time protec~ the rights of the holder of

Dear Neighbors and property owners:
Our synagogue has been in this neighborhood for 16
years. For all of these years we have operated a Sunday
morning religious school and an afternoon religious school.
Over the years we have served anywhere between 40 and 100
children per school day and hope to continue in the future.
Beginning this coming September (1981), the .synagogue
has plans to operate a mo.-nino relinioll" nrpschnol. The
maximum enrollment for the preschool will be 30 chi14ren.
The school wi-ll be. located on the east side of the school
building and within a completely fenced area.
The purpose in writing you is to inform you of our
plans in advance of the City of Arcadia's formal notice to
you. These notices are part of the Conditional Use Permit
application procedures. The city does not require us to
notify you personally, but we felt that in the spirit of
neighborhood cooperation and support that we would let you
know about our plans before you received a formal notice from
the city.
We want to assure you that every precaution will be
taken to protect the health 'and safety of all the children
enrolled in our religious programs as well as maintaining
our neighborhood. To our knowledge we have not received a
single complaint over the years from our neighbors about
noise, garbage, vandalism, or traffic problems in regard to
our school programs. These are issues with which the city
of Arcadia is concerned. Our application for the Conditional :
Use Permit include all of our school programs. It is our sincere
hope that as neighbors and property owners in our immediate area
you will lend your continued support and good will to our
Synagogue.
Please feel free to contact us if you would like to ask
more specific questions concerning this letter or to make
suggestions concerning our school facilities. We would be happy
to show you our school building and facilities at any time.

I am in receipt of your June 10, 1981 letter relative to the Temple's
plans to conduct a morning religious preschool, and I must advise you
that I object strongly to these plans for the following reasons:
Since our purchase of our home, at 210 El.Dorado (directly East and
,SouthlEast of the Temple) we have had several instances of the problems
which are connected with a great nUlllber of children. The children are
noisey, throw things over into the yard, tease our dog, and climb the
fence to retreive items such as balls, etc. they are playing with. It
also creates a lack of privacy for us.
The probleiD became so bad that we felt it necessary to extend the wall
on the East side of the temple and that has helped somewhat. Since
you have filled in the' swimming pool and removed the dressing rooms
that bOrder the north end of our property, however, we have found that
the problems are reoccurring; especially with the addition of the swing
set in "that area.
We would have no objection to the Temple conducting the preschool if
you would be willing to heighten the wall between our properties to
avoid SOll\8 of the aforementioned problem. We do not, however, feel
.that ie should be our responsibility to again pay the expense of another
willl to assure ourselves of the privacy and peace we expected when we
purchased our hOIllB.

Dear Mr. Donner:

The Planning Commission at its meeting of July 28, 1981 approved
Conditional Use Permit 81-7, a request to utilize classrooms for
the operation of a preschool and other religious school classes
at 550 South Second avenue. A resolution setting forth the
Planning Commission's findings will be presented to the Commis-
. sion for adoption at its next meeting of August 11, 1981. After
adoption, C.U.P. 81-7 will be forwarded to the City Council for
its consideration.
This Conditional Use P~rmit will not become effective until the
following conditions are met and if, for a period of twelve (12)
months (from the City Council's ratification date), any use
authorized by C.U.P. 81-7 is or has been unused, abandoned or
discontinued or the conditions- have not been complied with, said
conditional use permit shall become null and void and of no ef-
fect:
1. That the enrollment be limited to 30 students for the pre-
school, 80 students for the afternoon religious classes,
and 100 students for the Sunday School.
2. That enrollment may increase only with the review and ap-
proval from the Fire, Planning and Public Works Departments
to a maximum enrollment of 50 students for the preschool,
100 students for the afternoon religious classes, and 125
students for the Sunday School. The applicant shall pro-
vide to the City Departments any information required for
their review. Any increase in enrollment above the said,
maximum shall result in a new application for a conditional

use pe~mit. If the applicant is denied an increase in en-
rollment by staff, the applicant may appeal to the Planning
'Commission by filing for a new conditional use permit.
That C;U.P. 81-7 shall not take effect until the owner and
applican.t have executed a form available at the Planning
Department indicattng awareness and acceptance of the con-
ditions of approval.
Plea-sefindenclosed the above-mentioned Acceptance Form for
your execution. This shall be returned to the Planning Depart-
ment after the City Council's review.
