A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA RECOMMENDING APPROVAL
OF ZONE CHANGE Z-81-3 FROM R-3 {MULTIPLE-
FAMILY)TO C-O (PROFESSIONAL OFFICE) AT
1035-1045 WEST HUNTINGTON DRIVE.
WHEREAS, an application was filed by George T. Kirkpatrick
on behalf of Maier Brew~ng Company and the City of Arcadia, requesting
Zone Change 81-3 from R-3 (Multiple-family) to c-o (Professional
Office) for the property at 1035-1045 West Huntington Drive, more
particularly described as follows:
The southerly 195.16 feet of Lot 1, Tract No. 14846, as
per Map recorded in Book 314, Pages 8 and 9 of Maps in
the Office of the Recorder of Los Angeles County.
WHEREAS, a public hearing was held on July 14, 1981, at
which time all interested persons were given full opportunity to
be heard and to present evidence.
NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION
MAKES THE FOLLOWING RECOMMENDATION AND FINDS AS FOLLOWS:
Section 1. That the factual data submitted by the Planning
Department in the attached staff report is true and correct.
Section 2. The Planning Commission recommends to the City
Council a zone change from R-3 (multiple-family) to c-o (profes-
sional office) for the property at 1035-1045 West Huntington Drive.
Section 3. That the Planning Commission finds that tte
proposed zone change would be consistent with the General Plan and
the public convenience, necessity and general welfare justify the
proposed zone change.
Section 4. The Secretary shall certify to the adoption of
this Resolution and shall cause a copy to be forwarded to the City
Council of the City of Arcadia.

HISTORY
Prior to March, 1981 the General Plan for the site was multiple-
family residential. On ~iarch 3, 1981, the City Council adopted Res-
olution 4939 amending the General Plan for the subject area from
multiple-family residential to commercial.

The Council in its. approval recommended that an architectural overlay
be included at the time of the zone change to protect the apartments
north of the subject site.
PROPOSAL & ANALYSIS
The applicant, George Kirkpatrick, requested a zone change for the
property at 1043 - 1045 West Huntington Drive from R-3 to C-O in
order to construct an office building. The City has included the
properties at 1035 - 1041 West Huntington Drive.
The C-O (Professional - Office) zone allows office uses and financial
institutions. The following setback and height standards apply to
properties within the C-O zone:
Side Yards:
3' and a minimum-of 10' when abutting residential
except no portion of any structure shall encroach
through a plane projected from an angle of 550
as measured at the ground level along the side
property line.
Rear Yard:
Minimum of 20', provided however that no portion
of any structure shall encroach.. .(same as above
except "along the rear property line)
Minimum of 10'
Front Yard:
Building Height:
Maximum 3 stories, 40' in height
. The following special setbacks apply to the subject properties:
1. There is a 50' setback from the center line of Sunset
Boulevard (10' from the property line).
2,' There is a 75' setback from the center line of Huntington
Drive (15' from the property line).
3. There is a '40' setback from the center line of Cortez Road
(10' from the property line).
Any new.building would have to comply with the C-O requirements, or
obtain modifications.
It is staff's opinion that the C-O zone provides adequate protection
for the residential properties to the north. In addition, if a building
exceeds 20,000 square feet and is located within 100' of the residen-
tially zoned property, Section 9261.6.8. requires that a conditional
use permit be obtained prior to construction. This would provide the
City with additional controls over development of the subject site.

A zone change to C-O would be consistent with the "Commercial" Gen-
eral Plan designation, and is the least intensive commercial zone.
A change to a C-O zone would make the existing office uses conforming.
Pursuant to the provisions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for the
proposed project. Said initial study did not disclose any substantial
or potentially substantial adverse change in any of the physical
conditions within the area affected by the project including land,
air, water, minerals, flora, fauna, ambient noise, and objects of
historical or aesthetic significance. Therefore, a Negative Declaration
has been prepared for this project.
Before the Planning Commission or the City Council take action on
this project, they should "move to approve and file the Negative
Declaration and find that the project will not have a significant
effect on the environment".
RECOMMENDATION:
The Planning Department recommends approval of Zone Change 81-3 from R-3
to c-o.

1. The subject property is currently vacant and is of irregular
shape with frontage on Huntington Drive, Sunset Blvd. and
Portola Rd. A portion of the lot behind the buildings facing
