RESOLUTION NO. 1161 A RESOLUTION OF THE PLANNING CO~1MISSION OF THE CITY OF ARCADrA GRANTrNG A CONDITIONAL USE PE~lIT TO OPERATE A SCHOOL rN THE CHURCH FACILITY LOCATED AT 225 EAST LrVE OAK AVENUE. WHEREAS, On March 4, 1981 an application was filed by the Arcadia Community Church to operate a school in the existing church facility, Planning Department Case No. C.U.P. 81-2, on the property commonly known as 225 East Live Oak Avenue, more particularly described as follows: Lots I and 2 of Tract 13217 in the City of Arcadia, County of Los Angeles in Book 264, Pages 25 through 27, of Maps in the office of the County Recorder. WHEREAS, a public hearing was held on April 14, 1981, at ~ which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNrNG COMMISSrON OF THE CrTY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section I. That the factual data submitted by the planning Department in the attached report is true and correct. Section 2. This commission finds that: I. The granting of conditional use permit as hereinafter provided will not be detrimental to the public health or welfare on injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is pro- perly one for which a conditional use permit is authorized. . l161 - . . . . 3. The site for the proposed use is adequate in size and shape toaccommodate said use including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the general plan 6. The use applied for will not have significant effect on the environment. . Section 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit to operate a school in the Arcadia Community church upon the following conditions: 1. The property shall be improved and maintained in accord- ance with plans which are on file in the subject Case No. C.U.P. 81-2 and applicable regulations of the Arcadia Munic- ipal Code. 2. That the parking lot be restripped within one year from the date of this approval. 3. That all the Fire Department regulations be complied with. 4. That the maximum enrollment be limited to 40 students at this time. 5. This conditional use permit shall be reviewed on a yearly basis for compliance with all conditions and to ensure that said number of students can be accommodated the site. . 6. That this application shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. 1161 . . . . Both of these projects were constructed prior to the City's requirement for a Conditional Use Permit. On February 27, 1979, the Planning Commission granted Conditional Use Permit 79-2 to add a one-story addition to the front of the existing facility. SPECIAL INFORMATrON Building rnformation: The existing buildings contain approximately 10,439 square feet and include a sanctuary, fellowship hall, kitchen, library, offices, Sunday School rooms, narthex and nursery. . . . As noted in C.U.P. 79-2 these spaces are substandard, however, it is a workable layout and strict adherence to the code would substantially decrease the number of parking spaces. A condition of C.U.P. 79-2 was that the parking area be improved according to the plans submitt~d. The landscaping has been completed, however the parking area has not been restriped. PROPOSAL The church is operating a school which has a current enrollment of 26 students, ranging in age from 6 - 17 years. The operation of a school in the church facility was brought to the Planning Department's attention by the Fire Department. Presently the church is utilizing the fellowship hall for the "Learning Center" and the Sunday School rooms for mini-classes and tutoring. Students are transported to the local park (Live Oak Park) for the major part of the physical education program. The rear section of the parking area is utilized by the students during recess. The two entrances to this part of the parking area are blocked off during the school day. The school students. grades and anticipates a maximum growth in the next 5 years to 75 rt is projected that half of the students will be in I - 6 the other half 7 - 12 grades. There are 3 staff members. Presently all the students are dropped off and picked up by their parents and students are not allowed off campus during school hours. The peak on-site traffic would be during the morning and the afternoon. Even at its maximum number of students, staff does not believe there will be a negative impact on adjoining properties. C.U.P. 81-2 4/14/81 Page 2 . . . (' ( Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or poten- tially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission takes action on this project, the Com- mission should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the envir- onment II. RECOMMENDATION The Planning Department recommends approval of C.U.P. 81-2 subject to the following conditions: I. That the parking lot be restriped within one year from the date of this approval. 2. That all the Fire Department regulations be compl~ed with. 3. That the maximum enrollment be limited to 72 students at this time. 4. That this application shall not take effect until the owner and applicant have executed a form available at the, Planning Department indicating awareness and acceptance of the condi- tions of approval. C.V.P. 81-2 4/14/81 Page 3 . . . ( ( THE ARCADIA CCJ.jj',iUNI'rY CHURCH SCHOOL The school ministry at Arcadia Community Church is an extension of our educational ministry. It is designed primarily to support the parents of our own congregation by assisting them in the education of their children. (see gold brochure) Curriculum-~An individualized, instructional program written by high- ly qualified Christian educators has been adopted by our staff, (see accompanying brochure on Alpha Omega Publications) This material allows us to offer our students subject material written from a Christian perspective. We follow the same educational requirements as the state of c;alifornia a'nd are a member of the Association of Christian Schools International (~hittier, CA). Our high school course offerings include both vocational and college preparatory. Staff--Our school staff consists of three liscensed ministers, one of which has a valid California teaching credential and one with a E.A. and the other who will reci.e his E,A, in the Spring of 1981. They are all active members of our church and feel called to the ministry of Christian education. I Enrollment--We currently have an enrollment of 26 which includes ages 6-17 years. Technically we have a non-graded program but cover the span of grades 1-12. Facilities--We arc a "one-room" school using our fellowShip hall as our "learning center." For the major part of our physical education program we transport our students to the local park-and use the rear section of our parking lot for recess, (the two entrances are blocked off by chains during the school day) Daily Schedule and School Calendar--See accompanying school handbook, Projected Growth Plans--Next year we plan to increase our enrollment by no more than 10 (as we survey the needs of our congregation). ( HISTORY In 1949 the subject property was zoned R-I. In October, 1959 the City Council approved a zone change to rezone the property from R-I to R-3 P & D. In June, 1979 an application was filed by Fairhaven Development Company to change the General Plan on this site and the adjacent property to the west to a multiple-family designation. The reason for the proposed change was that the developer wished to construct condominiums an this site. In order to construct condominiums, the General Plan and the Zoning must be consistent. On August 21, 1979, the City Council denied the request based on the findings that the change would be inconsistent with the surrounding land use and zoning. The Caunci I at this meeting directed the stoff to initiate proceedings far the rezoning of the property to R-I with 0 parking overlay. ANAL YSIS This application is a result of the City Council's direction to stoff. This Zone Change to R-I & P will'bring the zoning into consistency with the General Plan designation of single-family residential, 0-6 du/ac. The zoning would also be compatible with the zoning of the adjacent properties to the east and south. The Parking Overlay (P) would permit the continued use of the site os a parking area. This parking area presently acts as a buffer for the residential properties to the south and east. If at some later date someone wished to develop the property, a single-family dwelling could be constructed on the site. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared on initial study for the proposed project.
