HomeMy WebLinkAbout1159 . . . ., RESOLUTION NO. 1159 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING APPROVAL OF T.A. 81-2 AMENDING THE ARCADIA MUNICIPAL CODE SECTION 9255.1.5 TO AUTHORIZE LIMITED IMPROVEMENTS TO NONCONFORMING SINGLE-F AMIL Y DWELLINGS IN THE R-3 ZONE. WHEREAS, a text amendment was initiated by the Planning _ Commission for the consideration of amending the Arcadia Municipal Code Section 9255.1.5 to authorize limited improvements to nonconforming single- fami Iy dwell ings in the R-3 zone; and WHEREAS, a public hearing was held on March 10, 1981 and March 24, 1981 at which time all interested persons were given full opportunity to be heard and present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RECOMMENDS TO THE CITY COUNCIL THAT THE FOLLOWING AMENDMENT BE MADE TO THE ARCADIA MUNICIPAL CODE: Section I. That the Arcadia Municipal Code Section 9255.1.5 be amended to read as set forth in attached Exhibit "A". . . . 9255.1.5. NONCONFORMING USES AND STRUCTURES. No building permit sholl be issued for any structure and no structure sholl be erected upon any property regulated by this Division unless 011 nonconforming uses of the property are discontinued and abandoned. No building permit sholl be issued for any structure to be erected upon property regulated by this Division unless the plans accompanying the appl ication include the removal or remodel ing to conform to the provisions of this Division of all nonconforming structures and buildings on the property; provided that 0 permit for the limited purposes hereafter listed may be issued for any property containing 0 nonconforming single-family dwelling. Any construction on the property other than for said limited purposes sholl require removal or remodeling in accordance with the provisions of this Section. Said purposes ore: I. For five hundred (500) square feet of additional floor area (cumulative) including covered patios proposed to be added to the main single-family dwelling on the lot, the Modification Committee, pursuant to modification procedures, may permit an additional five hundred (500) square feet of floor area (cumulative). 2.0ther alterations to the main single-family dwelling which do not create additional space. 3.Required parking facilities for the main single-family dwelling. 4.A swimming pool. NICHOLSON ASSISTANT PLANNER GENERAL INFORMATION APPLICANT: City of Arcadia REQUEST: To amend Section 9255.1.5., of the R-3 Multiple- Family development standards, to permit limited improvements for properties which are developed with one or more non-conforming single-family dwellings. ~ PROPOSAL This Text Amendment was initiated by the Planning Department, pursuant to the direction of the Planning Commission, in order to permit limited improvements for properties which are developed with one or more non-conforming single-family dwellings; zoned R-.3. Section 9255.1.5., of the present Arcadia Municipal Code, states as follows: :. 9255.1.5 NONCONFORMING USES AND STRUCTURES. No building permit shall be issued for any structure and no structure shall be erected upon any property regulated by this Division unless all nonconforming uses of the property are discontinued and abandoned and a statement of compliance with this provision is signed by the owner and occupant. No building permit shall be issued for any structure to be erected upon property regulated by this Division unless the plans accompanying the application include the removal or remodeling to conform to the provisions of this Division of all nonconforming structures and buildings on the pro- perty; provided that a permit for the limited purposes hereafter listed may be issued for property w~th one (1) nonconforming one-family dwelling. Any construction on the property other than for said limited purposes shall require removal or remodeling in accordance with the provisions ,of this Section. This amendment is for the consideration of amending the aforementioned Section to read as follows: 9255.1.:; NONCONFORMING USES AND STRUCTURES. No building permit shall be issued for any structure to be erected upon property regulated by this Division unless the plans accompanying the application include the removal or remodeling to conform to the provisions of this Division of all nonconforming structures and buildings on the property; provided that a permit for the limited'purposes hereafter listed may be issued for any property containing a nonconforming one-family dwelling. ANALYSIS The existing code section only permits the aforementioned improvements for properties with one nonconforming single-family dwelling on an R-3 lot. At t~e pr7sent time the owners of properties with two or more noncon ~~~~~~i~~n~leii~milY dwellings ~r a com~ination of said dwellings with maintain ~h we .~n~s andd/or.mult~Ple-fam~ly dwellings are permitted to . e ex~st~ng well~ngs and can obtain building permits for roof~ng, electr~cal, plumbing, interior remodeling other than major T.A. 81-2 3/3/81 Page 2 . . . ~ (- (," structural changes, and general repair when necessary (i.e. termite damage). However, no permits would be issued for any proposed expansion of any structure unless the proposed plans would include the removal or remodeling of all nonconforming uses and structures as set forth in the provisions of the Arcadia Municipal Code. Occasionally nonconforming single-family structures are demolished when larger lots are to be developed into multiple-family develop- ments. However, it has become apparent that there are property owners who are living in well-maintained nonconforming single-family dwellings,with two or three r€ntal units on the same R-3 lot,who are not going to demolish the nonconforming single-family dwelling in order to construct an .,additional rental unit because it is not ecomonically feasible; especially when the present development standards may not permit any additional units to be constructed, There have been numerous inquiries regarding expansion of nonconforming single-family dwellings on R-3 lots and it has been difficult for staff to explain the logic of why the City permits an expansion to a nonconforming single-family dwelling on an R-3 lot (in which the City is trying to abate) and yet in similar situations, with the exception that there exist an additional nonconforming single-family dwelling, the City does not permit any expansion to occur, regardless of the fact that the existing density is consistent with the General Plan. It is staff's op~n~on that this text amendment which would allow for the same type of consideration to be given to the situation where there is a single-family dwelling and units on the property as is currantly given to the single-family dwelling by itself would be fair and equitable. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, am- bient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission and City Council takes action on this project, the Commission and Council should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment." RECOMMENDATION The Planning Department recommends approval of Text Amendment 81-2. After taking action on this application, the Planning Commission should direct staff to prepare a resolution for adoption at its next meeting. The P~anning Commission's action shall not be final until adoption of the resolution. The appeal period for this action commences at the time the Commission adopts the resolution.
