RESOLUTION NO. 1153 A RESOLUTION OF THE PLANNING CO'~!ISSION OF TEE CITY OF ARCADIA RECO~~IENDING THAT TEE GE~ffiRAL PLAN LAND USE ELEMENT BE CHANGED FRO~ MULTIPLE FAMILY RESIDENTIAL (7+ DulAc) TO COMMERCIAL AT 800-900 SOUTH SANTA ANITA AVENUE. WHEREAS, A General Plan Change was initiated by the City of Arcadia for the consideration of changing the General Plan Land Use Element from Multiple-Family Residential 7+ dwelling units per acre to Commercial for the property situated on the east side of Santa Anita Avenue, between Alice Street and Duarte Road; and WHEREAS, A public hearing was held on December 9, 1980 at which time all interested persons were given full opportunity to be heard and present evidence; NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RECOMMENDS TO THE CITY COUNCIL THAT THE FOLLOWING k~ENDMENT BE MADE TO THE GENERAL PLAN LAND USE ELEMENT AND FINDS AS FOLLOWS: Section 1. That the General Plan Land Use Element should be changed from Multiple-Family Residential 7+ dwelling units per acre to Commercial for the property situated on the east side of Santa Anita Avenue between Alice Street and Duarte Road, as indi- cated on Attached Exhibit "A". Section 2. The Planning Commission finds that a General Plan change to Commercial would provide for consistency between the area's existing zoning classification and its general plan designation, and that the public necessit~ convenience and general welfare justify the proposed change. The subject area is comprised of eight (8) lots developed with a market, a garage, a temporary 'storage building/parking area, and a retail egg sales business and warehouse (see Use & Zoning Map); zoned C-2H. 66,430 square feet (1.53 acres) 390 feet on Santa Anita Avenue SURROUNDING LAND NORTH: USE & ZONING: SOUTH: EAST: WEST: GENERAL PLAN: Arcadia Fire Department, zoned C-2H ServicecStation, zoned C-2H Multiple-family and single-family residential dwellings; zoned R-3H County Golf Course; zoned S-2, and general office buildings; zoned C-2 Subject Site: Multiple-family Residential (7+du/ac) North: Public Facilities - Fire Station South: Commercial East: Multiple-family residential (7+du/ac) West:; Mixed Uses - Commercial/Public Facilities 12/9/80 G.P. 80-3 Page One . . . r SPECIAL INFORMATION On September 26, 1980 a tentative map application was submitted by the Allison Construction Corporation for the purpose of constructing a l6-unit commercial condominium at 800-816 South Santa Anita Avenue. This application was reviewed by staff and the proposal was found to be inconsistent with the City's General Plan. The Applicant was notified that the subject site was zoned General Commercial with a General Plan designation of Multiple- family Residential,and that State Law requires a finding of consistency between the General Plan designation and zoning classification, as a condition of subdivision (Condominium) approval. Because the City would not be able to make the required findings, the application was withdrawn by the Applicant. As a result of the Zoning and General Plan inconsistency, the Applicant pursued the matter before the City Council. The City Council at its NOvember 4, 1980 meeting directed staff to initiate proceedings for the consideration of amending the' General Plan regarding the properties at 800-816 South Santa Anita Ave- nue and to include other properties which may be subject to similar conditions. ANALYSIS The existing commercial zoning of the properties allows for the construction of commercial projects, however such projects cannot be developed as commercial condominium (ownership) because of the existing inconsistency between the general plan and zoning. This proposal to change the General Plan Land Use Element from multiple-family residential (7+du/ac) to commercial would pro- vide for consistency between the area's existing zoning classification and its general plan designation. Once such consistency is achieved the properties may be developed with a commercial condominium project. Pursuant to the provisions of the California Environmental Qual- ity Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within .the area affected by the proj ect including land', air, 'water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic signi- ficance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission and City Council takes action on this project, the Commission and Council should "move to 12/9/80 G.P..80-3 Page Two . . . f 7 ANALYSIS (Con't) approve and file the Negative Declaration and find that the project will not have a significant effect on the environment".
