A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT TO ALLOI.J THE OPERATION OF A HHOLESALE PL~NT NURSERY ON CITY-O"mE~ PROPERTY AT 622 EAST LIVE OAK AVENUE (NORTH OF PAR-3 GOLF COURSE, SOUTH OF ARCADIA MOUNTED POLICE AND WEST OF SANTA ANITA WASH). \1HEREAS, on September 15, 1980, John R, Stothers, Sr. filed an application for the operation of a wholesale plant nursery, Planning Department Case No. C.V.P. 80-6, on propert~:commonly known as 6~2 East Live Oak Avenue, more particularly described as follows: A portion of Lot B, Tract No. 7465, as per map recorded in Book 84, Page 98, of Maps in the office of the Recorder of Los Angeles County; described as follows: . 'Beginning at the point of intersection of the southerly line of Live Oak Avenue, 100 feet wide with the westerly line of said Lo': B; thence southerly along said westerly line, 425 feet; to the true point of beginning; thence continuing southerly along said westerly line 513.17 feet; thence easterly along a line parallel with Live Oak Avenue, 127.5 feet more or less, to a point in the ~esterlv line of the Flood Control easement, 140 feet ~ide; thence northerly along said easterly line 513.17 feet; thence westerly along a line parallel with Live Oak Avenue to the true point of beginning; except the westerly 25 feet of said lot. WEEREAS, a public hearing was held on October 14, 1980, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING CO~fr!ISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data sub~itted by the Planning Department in the attached report is true and correct. Section 2, This commission finds that: . -1- 1150 ' --.----'-----'.-.--....-..---. ,- - ( ( 1, The granting of this Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity, . 2. The use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. 3. The site for the proposed use is adequate in size and shape to accomodate said use including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neig~borhood, ,~ 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use, 5. The granting of such Conditional Use Permit will not adversely affect the General Plan, . 6, The use applied for will not have a substantial adverse impact on the environment. 7, The proposed use complies with..all requirements set forth for the issuance of a Conditional Use Permit. 8. The propos2d use will not substantially increase vehicular traffic on any street in a residentially zoned district. 9. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by interfering with pedestrian traffic, 10. The proposed use will not create increased traffic hazards to pedestrians when located near a school, church, auditorium, theater or other places of assembly, . -2- 1150 (' ( . Section 3. That for the foregoing reasons. subject to approval of the City Council, this Commission grants a Conditional Use Permit for the operation of a wholesale plant nursery upon the following conditions: 1, That a grading and drainage plan be submitted'for approval of the Director of Public Works, Construct A,C. driveway entrance adjacent to the existing roadway in accordance wi~h plans to be approved by the Director of Public Works (required to prevent erosion to the existing roadway pave- ment) , 2. That the driveway and parl:inp area be gravel. This shall be subject to the review and approval of the Planning Department. 3. That the number of parking spaces required on the site shall be determined by the number of employees to be employed at the subject site and shall not be less than seven (7) parking spaces. The parking area and size of parking spaces shall be subject to the review and approval of the Planning Department. . 4, That this nursery shall be strictly for wholesale use and no retail activity shall take place. 5. All structures shall comply with applicable Building Division regulations and if there are any deviations the City Council shall be required to review and approve , the request. 6. Water service to be installed by the City of Arcadia at the developer's expense to conform to the Uniform Plumbing Code, 7, Proper backflow protection required if sprinkler system is used. to be approved by Water Division, . 8, Any construction on the site shall be subject to the -3- 1150 . , . . ( review and approval ( , of the Fire Depan:ment. 9, That the following use restrictions (rental agreement) shall be complied with: A. Wests ide fence shall not be any closer than two (2) feet to the existing access road to the Par-3 Golf Course, B. - Northside fence shall be placed approximately twenty- nine (29) feet south of the existing fence on the south side of the Mounted Pol[ce Facility in order'" to allow access to the Facility, C. Eastside fence shall be placed on the west side of the existing trees which shade the horse trail, Min- imal trimming shall be allowed to accomodate said eastside fence, These trees shall be preserved by the Tenant. D, Southside fence shall be no further south than the southerly lot line of the Premises. E, Access to the existing light standards shall be provided by the Tenant upon request from the Land- lord or the proprietors of the Par-3 Golf Course. F. Actual placement of the fencing according to the above guidelines shall be subject to approval of the City Manager or his designee. 10. C.U.P. 80-6 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. . -4- 1150 ( ( Section 4, The Secretary shall certify to the adoption of this resolution. .... U . p, 80-,6 ANALYSIS On June 17, 1980. the City Council approved a lease to be entered into ~ith Mr. Stothers, subject to obtaining proper city permits. The proposed nursery is a permitted use with an approved conditional use permi t. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project, Said initial study did not disclose any substan- tial 9r potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora. fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declar- ation has been prepared for this project. Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment, " REcmIMENDATIO,,; The Planning Department recommends approval of C.U.P. SO-6 sUbject to the following conditions: 1. That the conditions as outlined in the report from the Department of Public ~orks shall he complied with to the satisfaction of the Director of Public Works (Report forthcoming), 2. That the driveway and parking area be paved as per the Arcadia MuniCipal Code (9269,14), This shall be subject to the review and approval of the Planning Department. 3.
