RESOLUTION NO. 1149
A RESOLUTION OF THE PLANNING CO~MISSION OF TEE
CITY OF ARCADIA GRANTING A ZONE VARIANCE TO
CONSTRUCT A SINGLE-FAMILY DWELLING ON A SITE WITH
AN EXISTING SINGLE-FAMILY DWELLING AT 637 WEST
LEMON AVENUE.
WHEREAS, on August 12, 1980, an application was filed by
Irving F. and Laveta L. Edwards for a zone variance to permit the
construction of a single-family dwelling on a site with an extsting
single-family dwelling, then upon completion of the new dwelling,
to convert the existing dwelling into a guest house, Planning Depart-
ment Case No. V-80-2, on property commonly known as 637 West Lemon
Avenue, more particularly described as follows:
A Portion of Lot 43, Tract No. 4869, in the City
of Arcadia, County of Los Angeles, State of Cali-
fornia, as per Map recorded in Book 52, Page 13
of Maps in the Office of Said County Recorder.
. WHEREAS; a public hearing was held on said matter on
September 23, 1980, at which time all interested persons were given
full opportunity to be heard and to present evidence;
NOVr,THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:

I ,Section 1. That the factual data sutmitted by the
Planning Department in the attached staff report is true and correct.
Section 2. This Commission finds as follows:
1. .That there are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved, or to the intended use of the property,
, that do not apply generally to the property or class
of use in the same zone or vicinity.
2. That the granting of such variance will not be
materially detrimental to the public health or welfare
or injurious to the property or improvements in such

zone or vicinity in which the property is located.
. 3. That such variance is necessary for the preservation
and enjoyment of a substantial property right of the
applicant possessed by other property in the same zone
and vicinity.
4. That the granting of such variance will not adversely
affect the comprehensive General Plan.
Section 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a zone variance
for the construction of a single-family dwelling on a site with an
existing single-family dwelling upon the following conditions:
1. That the property shall be improved as per plans
on file in the subject Case No. V-80-2.
2. That the applicant shall file a covenant in the form
and content approved by the City Attorney guaranteeing
that upon completion of the front dwelling, the kit-
chen will be removed from the rear dwelling and that
said rear dwelling shall be used only as a guest house.
. 3. That the entire length of the existing driveway along
the easterly property line shall be landscaped and that
the existing driveway apron be removed if not used. This
shall be subject to the review and approval of the Plan-
ning Department.
4. That the Planning Commission grants the following
modifications:
A. Accessory building to contain 72% of the ground
floor of the main dwelling in lieu of 50% allowed.
1,020 square feet in lieu of 712.5 square feet
allowed (9252.2.11).
B. A 3'-0" westerly side yard setback in lieu of
5' -0" required for the attached single-story
garage (9252 :'2-'4) ~~ -
C. A 9'-5" easterly side yard setback in lieu of
10'-0" required for the second-story portion of
the main dwelling (9252.2.4).

5. That the proposed dwelling be completed and all con-
ditions of approval be complied with within one year
from the date of adoption of ~lanning Commission
Resolution No. 1149.
6, V-80-2 shall not take effect until the applicant and
owner have executed a form available at the Planning
Department indicating awareness and acceptance of the
conditions of approval.
Section 4. The Secretary shall certify to the adoption of
this resolution.

A Zone Variance to construct a new single-
family dwelling on a site with an existing
single-family dwelling, then convert the
existing dwelling, into a guest house.
15,570 square feet (.36 acres)
66.41 feet on Lemon Avenue
The site is developed with one single-
family dwelling; zones R-1.
Properties to the North, South, East and
West are developed with ,single-family
dwellings, zoned R-1.
Area is designated single-family residen-
tial (0-6 du/ac).
The existing single-story dwelling was constructed in 1934 with an
addition in 1937 and is in fair condition.
The ~pplicants are proposing to construct a two-story dwelling
cont,aining 2,309 square feet (including an attached garage) in front
of the existing dwelling. They are requesting the Zone Variance so
that" they"may live in the rear dwelling while the front house is being
constructed. Upon completion of the front house, the kitchen fac-
ilities in the rear house would be removed and the dwelling converted
into a guest house.
The existing dwelling contains 1,020 square feet. The ground floor
of the proposed house contains only 1,425 square feet. Section 9252.2.11
of the Arcadia Municipal Code states ",. .the total area of accessory

buildings shall not exceed 50% of the ground floor area of the
main building". The accessory buildings (existing dwelling)
exceed the allowable 50% by 22% or 307.5 square feet.
If this application were approved, the following modifications
would be required:
1. Accessory building to contain 72% of the ground floor area
of the main dwelling in lieu of 50% allowed (1,020 square

feet in lieu of 712.5 square feet).
2. A 3'0" westerly side yard setback in lieu of 5'0" required
for attached single-story garage (9252.2.4).
3. A 9' 5" easterly side yard setback in lieu of 10'0" required
for the second-story portion of the main dwelling (9252.2.4).
REQUIRED FINDINGS:
The Planning Commission should examine the information and make
findings which are relevant to the prerequisite conditions below:
Section 9291.1. 2 of the Arcadia Municipal Code states: "Prerequi-
site Conditions. Before a variance may be granted, it shall be
shown;
A.
That there are exceptional or extraordinary circumstances
or conditions applicable to the property involved, or to
the intended use of the property, that do not apply generally
to the property or class of use in the same zone or vicinity.
B. That the granting of such variance will not be materially
detrimental to the public health or welfare or injurious to
the property or improvements in such zone or vicinity in
which the property is located.
C. That such variance is necessary for the preservation and
enjoyment of a substantial property right of the applicant
possessed by other property in the same zone and vicinity.
D. That the granting of such variance will not adversely
affect the. comprehensive General Plan."
Attached for your consideration are those pages of the application
in, which the applicants have stated their case regarding the afore-
mentioned prerequisite conditions.

Because of the age and condition of the existing dwelling, the
construction of the new dwelling would be a substantial improve-
ment in the neighborhood.
If the application is approved, in order to insure that the
kitchen facilities in the rear dwelling will be removed and the
dwelling used as a guest house only, a. covenant in a form and
content approved by the City Attorney should be filed on the
property.
Pursuant to the provisions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for
the proposed project. Said initial study did not disclose any
substantial or potentially substandard adverse change in any of
the physical conditions within the area affected by the project
including land, air, water, minerals, flora, fauna, ambient noise
and objects of historical or aesthetic significance. Therefore,
a Negative Declaration has been prepared for this project.
Before the Planning Commission takes action on this project, the
Commission should "move to approve and file the Negative Declara-
tion and find that the project will not have a significant effect
on the environment".
RECOMMEND AT ION
The Planning Department recommends approval of V-80-2 subject to
. the following conditions:
1, That the applicant shall file a covenant in the form and
content approved by the City Attorney, guaranteeing that upon
completion of the front dwelling, the kitchen will be removed
from the rear dwelling and that said rear dwelling shall be
used only as a guest house. '
2. That the existing driveway apron shall be removed and the
entire 52'0" front yard be landscaped or that the ,entire
length of the existing driveway aiong the easterly property
line be paved. This shall be sUbject to the review and approval
of the Planning Department.
3. That the Planning Commission approve the following modifications:
A. Accessory building to contain 72% of the ground floor

After taking action on this application, the Planning Commission
should direct staff to prepare a resolution for adoption at its
next meeting, The Planning Commission action shall nQt be final
until adoption of the resolution, The appeal period for this
action commences at the time the Commission adopts the resolution.

ADDENDUM TO ANALYSIS SECTION
V-80-2 (637 WEST LEMON AVENUE)
A survey by staff of sixteen surrounding lots found that 50%
(8) of the main dwellings have at least one side yard set-'
back of 3' -0" and that six of the remaining eight lots have
accessory buildings with a 3'-0" side yard setback. Allow-
ing a 3'-0" westerly side yard for the proposed dwelling
would be consistent with the dwellings along Lemon Avenue.,
