RESOLUTION NO, 1143
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA RECOMMENDING APPROVAL OF TEXT AMENDMENT
80-5 TO REQUIRE THAT PARKING FACILITIES BE PROVIDED
IN COMPLIANCE WITH CODE WHEN EXISTING USES ARE CHANGED
TO A MORE INTENSIVE USE.
WHEREAS, a text amendment was initiated by the City for the
consideration of requiring that parking facilities be provided in
compliance with Code when existing uses are changed to a more inten-
sive use; and
WHEREAS, a public hearing was held on January 8, 1980, at which
time all interested persons were given full opportunity to be heard
and present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBY RECOMMENDS TO THE CITY COUNCIL THAT THE FOLLOWING AMENDMENT
BE MADE TO THE ARCADIA MUNICIPAL CODE:
Section 1, That Section 9269,3, be amended to read:
"9269,3. CHANGES IN USE. Whenever the existing use
of a structure or lot is changed to another use re-
quiring a larger number of parking spaces than required
for the existing use, parking facilities sh~ll be pro-
vided in accordance with the standards set forth in Part
6, Division 9 and Part 8, Division 4 of this Chapter,"
Section 2, The Planning Commission finds that this proposed
change will provide for more clarity in the Code, will establish
necessary regulations for parking facilities, and that the public
necessity, convenience, general welfare and good zoning practice
justify the above recommendation,

Section 3. The Secretary shall certify to the adoption of this
resolution and shall cause a copy to be forwarded to the City Council
of the City of Arcadia,

Text amendment to require that parking be provided
in compliance with Code when existing uses are
changed to a more intensive use
Since the Planning Commission's original consideration of this item
on January 8. 1980. the Planning Division has contacted 16 other
cities regarding their parking regulations. Ten of the cities have
specific regulations requiring parking to be changed when there is
a change in the use. Unfortunately, most of the regulations are as
pcorly worded as our existing code section. Five other cities did
not have specific regulations in their codes but did indicate in
conversation that none the less, changes in parking were required
with changes in use. One other city did not have or impose any
restrictions with respect to such changes. However, from the
regulations of a couple of the cities, the Planning Division was
able to obtain some ideas as to language which would make more clear
our intent.'
The following is a proposed revision to the wording of Section 9269.3.
CHANGES IN USE, from the wording contained in our original staff
report:
"9269.3. CHANGES IN USE. Whenever the existing
use of a structure or lot is changed to another
use requiring a larger number of parking spaces
than required for the existing use, parking
facilities shall be provided in accordance with
the standards set forth in Part 6, Division 9 and
Part 8. Division 4 of this Chapter."

The intent of the text amendment is to require the upgrading of
parking facilities (number of spaces, landscaping, etc.) when a more
intensive use is sought for the property or structure. No upgrading
would be required. when either a similar or a less intense use is
sought, even if there was an existing deficiency.

REQUEST:
Text amendment to require that parking be provided
in compliance with code when exisLing uses are
changed to a more inLensive use.
PROPOSAL
This text amendment was initiated by the City in order to provide
clarification to existing code requirements,
Existing Arcadia Municipal Code Section 9269,3, states as follows:
"9269.3, CHANGES IN USE, Whenever the existing use
of a structure or lot is changed to another use, park-
ing facilities shall be provided in accordance with
the standards set forth herein,"
This amendment is for the consideration of amending the aforementioned
section to read as follows:
",9269,3. CHANGES IN USE, Whenever the exist ing use
of a structure or lot is changed to another use which
requires a greater number of parking spaces than the
number of parking spaces required for the previous use
based on the provisions of this Division, then parking
facilities shall be provided in accordance with the
standards set forth herein,"
ANALYSIS
The existing code section does not differentiate between changes from
more intensive uses to less intensive uses or vise versa, In addition,

the term "standards set forth herein" is not limited to just the
number of required parking spaces, but to all of the other parking
criteria, .
The strict application of the existing code section would impose a
tremendous hardship on many property and business owners.
However, it is becomming apparent that to not enforce this section
would allow for a building to be designed, built and occupied by
business office uses requiring four parking spaces per 1001 square
feet of gross floor area and then to change uses to a retail uses
requiring five parking spaces per 1001 square feet of gross floor
area (a reduction of 20%) or to medical uses requiring six parking
spaces per 1001 square feet of gross floor area (a reduction of 33%),
Substantial hardship will be avoided if the proposed amendment is
adopted and the upgrading of parking facilities is required only when
the change in use requires additional parking spaces. In addition,
the amendment will reduce the potential for circumvention of the
existing parking space requirements,
Pursuant to the provisions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for the
proposed project, Said initial study did not disclose any substan~
tial or potentially substantial adverse change in any of the phy~
sical conditions.within the area affected by the project including
land, air, water, minerals, flora, fauna, ambient noise, and objects
of historical or aesthetic significance, Therefore, a Negative
Declaration bas been prepared for this project.
Before the Planning Commission and City Council takes action on this
project, the Commission and Council should "move to approve and file
the Negative Declarafion and find that the projeci will not have a
significant effect on the environment,"
