A RESOLUTION OF THE Ph~NNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A ZONE VARIANCE
TO PERMIT AN ADDITION TO THE'EXISTING MAIN
DWELLING ON A NONCONFORMING LOT IN A R-l
ZONE AT 1224 SOUTH MAYFLOWER AVENUE
WHEREAS, on April 21, 1980, an application was filed by Rodney
L. Williamson and Anna M. Williamson for a zone variance to permit
an additional 128 square feet of floor area (500 square feet allowed
by M-80-57 - a total addition to equal 628 square feet) to the main
dwelling on a lot'with three one-family dwellings which are non-
conforming.uses, structures or buildings under Arcadia Municipal
Code Sections 9251.1 and 9252.1.1., Planning Department Case No.
V-80-1, on property commonly known as 1224 South Mayflower Avenue,
. more particularly described as follows:
Portion of Lot 32 of F. A. Geier Tract in the
City of Arcadia, County of Los Angeles, State
of California, as per Map recorded in Book 23,
Page 40 of Maps in the office of said County

WHEREAS, a public hearing was held on said matter on May 13,
1980, at which time all interested persons were given full oppor-
tunity to be heard and to present evidence:
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the attached staff report is true and correct.

SECTION 2. This Commission finds that:
1. That there are exceptional or extraordinary circum-
stances or conditions applicable to the property involved, or to
the intended use of the property, that do not apply generally to
the property or class of use in the same zone or vicinity.
2. That the granting of such variance will not be
materially detrimental to the public health or welfare or injurious
to the property or improvements in such zone or vicinity in which
the property is located.
3. That such variance is necessary for the preservation
and enjoyment of a substantial property right of the applicant
possessed by other property in the same zone and vicinity.
4. That the granting of such variance will not adversely
affect the comprehensive general plan.
SECTION 3. That for the foregoing reasons, subject to approval
of the City Council, this commission grants a zone variance for the
construction of an additional 128 square feet of floor area (500
square feet allowed by M-80-57 - total addition to equal 628 square
feet) to the main dwelling on a lot with three one-family dwellings
upon the following conditions:
1. That V-80-1 shall not take effect until the applicant
and owner have executed the covenant as required by Modification
M-80-57 requiring the removal or remodeling (remove kitchen
facilities) of the nonconforming rental structures at 1224 South
Mayflower Avenue within twenty (20) years. The covenant shall be
approved to form and content by the City Attorney.

2, V-80-1 shall not take effect until the applicant and

indicating awareness and acceptance of the conditions of approval.
SECTION 4. The Secretary shall certify to the adoption of
this Resolution.

HISTORY: .
The Building Division permit records show that the main dwelling was
constructed in 1927 with additions made in 1947 and 1967, The rear
dwelling was constructed in 1947 with no additions made as to date,

On January 16, 1979, Ordinance No, 1655 was adopted which allowed
for a maximum 500 sq, ft, addition to the main dwelling on a lot
with two or more one-family dwellings with an approved modification,
This procedure was provided in response to past Variance Applications
for additions to nonconforming dwellings in the R-l Zone
On April 22, 1980, Modification M-80-57 was approved allowing for the
maximum 500 square foot addition to the main dwelling for a bedroom
and bath,
A real estate inspection was made on April 4, 1980, by the Building
and Safety Division and no corrections were required for any structures
on the lot, The modification was approved on the condition that a
Covenant be recorded that would require the removal or remodeling
(remove kitchen facilities) of the nonconforming rental structures on
the subject lot within twenty (20) years,
The applicant is requesting the Zone Variance so that he may construct
a loft (168 sq, ft. - 12' x 14') within the addition approved by M-80-
57, The loft will be above the bathroom and has access from a spiral
staircase located in the bedroom, The loft will be open to the bed-
room below, The addition will be 20 feet in height, Code allows for
... a maximum height of 35 feet,
REQUIRED FINDINGS
The Planning Commission should examine the information and make find-
ings which are relevant to the prerequisite conditions below:
Section 9291,1,2, of the Arcadia Municipal Code states' "Prerequisite
Conditions, Before a variance may be granted. it shall be shown:
a, That there are exceptional or extraordinary circumstances or
conditions applicable to the property involved, or to the in-
tended use of the property, that do not apply generally to the
property or class of use in the same zone or vicinity.
b, That the granting of such variance will not be materially detri-
mental to the public health or welfare or injurious to the property
or improvements in such zone or vicinity in which the property is
located,
c, That such variance is necessary for the preservation and enjoyment
of a substantial property right of the applicant possessed by
other property in the same zone and vicinity.

d, That the granting of such variance will not adversely affect the
comprehensive general plan,

Attached for your consideration are those pages of the application
in which the applicants have stated their case regarding the afore-
mentioned prerequisite conditions
ANALYSIS
The granting of this Variance will not encourage the retention of a
non-conforming R-2 type use in an area designated for single-family
use by both the General Plan and the Zoning Ordinance,
The Code allows non-conforming uses and structures to be maintained
until it is feasible to remove them to develop the property in con-
formance with the General Plan and the minimum development standards,
This allows the property owners to amortize the value of the non-con-
forming structure over the effective life of that structure, With
the approval of Modification 11-80-57, the non-conforming rental will
be brought into conformance within twenty (20) years,
Pursuant to the provisions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for the
proposed project, Said initial study did not disclose any substan-
tial or potentially substantial adverse change in any of the phy-
sical conditions within the area affected by the project including
land, air, water, minerals, flora, fauna, ambient noise, and objects
of historical or aesthetic significance, Therefore, a Negative
Declaration has been prepared for this project,
Should the Planning Commission wish to approve this application, the
Commission should "move to approve and file the Negative Declaration
and find that the project will not have a significant effect on the
environment,"
RECOMMENDATION
The Planning Department recommends approval of V-80_1 on the follow_
ing conditions:
1, That V-80-1 shall not take effect until the applicant and
owner have executed the Covenant as required by 110dification
M-80-57 requiring the removal or remodeling (remove kitchen
facilities) of the non-conforming rental structures on the
subject site lot within twenty (20) years. The Covenant shall
be approved as to form and content by the City Attorney,

have ex~cuted a form available at the Planning Department in_
dicating awareness and acceptance of the conditions of approval,

After taking action on this application, the Planning Commission
should direct staff to prepare a resolution for adoption at its
next meeting, The Planning Commission's action shall not be final
until adoption of the resolution, The appeal period for this action
commences at the time the Commission adopts the resolution

A. Request to construct a 500 square foot

9251.1 and 9252.1.1 (9292.1.4.15).
B. Request proposed addition to the main
dwelling to be within 6 feet of existing
second one-family dwelling in lieu of 10
feet required (9252.2.11).
FINDINGS
With an approved modification the applicant can construct 500 square feet of additional floor area
to the main dwelling on the lot. A real estate inspection has been made by the Building and Safety
Division and no corrections were required for any structures on the lot.
Staff presented a photo which showed that 6 feet between the proposed addition and existing non-
conforming dwelling would allow for adequa te access (existing walkway).
There was no opposition to the proposed modification. The granting of the modification would secure
an appropriate improvement.
ACTION
Approved on the following conditions:
1. That a covenant be recorded that would require the removal or remodeling (remove kitchen
facilities) of the nonconforming rental structures on the subject lot within 20 years. The
covenant shall be approved to form and content by the City Attorney.
2. That the existing patio cover attached to the family room (as per plans on file) may be replaced
by the applicant after demolition due to construction of the subject addition.
Please contact the Building Department at 446-4471, ext. 20 to determine number of building
plans required for plan check and proper permits to be obtained before construction.

consider the granting of such a request to be ~it~in che reasonsb~ eTPectations
of any property owner.
