RESOLUTION NO, 1138 A RESOLUTION OF THE PLANNING COM/.'lSSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL' USE PER~IIT FOR A 3- UNIT APARTMENT BUILDING AT 146 ALICE STREET, WHEREAS, on February 12. 1980, an application was filed by Mike DiFilippo for a three (3) unit apartment building, Planning Department Case No, C,U,P, 80-3 on property commonly known as 146 Alice Street, more particularly described as follows: Lot 28, Block 62, in the Santa Anita Tract as recorded in Map Book 16. Page 58, in the Office of the Los Angeles County Recorder, WHEREAS, a public hearing was held on March 11, 1980 and March 25, 1980, at which time all interested persons were given full opportunity to be heard and to present evidence; NOli'. THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1, That the factual data submitted by the Planning Department in the attached staff report is true and correct, Section 2, This Commission find that: 1, The granting of a Conditional Use Permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity, 2, The use applied for at the location indicated is a proper one for which a Conditional Use Permit is authorized. 3, The site for the proposed use is adequate in size and shape to accommodate said use, including all yards, parki,ng. loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood, 1138 'V,. . 4, The site abuts ,streets and highways adequate in width and pavement type to carry the kind of traffic generated by the pro- posed use, 5, The granting of such Conditional Use Permit will not adversely affect the General Plan, 6, The use applied for will not have a significant effect on the environment, 7, The proposed use complies with all requirements set forth for the issuance of a Conditional Use Permit, 8, The proposed use will not substantially increase vehicular traffic on any street in a residentially zoned district, 9. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by interfering with pedestrian traffic, . 10, The proposed use will not create increased traffic haz- ards to pedestrians when located near a school, church, auditorium, theater or other place of assembly, Section 3, That for the foregoing reasons, suhject to Rpproval of the City Council, this Commission grants a Conditional Use Permit for a 3-unit apartment building upon the following conditions: 1, The property shall be improved and maintained in accor- dance with plans on file in the subject Case No, C U,P, 80-3, and that said plans be applicable to the regulations of the Arcadia Municipal Code, 2, The proposed building shall comply with Building Division regulations, 3, grading and opment, the Prior to the issuance of a building permit an approved drainage plan wi 11 be required; and concurrent wi th devel- existing drive apron (not to be used) shall be closed, . -2- 1138 :' ." . " 4, Water service for the proposed development to conform to the Uniform Plumbing Code and to be installed by Arcadia Water Division at developer's expense, 5, The proposed building shall comply with regulations set forth by the fire Department, 6, The Planning Commission grant the following modifications: A, A zero side yard setback for a proposed garage adjacent to the westerly property line and a pro- posed trash enclosure adjacent to the easterly property line in lieu of 10' required (9255,2 4) B, The deletion of a 5 foot between any open parking erty lines or buildings, wide planting area required spaces and adj?ining prop- (9255,~,8) C, Fifty percent (50%) of the required landscaped rear yard to be deleted for vehicular access, and a nor- . tion of said rear yard to be 5' (in depth) in lieu of 10' required (9255,2,5) . 7. That an offer of dedication be made to the City of Arcadia for a five (5) foot porti~n on the north side of the alley, in form and content satisfactory to the City Attorney, that the alley be improved to Arcadia Municipal Code Standards by the owner for the five (5) foot dedication, and a 20 ft, front yard setback be granted in lieu of the 25 ft, required. 8, If any attempt is made to convert this property into a cooperative multiple dwelling, the Conditional Use Permit 80-3 and the requested modifications shall become null and void and applicant shall execute a Covenant to this effect in a form and with content approved by the City Attorney, to be recorded and run with the land, -3- 1138 .. , . . . 9. Conditional Use PerMit 80-3 shall not take effect until the owner and applicant have executed a form available at the Plann- ing Department indicating awareness and acceptance of the conditions of approval. Section 4. Would there be an objection to limit access onto Sec- ond Avenue from the alley by the placement of a "Right- Turn Only" sign? Reply to Item No.1 The City does not have the necessary right of way to continue the alley westerly to First Avenue. Due to grade problems and lack of necessary right of way, alley stop at the approximate west property line of 138 Alice Street. map showing existing and proposed alley construction. construction will Refer to attached Reply to Item No.2 . Unless the Council authorizes the acquisition of right of way for drainage purposes, the alley cannot be constructed beyond that shouwn on attached map, For this reason, future mutiple developments west of 138 Alice Street will not be able to use the alley for vehicular ingress and egress, Reply to Item No.3 This Department does not unless the need exists, to determine if the need recommend the use of Right Turn Only sign at alley entrance It is recommended that traffic be monitored periodically exists for turning restrictions. tZt;/!h~ CHESTER N.
