RESOLUTION NO. 1137 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING APPROVAL OF ZONE CHANGE 80-1 FROM R-O & D 30,000 TO R-O & D 22,000 FOR THE PROPERTY AT 701 WEST FOOTHILL BOULEVARD, WHEREAS, an application was filed by Lowry B. McCaslin on February 19, 1980, requesting a zone change from R-O & D 30,000 to R-O & D 22,000 for the property at 701 West Foothill Boulevard, (Anoakia property), more particularly described as follows: Portion of Lot 3, Tract No. 948, Map Book 17, Page 21, and portions of Rancho Santa Anita Tract, Pat. 1, 97 & 98. WHEREAS, a public hearing was held on March 11, 1980, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION MAKES THE FOLLOWING RECOMMENDATION AND FINDS AS FOLLOWS: Section 1, That the factual data submitted by the Planning Department in the attached staff report is true and correct. Section 2, The Planning Commission recommends to the City Council a zone change from R-O & D 30,000 to R-O & D 22,000 for the property at 701 West Foothill Boulevard, Section 3, That the Planning Commission finds that the pro- posed zone change would be consistent with the General Plan and the public convenience, necessity and general welfare justify the proposed zone change. -1- 1137 . . . McCaslin Zone Change from R-08oD 30,000 to R-O&D 22,000 701 West Foothill Boulevard (Anoakia property) The site is developed with a school, outbuildings, offices, and house and zoned R-O&D 30,000, The site contains 19.13 acres 772 feet of frontage on Baldwin Avenue and 1051 feet of frontage on Foothill Boulevard 950 feet of frontage on Anoakia Lane. North: Developed with single family dwellin~s: Zoned R-O&D.30,000 South: Across Foothill Boulevard, developed with single family dwellings; zoned R-l 10,000, East: Across Baldwin Avenue, developed with single family dwellings; zoned R-O 15,000. West: Developed with single family dwellings; zoned R-O&D 30,000. Subject Site: Single Family Residential 0-2 dujac North: Single Fami ly Residential 0-2 dujac South: Single Family Residential 0-4 dujac East Single Family Residential 0-4 dujac West Single Family Residential 0-2 dujac HISTORY In March, 1972, the City's General Plan was adopted designating the subject area as single-family residential 0-2 dujac. -1- ZONE CHANGE 80-1 . HISTORY (Contd.) . '. . In August, 1975, the subject area was annexed to the City of Arcadia. Concurrent with the area's annexation, said area was placed in zone classification R-l (7,500) in accordance with Sec- tion 9232.6 of the Arcadia Municipal Code. In June, 1975, Mr. Lowry McCaslin filed an application for a change in the City's General Plan (G,P. 75-4) from 0-2 dulac to 0-4 du/ac. In February, 1976, the City received a petition containing 314 signa- tures requesting R-O 30,000 zoning for the subject area. Action on this petition was tabled pending action by the Planning Commission and City Council on Mr. McCaslin's General Plan request. In August of 1976, the Planning Commission recommended denial of G.P. 75-4. On November 9, 1976, the applicant withdrew his applica- tion for the General Plan Change, prior to City Council action, Upon this withdrawal, the City Council directed staff to initiate zone change proceedings to rezone the property to be consistent with the General Plan (Z-76-3), . A zone change from R-l 7500 to R-O 30,000 was approved by the City Council on 3-1-77. At this meeting several of the Council Members indicated that the City should consider a zone classification which would allow for smaller lots which would be consistent with the General Plan designation of Single Family Residen tial 0'.;.2. du/ac. Subsequent Text Amendments have been approved which provide' for 22,000 sq. ft. lots which meet this requirement. On December 2, 1977, a petition was submitted to the City by 12 of 17 property owners in the Anoakia area, requesting a zone change for all the Anoakia area from R-O 30,000 to R-O 30,000~D, whinh would place all of the Anoakia area in the Rancho Santa Anita Property Owners' Association. On 4/18/78 the City Council adopted Ordinance 1625 which reclassified the Anoakia area from R-O 30,000 to R-O 30,000 D. SPECIAL INFORMATION The applicant is requesting a zone change from R-OD 30,000 to R-OD 22,000. Attached Exhibits A, B, and C, illustrate the average lot sizes, average dwelling units per acre, and the individual lot sizes with- in the area. If.the site were developed as R-O 30,000, a maximum of 24 lots and homes could be developed in accordance with said zoning on this site. If the site is rezoned to a-O 22,000, 29 to 32 lots and homes could be developed in accordance with all the zoning regulations. -2- ... Zone Change 80-1 . . ANALYSIS The R-O&D 22,000 zoning is consistent with the General Plan des- ignation of Single Family Residential 0-2 dulac" It is staff's opinion that such a zone change would not be detrimental to the area and would not compromise the integrity and quality of the neighborhood. The design overlay would ensure that the develop- ment standards in the area are maintained. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substan- tial or potentially substantial adverse change in any of the phy- sical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission and City Council takes action on this project, the Commission and Council should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment."
