A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A 12-UNIT RESIDENTIAL CONDO- MINIUM AT 309-315 CALIFORNIA STREET. WHEREAS, on January 29, 1980, an application was filed by Robert Bent for a twelve (12) unit residential condominium, Planning Depart- ment Case No. C.U.P. 80-2 on property commonly known as 309-315 California Street, more particularly described as follows: Portion of Block 57 of the Santa Anita Tract as recorded in Map Book 34-41 and 42, in the Office of the Los Angeles County Recorder, WHEREAS, a public hearing was held on February 26, 1980, at which time all interested persons were given full opportunity to be heard . and to present evidence; NOW, THEREFORE, THE PLANNING COMtlISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Depart- ment in the attached staff report is true and correct, Section 2, This Commission finds that: I. The granting of a Conditional Use Permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity, 2. The use applied for at the location indicated is .a proper one Tor which a Conditional Use Permit is authorized. 3, The site for the proposed use is adequate in size and shape to accommodate said use, including all yards, parking, loading, land- . scaping and other features required to adjust said use with the land and uses in the neighborhood, -l- 1135 ,. . ~ 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed ~ . use. 5. The granting of such Conditional Use Permit will not adversely affect the General Plan. 6. The use applied for will not have a significant effect on the environment. 7, The proposed use complies with all requirements set forth for the issuance of a Conditional Use Permit. 8. The proposed use will not substantially increase vehicular traffic on any street in a residentially zoned district, 9. The proposed use will not lessen the suitability of any near- by commercially zoned property for commercial use by interfering with pedestrian traffic, IO. The proposed use will not create increased traffic hazards to pedestrians when located near a school, church, auditorium, theater or other place of assembly. Section 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a Conditional Use Permit for a 12-unit residential condominiu~ upon the following conditions: I: The property shall be improved and maintained in accordance with plans on.file in the subject Case No. C,U.P. 80-2 with the excep- tion of the requested modifications which were not granted by the Commission,' and that said plans be applicable to the regulations of the Arcadia Municipal Code. -2- 1135 . 2. The proposed building shall comply with Building Divi- sion regulations. 3, Water service to the development to conform to the Uniform Plumbing Code and to be installed by Arcadia Water Division at developer's expense. 4. The proposed building shall comply with regulations set forth by the Fire Deparment. 5. That a solid masonry wall, the height and location of which shall be subject to the review and approval of the Planning Department, shall be constructed along interior side and rear lot lines of the project site. 6. Conditional Use Permit 80-2 shall not take effect until . the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval, Section 4. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. CODE COMPLIANCE The proposed plans are in compliance with the revised R-3 Multiple Family Development Standards as approved by the City Council on Febru- ary 19, 1980, with the exception of the aforementioned modifications (Items B, C, D, and F), In addition to these modifications, one guest parking space (No.6) of the six spaces provided is deficient in pro- viding thirty feet (30') of back-out space as required by the revised standards. . BUILDING INFORMATION SUMMARY The applicant is proposing to construct a 12 unit residential condo- minium which will consist of the following: Open Area (including deck) Required: 9,766 square feet (28% of lot area) Provided: 14,074 square feet ( 4%) Common Recreational Area (deck area) Required: 697.6 square feet (2% of lot area) Provided: 1465 square feet (4%) Landscaped Area Required: Provided: 7037 square feet (50% of open area) 7537 square feet (53%) Patio Area Per Required: Provided: Unit 200 308 square feet minimum square feet The proposed 12 units will consist of eight three-bedroom units with approximately 1790 square feet per unit and four two-bedroom units with approximately 1834 square feet per unit. . -2- C.U.P. 80-2 . All of the proposed units will provide an interior storage room of approximately 180 square feet in addition to the required general storage cabinets. ANALYSIS The proposed construction of a 12 unit residential condominium is a permitted use in a R-3 zone with an approved Conditional Use Permit. The proposed residential condominium on the subject site would be consistent with the General Plan and Zoning Ordinance with the excep- tion of the requested modifications! Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or poten- tially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance, Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission takes action on this project, the Commi- ssion should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the envir- onment." . RECOMMENDATIONS Because the proposed project incorporates the revised R-3 Development Standards as approved by the City Council, the Planning Department recommends approval of C.U.P. 80-2 subject to the following conditions: I. The proposed building shall comply with Building Division regulations. 2. Water service to the development to conform to the Uniform Plumbing Code and to be installed by Arcadia Water Division at developer's expense. 3. The proposed bUilding shall comply with regulations set forth by the Fire Department. '4. That a solid masonry wall, the height and location of which shall be subject to the review and approval of the Planning Department, shall be constructed along interior side and rear lot lines of the project site. 5.
