OF THE ARCADIA MUNICIPAL CODE TO REQUIRE A CONDITIONAL USE PERMIT FOR ALL DEVELOPMENT WITHIN A R-3 ZONE AND TITLE I. PREREQUISITES AND CLASS- IFICATION OF DIVISION 5. CONDITIONAL USES OF SAID MUN- ICIPAL CODE TO INCLUDE A CLASSIFICATION FOR MULTIPLE FAMILY DWELLINGS. WHEREAS, a Text Amendment was initiated by the City for the con- sideration of revising Section 9255.1. of the Arcadia Municipal Code to require a Conditional Use Permit for all development within a R-3 zone and TITLE I. (Prerequisites and Classification) of Division 5. (Conditional Uses) of said Municipal Code to include a classification for multiple family dwellings. . WHEREAS, a public hearing was held on January 22, 1980, at which time all interested persons were given full opportunity to be heard and present evidence; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF ARCADIA AS FOLLOWS: Section I. That the factual data submitted by the Planning Depart- ment in the attached report is true and correct. Section 2. This Commission finds that the public necessity and general welfare do not justify said Text Amendment. Section 3. For the foregoing reasons the Planning Commission re- commends to the City Council denial of T.A. 80-6. Section 4. The Secretary shall certify to the adoption of this resolution. . -l- 1132 . . . PROPOSAL: ". Existing: . Proposal to amend the following: I. Section 9255.1. of the Arcadia Municipal Code to require a Conditional Use Permit for all development within a R-3 zone, including the conversion of existing multiple dwellings into co-operative multiple dwellings, 2. TITLE I. (Prerequisites and Classification) of Division 5 (Conditional Uses) of said Municipal Code to include a classification for multiple family dwellings. This text amendment was initiated by the Planning Department in order to insure that a Conditional Use Permit procedure for R-3 development be adopted prior to the expiration of the existing moratorium. In the event the proposed R-3 code revisions as submitted by Text Amendment 80-7 does not become effective prior to said expiration on May 15, 1980, the adoption of a Conditional Use Permit procedure would aid the Plann- ing Commission in the review of proposals as the exist- ing moratorium implements until such time the R-3 revisions are adopted, This amendment is for the consideration of the follow- ing: 9255.1. GENERAL. "9255.1. GENERAL, No building or land shall be used and no building shall be hereafter erected, constructed, or established except for the uses specified in the following sub-sect ions, " . . . , - '. Proposed: 9255.1. GENERAL. No building or land shall be used and no building shall be hereafter erected, constructed, established or the conversion of, existing multiple dwellings into cooperative multiple dwellings except for the uses specified in the follow- ing subsections with an approved Conditional Use Per- mit pursuant to and in accordance with Title I (Pre- requisites and Classification) and Title 2 (Procedures) of Division 5, Part 7, Chapter 2, Article IX of the Arcadia Municipal Code. ANALYSIS: It is staff's opinion that a Conditional Use Permit process would necessitate a total design perspective of a proposal before the Planning Commission and in doing so would aid in implementing Code compliance, TITLE I. PREREQUISITES AND CLASSIFICATION Proposal: To add to the existing Code the following section: "9275.1.52.1.1. MULTIPLE FAMILY DWELLINGf-. R-3" AnalysiS: The proposed addition of the aforementioned section to the existing Code would classify multiple' family dwellings to be allowed in a R-3 zone upon the grant- ing of a Conditional Use Permit. ANALYSIS OF THE PROPOSED TEXT AMENDMENT It has become apparent that special consideration must be taken in order to avoid the unique problems that may beset multiple family projects. It is staff's opinion that the proposed text amendment would insure a more percise design procedure which would aid in mitigating any foreseeable problems. Pursuant to the provisions of the California Environmental Quality Act, tbe Planning. Department has prepared an initial study for the proposed project. Said initial study did not disclose any substan- tial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance, Therefore, a Negative Declara- tion has been prepared for this project. Before the Planning Commission and City Council take action on this project, the Commission and Council should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment." -2- . . . ." '; RECOMMENDATION The Planning Department recommends approval of Text Amendment 80-6 as set forth in the staff report. After taking action on this application, the Planning Commission should direct staff to prepare a resolution for adoption at its next meeting. The Planning Commission's action shall not be final until adoption of the resolution, The appeal period for this action com- mences at the time the Commission adopts the resolution.
