A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING APPROVAL OF TEXT AMENDMENT 80-2 TO PERMIT OUTDOOR STORAGE IN COMMERCIAL AND INDUSTRIAL ZONES ON A CONDITIONAL USE PERMIT BASIS. WHEREAS, a text amendment was initiated by the City for the con- sideration of allowing outdoor storage in commercial and industrial zones on a Conditional Use Permit basis; and, WHEREAS, a public hearing was held on January 8, 1980, at which time all interested persons were given full opportunity to be heard and present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RECOMMENDS TO THE CITY COUNCIL THAT THE FOLLOWING AMENDMENTS BE MADE TO THE ARCADIA MUNICIPAL CODE: Section 1. That Section 9266.2.7. be amended to read: "9266.2.7. STORAGE. All permanent and temporary storage . of wares and merchandise, crates, bottles and similar items shall be within a building except that trash, garbage and re- fuse may be temporarily stored outside the building, provided, however, that such refuse shall be completely screened from public view by an enclosure of which three (3) sides shall con- sist of six (6) foot high decorative masonry walls or other screening devices approved by the Planning Department." Section 2. That Section 9275.l.53.1. be added to read: "9275.1.53.1. OUTDOOR STORAGE. Outdoor storage of wares, merchandise, crates, bottles, and similar items, in a C-2 or any less restrictive commercial or industrial zone." Section' 3. The Planning Commission finds that these proposed changes will provide more flexibility in the Code, will establish necessary regulations for outdoor storage, and that the public nec- essity, convenience, general welfare and good zoning practice justify the above recommendations. . 1130 . . PROPOSAL . The City Council recently expressed concern with the adequacy of existing regulations governing the .screening of outdoor storage in the industrial zones, and requested that a text amendment be initiated for the consideration of amending the existing regula- tions by providing for such storage on a conditional use permit basis. The existing M-I zone outside storage regulations read as follows: "Section 9266.2.7. OUTSIDE USAGE. Property outside a building may be used for parking, loading and storage areas, provided that all such storage activities con- ducted thereon are screened from view from adjoining procerties and public rights of way," By amending this Section to read as follows, the outside storage regulations for the M-I zone would be consistent with the outside storage and trash regulations of the commercial zones: . "9266.2.7. STORAGE. To: Planning Commission January 8, 1980 T.A. 80-2 In order to allow for outside storage, on a conditional use permit basis, in both the commercial and industrial zones, Section "9275.1.52.3. NURSERIES, PLANTS. Plant nurseries in a C-2 or any less restrictive commercial or industrial zone..." is recommended to be amended to read as follows: "9275.1.52.3. OUTDOOR STORAGE. Outdoor storage of wares, merchandise, crates, bottles, and similar items, and plant nurseries in a C-2 or any less restrictive commercial or industrial zone..." ANALYSIS The proposed code amendments would not alter the status of exist- ing legal non-conforming uses, but would provide for a more in- depth review and analysis of future outdoor storage activities in both commercial and industrial zones. '. Because the nature of outdoor storage can vary greatly from one use to another, the proposed text amendment will allow individual consideration of the nature of the storage, the proposed screen- ing, and the relationship of the proposed storage and screening to the surrounding area. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substan- tial or potentially substantial adverse change in any of the phy- sical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and ob- jects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission and City Council takes action on ,this project, the'Commission and Council should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment."
