A RESOLUTION OF THE PLAI\Tt-TING COMMISSION OF THF
CITY OF ARCADIA RECOMMENDING APPROVAL OF TFXT
AMENDMENT 80-1 TO AHEND THE SIDE YARD. .AND REAR
YARD SETBACK REQUIREMENTS FOR THE R-M, R_O AND
R-I ZONES.

WHEREAS, a text amendment was initiated by the City for the
consideration of amending the side yard and rear yard setback re~
quirements for the R-M, R-O and R-I zones; and,
WHEREAS, a public hearing was held on January 8, 1980, at which
time all interested persons were given full opportunity to be heard
and to present evidence;
NOW, THEREFORE, TEE PLANNING COIlMISSION OF TEE CITY OF ARCADIA
HEREBY RECOMMENDS TO THE CITY COUNCIL THAT THE FOLLOWING AHEND\lENTS
BE MADE TO THE ARCADIA MUNICIPAL CODE:
Section 1. That Sections 9251.2.4.1., 9252.2.4.1., 9251.2.6.1.
and 9252.2.8.1. be deleted.
Section 2. That Section 9250.3.4. be amended to read:
"9250.3.4. REAR YARD. There shall be a rear yard of not
less than twenty-five (25') feet (7.62 meters). Any two-story
portion of a dwelling shall have a rear yard setback of not less
than thirty-five (35') feet (10.67 meters)."
Section 3. The Planning Commission finds that the public necessity,
convenience, general welfare and good zoning practice justify the above
recommendations.
Section 4. The Secretary shall certify to the adoption of this
resolution and shall cause a copy to be forwarded to the City Council
of the City of Arcadia.
I HEREBY CERTIFY that the foregoing Resolution was adopted at a
regular meeting of the Planning Commission of the City of Arcadia held
on the 22nd day of January, 1980, by the following vote:

REQUEST:
Text Amendment to change the side yard and rear yard
setback requirements for the R-M, R-O and R-l Zones.
PROPOSAL:
The Planning Commission at its December II, 1979 meeting requested
staff to initiate a separate text amendment to establish new regula-
tions for side and rear yard setbacks for two-story dwellings and
additions.
The existing R-O and R-l side yard setbacks read:
R-O
"9251.2.4. SIDE YARD, On interior lots there shall be a
side yard on each side of a building of not less than five
(5) feet."
"9251.2.4.l. SAME. TWO-STORY DWELLINGS. Every two-story
dwelling shall have a side yard on each side of every build-
.ing of a width not less than one-half the height of such
building, provided that the side yard need not exceed ten
(IO) feet."
"9251,.2.5. SAME. CORNER LOT. On corner lots the required
side yard adjoining the interior lot shall be the same as
for interior lots. The required side yard on the street side
shall be not less than twenty (20) feet. ,.

~52:2.4.,SIDE YARD. On interior lots there shall be a side
yard on each side of a building of not less than three (3)
feet, provided that when one or more dwellings are erected
at locations on a lot other than the building side contiguous
to the front yard, the required side yard for each such build-
ing shall be not less than ten (10) feet."

"9252.2.4.I, SAME. TWO-STORY STRUCTURE, On lots where a
two-story structure is erected, constructed or established,
there shall be a side yard on each side of the building of
the building of not less than five (5) feet."
"9252.2.5. SAME. CORNER LOT. On corner lots the required
side yard line adjoining the interior lot shall be the same
as for interior lots. The required side yard on the street
side shall be ten percent (10%) of the width of the lot,
provided it shall be not less than ten (10) feet,"
The Planning Department recommends the following changes:

side yard on each side of every building of not less than
ten (10) feet (3.05 meters) in width."
Delete Section 9251.2.4.I,

ten (10) feet (3.05 meters) in width. The required side yard
on the street side of a corner lot shall be not less than
twenty (20) feet (6.09 meters),"

five (5) feet (1.52 meters) in width. Any two (2) story
portion of a dwelling shall have a side yard setback of not
less than ten (10) feet (3,05 meters)."
Delete Section 9252.2.4.1.
"9252.2.5. SAME. CORNER LOT. On corner lots the required
side yard adjoining the interior lot shall be not less than
five (5) feet (1'.52 meters), The required side yard on the
street side of a corner lot shall be not less than ten (10)
feet (3.05 meters). Any garage opening directly upon a side
street shall be located not less than twenty (20) feet (6.10
meters) from the street side lot line."
The existing R-M, R-O and R-I rear yard setback requirements read:

These proposed changes to the R-O and R-I zone were originally approved
by the Planning Commission on March 27, 1979 (T,A, 79-3). On Hay 2,
1979 this Text Amendment was approved by the City Council, An

ordinance has not been adopted at this time. It was the Planning
Department's opinion that the R-M zone rear yard requirements should
be consistent with the R-I requirements.
Pursuant to the provisions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for the
proposed project. Said initial study did not disclose any substan-
tial or potentially substantial adverse change in any of the phy-
sical conditions within the area affected by the project including
land, air, water, minerals, flora, fauna, ambient joise, and objects
of historical or aesthetic Significance. Therefore, a Negative
Declaration has been prepared for this project.
Before the Planning Commission and City Council takes action on
this project, the Commission and Council should "move to approve
and file the Negative Declaration and find that the project will
not have a significant effect on the environment."
RECOMMENDATION
The Planning Department recommends approval of T.A, 80-1.
