RESOLUTION NO. 1128 A RESOLUTION OF THE PLANNING COHMISSION OF THE CITY OF ARCADIA RECOMMENDING DENIAL OF TEXT AMENDMENT 80-4 TO ALLOW COMMERCIAL USES IN AN INDUSTRIAL ZONE WITH AN APPROVED CONDI- TIONAL USE PERMIT. WHEREAS, a text amendment was initiated by the City for the consideration of allowing commercial uses in an industrial zone with an approved Conditional Use Permit; and, WHEREAS, a public hearing was held on January 8, 1980, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF ARCADIA AS FOLLOWS: Section I. That the factual data submitted by the Planning Depart- ment in the attached report is true and correct. Section 2. This Commission finds that the public necessity and general welfare do not justify said text amendment. Section 3. For the foregoing reasons the Planning Commission recommends to the City Council denial of T.A. 80-4. Section 4. The secretary shall certify to the adoption of this resolution. REQUEST: Text Amendment to allow commercial uses in an in- dustrial zone with an approved Conditional Use Permit, PROPOSAL AND ANALYSIS The Planning Department is recommending that the following section be added to "Conditional Uses Permitted in Specified Zones." "9275.1. 43 .'1. COMMERCIAL USES as specified in Sections 9263.1.1. and 9263.1.2. M-l Zone." The purpose of this text amendment is to allow flexibility in zoning. The Conditional Use Permit process gives the Planning Com- mission and City Council the discretion to approve certain uses which might be compatible with industrial uses in the M-I Zone. Planning staff contacted twenty-one cities to determine if they allowed commercial uses in industrial zones. Nineteen cities allowed commercial uses without any special permits; one city (Cerritos) allowed offices only, with a Conditional Use Permit. Only one city (Monterey Park), did not allow any commercial uses in induatrial zones. It is the Planning Department's opinion the Conditional Use Permit process would allow the City the opportunity to review the impact of each. commercial use with respect to a specific site and the area in general. -l- . . . . To: Planning Commission Re: T.A. 80-4 January 8, 19BO Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substan- tial or potentially substantial adverse change in any of the phy- sical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission and City Council takes action on this project, the Commission and Council should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment."
