R-3 TO C-2 AT 610 - 618 NORTH SANTA ANITA AVENUE WHEREAS, an application was filed by Lyle W. Alberg on behalf of the City of Arcadia on November 21, 1979, requesting a zone change from R-3 (Multiple Family) to C-2 (General Commercial) for the prop- erty at 610-618 North Santa Anita Avenue, more particularly descrbied as follows: All that real property located in the City of Arcadia, County of Los Angeles, State of California described as follows: . Lots 16 and 17 and those portions of Lots II through 15 inclusive of the Haven Tract, in the City of Arcadia, as shown on map recorded in Book 13, Pages 22 and 23, in the office of the County Recorder of said County, bounded Northwesterly and Northeasterly by the following described line: Beginning at a point in the Westerly line of said Lot 15, distant along said Westerly line South 10 04' 13" east 20.00 feet from the Northwesterly corner of said Lot 15; thence North 640 57' 12" East 49.25 feet to the Northerly line of said Lot 15; thence in a direct line Southeasterly to a point in the Southerly line of said Lot II, distant thereon North 880 54' 49" East 17.47 feet from the South- westerly corner of said Lot II. WHEREAS, a public hearing was held on December II, 1979, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION OF THE CITY OF ARCADIA MAKES THE FOLLOWING RECOMMENDATION AND FINDS AS FOLLOWS: Section I. Subject property is developed with a seven-unit apartment building and one single-family dwelling and zoned R-3; ~ the properties to the north are developed with the Foothill Freeway; the properties to the east are developed with the Foothill Freeway 1126 . . . ,r.. and single-family dwellings and zoned R-l; the properties to the west are developed with the U.S. Department of Agriculture Forest Service and multiple-family dwellings and zoned R-I and R-3; the properties to the south are developed with single and multiple-family dwellings and zoned R-3. Section 2. This Commission finds that the proposed zone change is not justified by either public necessity, convenience, general welfare or good zoning practice, and, therefore, recommends to the City Council that said property not be rezoned. Section 3. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. WONG ASSISTANT PLANNER GENERAL INFORMATION APPLICANT: City of Arcadia LOCATION: REQUEST: LOT AREA: FRONTAGE: EXISTING LAND USE & ZONING: SURROUNDING LAND USE & ZONING: GENERAL PLAN: 610-618 North Santa Anita Avenue Zone change from R-3 (Multiple-Family) to C-2 (General commercial) Approximately 30,000 square feet. 155 feet on Santa Anita Avenue. The subject site is developed with a seven-unit apartment and one single-family dwelling. The site is currently zoned R-3. North: South: Foothill Freeway Developed with single and mUltiple-family dwellings and an automobile service station; Zoned R-3 and C-2. Foothill freeway and single-family dwellings; Zoned R-I Developed U.S. Department of Agriculture Forest Service, multiple-family dwellings; Zoned R-I and R-3. East: West: The subject site is designated as "Mixed Use Commercial-Multifamily". -l- . . . .' - Zone Change Z-79-5 December II, 1979 HISTORY The subject site was purchased by the City from Caltrans as excess freeway property. On October 28, 1976, the City Council directed the Planning Depart- ment to commence General Plan Changes for the Newman Avenue area to implement a zoning that would reflect the current land use pattern. On July 12, 1977, the Planning Commission adopted Resolution No. 993 which recommended to the City Council that the General Plan for the subject site be Multiple-Family Residential (G.P. 77-2). Following public hearings before the City Council, the Council on November I, 1977, adopted Resolution No. 4658 which designated the General Plan for the site as Mixed Use Commercial-Multifamily (see Exhibit A). Prior to this time the site had a General Plan designa-' tion of Commercial and was zoned M-l. On November 8, 1977, Zone Change Z-77-9 was introduced recommedning that the site be brought into consistency with the General Plan and that the subject site be rezoned to R-3. Since the site was designat- ed for Mixed Use, the Planning Department recommended the R-3 zoning because it was most consistent at the time with the existing uses in the area. The Planning Commission adopted Resolution No. I020 which recommended the Zone Change from M-I to R-3 for the site. On February 2l, 1978, the City Council adopted Ordinance No. 1623 which approved the Zone Change from M-I to R-3. On February 28, 1979, the City Council advised staff to accept pro- posals for the development of the City owned property at 610-618 North Santa Anita Avenue. Seven proposals were presented to the City Council, all of which were for office uses. In October, 1979, the City executed an Agreement to Acquire Real Property with Bowden Construction Inc. and Bowden Construction Inc. entered into a Participating Agreement with the Arcadia Redevelop- ment Agency for the.development of the site. The Participation and AcquiSition Agreements provide for the follow- ing controls to insure property development of the site: I. The City shall have the right of reverter in the event the Buyer fails to commence construction of the improvements as required, abandons or suspends construction, or transfers -2- ,'.. . The Arcadia Redevelopment Agency has approval over final construction drawings, landscaping and finish grading plans. 3. Minimum requirements for the development have been set forth in the Participation Agreement. Once the project is completed, the Arcadia Redevelopment Agency will issue to Bowden Construction,. Inc. a "Certificate of Completion of Construction and Development." This certificate will remove any conditions set forth in the Grant Deed and certify the project complete. ANALYSIS The requested zone change from R-3 to C-2 would be consistent with the General Plan and would promote development of the area. . Rezoning the site to C-2 would allow future uses which may be too intensive for the location. The volume of traffic on Santa Anita Avenue, the proximity to the freeway on-ramp, and the heavy traffic volumes at peak periods during race track operations can make in- gress and egress hazardous at times. A C-O zoning of the subject site will insure that only office uses will be allowed, thus having a minimal impact upon the traffic along Santa Anita Avenue and upon the residential properties to the east, Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substan- tial or potentially substantial adverse change in any of the phy- sical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission and City Council takes action on this project, the Commission and Council should "move to approve and file the Negative Declaration and find that the project will not have a significant effe'ct on the environment." After taking action on the application, the Planning Commission should direct staff to prepare a resolution for adoption at its next meeting. The Planning Commission's action shall not be final until adoption of this resolution. The appeal period for 'this action commences at the time the Commission adopts the resolution.
