RESOLUTION NO, 1005
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT TO OPERATE AN ENTERTAINMENT
FACILITY AT 21 MORLAN PLACE.
WHEREAS, on July 18, 1977, Paul Fry filed an application
for an entertainment center, Planning Department Case No. C.U.P. 77-16,
on the property commonly known as 21 Morlan Place, more particularly
described as follows:
A portion of Lot 5, Tract l376B, in the City of Arcadia,
County of Los Angeles, as per Map Book 273, page 73, in
the office of the Recorder of said County.
WHEREAS, a public hearing was held on August 23, 1977, at
which time all interested persons were given full opportunity to
. be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the
Planning Department in the attached report is true and correct.
SECTION 2, This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.

3. The site for the proposed use is adequate in size
and shape to accommodate said use including all yards, parking,

loading, landscaping and other features required to adjust said
use with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated by
the proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial
adverse impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for an entertainment center upon the following
conditions:
1. The property shall be improved and maintained in
accordance with the plans which are on file in the subject Case
No. C.U.P. 77-16 and applicable regulations of the Arcadia
Municipal Code.
2. Existing asphalt sidewalk and drive apron on
Morlan Place shall be replaced with P.C.C. drive apron and sidewalk.
3. Grading and drainage plan of proposed parking lot
shall be submitted for review and approval of the Director of
Public Works.
4. A trash enclosure shall be provided according to
Code requirements.
5. Irrevocable covenant to guarantee 42 additional
parking spaces shall be recorded in accordance with Arcadia
Municipal Code Section 9269.6.

6. That all landscaping, exterior lighting and parking
standards shall meet Code requirements.
,7. That hours of operation shall be limited to 7:00 p.m.
to 12:00' a.m. Tuesday through Saturday and to 7:00 p.m. to
10:00 p.m. on Sunday.
8. That this conditional use permit shall become null
and void if any transfer is made of the rights of this conditional
use permit including, but not limited to, outright transfer,
operation of law, by sublease, subrental or license, forfeiture
or any other means whatsoever, unless the applicant herein first
applies for and is granted permission to make such transfer by the
Planning Commission. Should such permission be requested, the
Planning Commission may impose additional conditions of approval
. as it deems necessary which shall be adhered to by the transferee,
or may deny such transfer.
This conditional use permit shall not issu~ until all
persons having any interest in the real property and this
conditional use permit have executed and recorded a covenant,
approved as to form and content by the City Attorney, agreeing
to the terms of this condition and promising that the require-
ments of this condition will be complied with.
9. That all parking areas to be used by the entertain-
ment facility patrons be adequately ~-~ patrolled to the
satisfaction of the Chief of Police. (C.C. amendment -- 9/20/77)
10. That parking and landscaping plans be submitted to
the Planning Department for review and approval prior to issuance

11. That mechanical equipment shall be painted a color

which will blend with the roof.
12. That this conditional use permit shall be reviewed
annually by the Planning Commission at which time conditions
may be added or modified as deemed necessary.
13. That this conditional use permit shall b~ deemed null
and void should the written permission for the additional parking
be terminated without provisions being made for an equivalent
amount of off-street parking equally as convenient being approved
by the Planning Commission.
14, Covenant in the form approved as to content and form
by the City Attorney shall be executed and recorded guaranteeing
access to Santa Clara Street across the rear of subject property
through the adjoining property at 121-159 North Santa Anita Avenue.
15. That the permit shall become null and void at such
time tha~ a dance permit is denied for subject property.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
city Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission of the

PROPOSED FACILITY:
The applicant is proposing to convert the existing building at
Zl Morlan Place into an entertainment facility,
The entrance to the facility will be on the north side of the
building.
The proposed use will have an elevated 600~ square foot stage,
and a dance floor containing approximately 3,348 square feet.
A band viewing area will provide chairs and tables for
approximately 100 patrons. Additional patrons could congregate
around the dance floor. The building will also include
rehearsal and dressing rooms for the performers, restrooms,
a sound room and a snack bar, The applicant has proposed to
include a record shop within the building,
PARKING AND ACCESS:

Ninety-six parking spaces would be required for this use based
on the requirements for "other permi tted uses" in the commercial
zone of 5 spaces per 1,001 square feet of gross floor area.
The applicant is requesting a modification for 46 spaces, In
staff's opinion, the parking plan could be revised to accommodate
a maximum of 54 parking spaces and conform with the 3% land-
scaping required by Code, Vehicular access would be from
Morlan Place, Vehicular access to Santa Clara Street is proposed
across the rear of the property at 121-159 Santa Anita Avenue,
There are ZO parking spaces located on this property at the
present time, If the parking lot were redesigned to allow
ingress/egress from 21 Morlan Place to Santa Clara Street, the
lot could accommodate the same number of spaces,
The property owner at lZl-lS9 Santa Anita Avenue is also the
owner of 21 Morlan Place, The property owner has indicated
that the majority of the businesses at the Santa Anita location
close at 5:00 p.m. and the parking area at lZl-159 Santa Anita
Avenue could be used for the proposed entertainment facility.
There is ample on-street parking during the business hours of
the proposed facility on Santa Clara Street and Morlan Place.

The applicant has obtained written consent for the use of the
parking lots at ZS, lZl-159 and Z14 North Santa Anita Avenue.
The parking lot at 25 North Santa Anita Avenue (Santa Anita
Professional Building) contains 105 parking spaces and the lot
at 214 North Santa Anita Avenue (Arcadia Lumber Company) con-
sists of 37 parking spaces. The parking lot adjacent to the
subject site at 121-159 North Santa Anita Avenue consists of
ZO parking spaces, There are a total of Z08 parking spaces

proposed by combining the on-site parking and the parking provided
by written permission at the aforementioned locations. An
additional 8 parking spaces could be obtained by revising the
on-site parking plan.
MISCELLANEOUS INFORMATION
The hours of operation for the proposed entertainment facility
will be from 7:00 p.m, to 12:00 a,m, Tuesday through Saturday,
and from 7:00 p,m. to 10:00 p.m, on Sunday,
The maximum occupancy according to the Uniform Building Code
is 1,130 persons, The applicant anticipates the facility to
draw approximately 600 persons. Parking could become a
problem if the facility draws a crowd as large or larger than
anticipated.
Mechanical equipment located on the roof of the building is not
screened from view.
No exterior lighting is shown on the preliminary plans for the
on-site parking area.

The applicant anticipates that IS employees (6 outside and
9 inside -- excluding performers) will be necessary to operate
the proposed facility.
The applicant has applied for a dance permit.
ANALYSIS
An entertainment facility is a permitted use in a C-l zone with
an approved conditional use permit, It is also consistent with
the General Plan designation of Commercial.
Since no sale of alcoholic beverages is proposed, it is staff's
opinion that there should be no age limit imposed.
The Planning Department recommends approval of a modification
to allow 54 parking spaces in lieu of 96 required by Code.
This conditional use permit shall become void if operated by
anyone other than the applicant.
On-street parking and the combined use of the parking lots at
Z5, lZl-159 and Z14 North Santa Anita Avenue would tend to
mitigate some of the anticipated parking problems,

A covenant should be filed with the County Recorder's office
guaranteeing access to Santa Clara across the rear of the property

at lZl-lS9 Santa Anita Avenue insuring mutual use of the property.
The Planning staff has contacted several cities with facilities
similar to the one proposed by the applicant. A synopsis of
the information gathered is as follows:
1, Parking was indicated as being a problem in several of the
cities contacted. The majority of cities with these
facil!ties have parking regulations which are less restrictive
than Arcadia's. The City of Norwalk requires one parking
space per SO square feet of assembly area which is the most
restrictive parking regulation of all the cities contacted,
Z. Noise was indicated as a problem only where the facility
was located adjacent to residences, Arcadia's noise
ordinance is the most restrictive statute of all the cities
contacted.
In staff's opinion, due to the location of the facility,
noise will not be a substantial problem and should be
regulated to meet Code requirements.

3, Hours of operation varied for each facility from opening
at 11:00 a.m. to closing at 6:00 a,m, It is the Planning
Department's opinion that the operating hours of 7:00 p,m,
to lZ:OO a.m. Tuesday through Saturday and 7:00 p,m, to
10:00 p.m, on Sunday would not be detrimental to the
surrounding properties,
4, Security patrol varied from the hiring of security guards to
hiring of off-duty police officers. The Arcadia Police
Department stated that security patrol may be required.
Pursuant to the provisions of the California Environmental
Quality Act, the Planning Department has prepared an initial
study for the proposed project. Said initial study did not dis-
close any substantial or potentially substantial adverse change
in any of the physical conditions within the area affected by
the project including land, air, water, minerals, flora, fauna,
ambient noise, and objects of historical or aesthetic signifi-
cance. Therefore, a Negative Declaration has been prepared and
filed for this project,

Before the Planning Commission takes action on this project,
the Commission should "move to approve and file the Negative
Declaration and find that the project will not have a signifi-
cant effect on the environment."

RECOMMENDATION
The Planning Department recommends approval of C.U.P, 77-16
subject to the following conditions:
1. Conditions as outlined in the attached report from the
Department of Public Works shall be complied with to the
satisfaction of the Director of Public Works,
2, A trash enclosure shall be provided according to Code
requirements.
3, A modification shall be granted to allow 54 on-site parking
spaces in lieu of 96 required by Code.
4. That all landscaping, exterior lighting and parking standards
shall meet Code requirements,
5, That hours of operation shall be limited to 7: 00 p, m, to
12:00 a.m. Tuesday through Saturday and to 7:00 p.m, to
10:00 p.m. on Sunday,
6. That this conditional use permit shall become null and void
if any transfer is made of the rights of this conditional
use permit, by outright transfer, operation of law,
forfeiture or any other means whatsoever, unless the
applicant herein first applies for and is granted permission
to make such transfer by the Planning Commission, Should
such permission be requested, the Planning Commission may
impose additional conditions of approval as it deems neces-
sary which shall be adhered to by the transferee, or may
deny such transfer.
This conditional use permit shall not issue until all persons

The proposed parking lot for this development does not have direct access to
Santa Clara Street. Access to Santa Clara Street will be through an adjacent
parking lot on the east side of this property, Unless the applicant has an
easement over the adjoining property, the access is subject to closure at any
time.
The following conditions of approval are recommended:
1, Replace existing asphalt sidewalk and drive apron on Morlan Place
with P,C.C. drive apron and sidewalk.
2. Submit grading and drainage plan of proposed parking lot for review
and approval of the Director of Public Works.
