RESOLUTION NO. 1002 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA AMENDING SECTION 3, PARAGRAPH NO. 7 OF RESOLUTION NO. 937 WHICH GRANTED A CONDITIONAL USE PERMIT FOR A SAVINGS AND LOAN INSTITUTION WITH A DRIVE-UP WINDOW AT 654-668 WEST HUNTINGTON DRIVE AND 812-816 SOUTH BALDWIN AVENUE . WHEREAS, on March 30, 1976, Home Federal Savings and Loan Association of San Diego filed an application for a savings and loan institution with a drive-up window, Planning Department Case No. C.U.P. 76-7, on the property commonly known as 654-668 West Huntington Drive and 812-816 South Baldwin Avenue, more particularly described as follows: Lots 1-6 of Tract 6985 in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 106, page 53, of Maps in the office of the Recorder of said County, subject to an easement for street and highway purposes over the westerly 15 feet of Lots 1, 5 and 6 WHEREAS, on May 11, 1976, the Planning Commission adopted Resolution No. 937 granting said C.U.P. 76-7 with conditions, one of which conditions, section 3, No.7 read as foll~ws: 7. A covenant shall be recorded in the office of the County Recorder in a form approved by the City Attorney that the owner of 654 West Hun- tington Drive will continue to maintain such parking space as long as the savings and loan institution is maintained. WHEREAS,. on July 15, 1977, Victor R. Stark, Assistant'Vice- President of Home Federal Savings & Loan Association of San Diego, requested that Condition No. 7 of Section 3 of Resolution No. 937 be amended as set forth in his letter to the Planning Commission dated July 15, 1977 attached hereto; WHEREAS, on July 25, 1977, Victor R. Stark appeared before ~ the Planning Commission requesting, on behalf of Home Federal Savings -1- 1002 .r {\ ,/"\ . and Loan Association of San Diego that the aforedescribed condition of C.U.P. 76-7 be modified and agreed to such modification on be- half of Home Federal Savings and Loan Association of San Diego; WHEREAS, on July 25, 1977, Alta B. Romo and Ralph R. Romo appeared before the Planning commission with their legal counsel, Thomas parrington and agreed to the modification of aforedescribed condition of C.U.P. 76-7, requested by Home Federal Savings and Loan Association of San Diego. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF ARCADIA that Item 7 ,of Section 3 of Planning Commis- sion Resolution No. 937 is hereby amended to read a,s follows: . "A covenant shall be recorded in the office of the County Recorder in a form approved by the City Attorney that the owner of 654 West Huntington Drive will continue to maintain such parking space until February 15, 2033. This conditional use permit will become null and void on February 15, 2033 unless Home Federal Savings and Loan Association of San Diego obtains title to 654 West Huntington Drive or procures title to other property suitable for parking, acceptable to the Planning Commission by February 15, 2033" " BE IT FURTHER RESOLVED that except as amended above, Plan- ning Commission Resolution No. 937 shall remain in full force and effect. the adoption of this Resolution to the City Council of the City and the Secretary shall cause a shall certify to copy to be forwarded BE IT FURTHER RESOLVED that of Arcadia. A~~ Secretary - -2- 1002 . - ~ , . . ~' ~ "- , ,---", /" -- July 15, 1977 TO: PLANNING COMMISSION MEMBERS A covenant was prepared for Home Federal Savings & Loan Association of San Diego in cofiformance with Condition No, 7 of CUP 76-7 (P,C, Resolution 937) for their new savings and loan building at 654-668 W. Huntin~ton Drive and 812-816 S. Baldwin Avenue. Condition No, 7 requires "a covenant shall be recorded in the Office of the County Recorder in a form approved by the City Attorney that the owners of 654 W. Huntington Drive will continue to maintain such parking space as long as the savings and loan institution is maintained. The Owners of 654 W. Huntington Drive, a Mr, & Mrs. Romo have leased said property to Home Federal Savings & Loan; however, the lease terminates in 2033 and the Romo's have refused to sign a covenant promising to maintain such park- ing space on their property for the length of-time the savings and loan institution remains. The Arcadia City Attorney's office has prepared a covenan~ 'therefore which terminates in 2033, which new covenant is , now acceptable to the Romo's, However, this new covenant does not conform with Condition NO, 7 of CUP 76-7, and we hereby request the Arcadia City Planning commission to modify Condition No, 7 to allow the covenant to terminate in 2033 and provide that the CUP become null and void in 2033 unless Home Federal SavinQs & 1nan Association obtains title to 654 W, Huntington Drive or procures title to other property sui tabl,., for p,",'kin", ,lcccptilbl'" to the I'l.lnning Commission by December 21; 2033. u~~.~ Victor R.
