PLANNING COMMISSION RESOLUTION 1232
A RESOLUTION RECOMMENDING APPROVAL OF TEXT AMENDMENT
83-3 AMENDING SECTION 9276,2.1, OF THE ARCADIA
MUNICIPAL CODE REALTING TO BUILDING HEIGHT IN THE
"H" OVERLAY ZONE.
WHEREAS, a Text Amendment was initiated by the City for the
consideration of amending Section 9276.2.1 of the Arcadia Municipal
Code relating to building height in the "H" overlay zone, and
WHEREAS, a public hearing was held on March 22, 1983 at which time
all interested persons were given full opportunity to be heard and to
present evidence,
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBY RECOMMENDS TO THE CITY COUNCIL THAT THE FOLLOWING AMENDMENT BE
MADE TO THE ARCADIA MUNICIPAL CODE:
Section 1. That Section 9276,2,1. be amended to read as
follows:
"9276.1.2 GENERAL. The regulations set forth in this Title shall
apply to all buildings and structures on property in the "H" zone which
exceed the height restrictions as set forth in the underlying zone,"
Section 2. The Planning Commission finds that the public
necessity, convenience and general welfare justify the above recom-
mendation.

I HEREBY CERTIFY that the foregoing resolution was adopted at
a regular meeting of the Planning Commission of the City of Arcadia
on the 12th day of April, 1983 by the following vote:

Text Amendment to amend Section 9276.2.1 of
the Arcadia Municipal Code relating to Building
Height in an "HI! overlay zoned area.
SPECIAL INFORMATION
In 1978. Text Amendment 78-2 was approved which amended the
maximum'building height in the C-O, C-1, C-2 and C-M zoned
areas from 35 feet to 40 feet. This text amendment also
changed the required building setbacks in these iones estab-
lishing greater setbacks when the commercially zoned property
is adjacent to residentially zoned property.
Section 9276.2.1 in the "HI! Special Height Zone states:
"9276.2.1. GENERAL, The regulations set forth in this
Title shall apply to all buildings and structures which
exceed two (2) stories or which exceed thirty-five (35)
feet in height located on property which is in the H
Zone and is ~lso in either Zone R-O, R-1, R-2 or R-3, and
shall apply to all buildings and structures which exceed
three (3) stories or which exceed thirty-five (35) feet
in height located on property which is in the H Zone and
is also in either Zone C-O, C-1, C-2, C-M or C-C. (Amenced

l~en the new building heights were established in 1978, this
section was overlooked. Under this present code, any person
wishing to construct a three story commercial building in an
area zoned with a high rise overlay would be limited to 35'
in height rather than the 40' permitted in the commercial zones.

It is staff's recommendation that Section 9276,2.1 be amended
to read:
"9276.2.1. GENERAL. The regulations set forth in this
Title shall apply to alL buildings and structures on
property in the H zone which exceed the height restric-
tions as set forth in the underlying zone."
This change would allow buildings and structures located on
H zoned property to have the same height requirements and set-
back requirements as buildings and structures located in the
same zone without an "H" overlay.
Pursuant to the provisions of the California Environmental Quality
Act and State Guidelines, an initial study has been prepared ror
the proposed project. Said initial study did not disclose any
substantial or potentially substantial adverse change in any of
the physical conditions within the area affected by the project,
including land, air, water, minerals, flora, fauna, ambient
noise, and objects of historical or aesthetic significance.
Therefore, a Negative Declaration has been prepared for this
project.
Before the Planning Commission takes action on this project,
the,Commission should "move to approve and file the Negative
Declaration and find that the project will not have a signifi-
cant effect on the environment1!.
RECOMENDATION
The Planning Department recommends approval of T,A. 83-3 as
noted in the staff report,
