A RESOLUTION GRANTING CONDITIONAL USE PERMIT 83-7
TO OPERATE AN EATING ESTABLISHMENT AT 106 EAST
'FOOTHILL BOULEVARD.
WHEREAS, on February 28, 1983-, The Cheese Box filed an application
to operatecan eating establishment (delicatessen. with tables and chairs)
Planning Department Case No, C. U. P. 83-7, on property commonly known, as
106 East Foot~ill Boulevard, more particularaly described as .follows:
A portion of Lot 12, Block 89 of Santa Anita Tract, in the City
of Arcadia, County of Los Angeles, State of California, as per
Map recorded in Book 34, Pages 41 and 42 of Maps in the Office
of said County Recorder.
WHEREAS, a public hearing was held on March 22, 1983 at which
time all interested persons were given full opportunity to be heard
and present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
~ HEREBY RESOLVES AS FOLLOWS:
Section I. That the factual data submitted by the Planning
Department in the attached report is true and correct,
Section 2. This Commission,finds that:
1. The granting of this Conditional Use Permit will not be
detrimental to the public health or welfare or injurious to the
property or improvements in such zone or vicinity.
2. The use applied for at the location indicated is properly
one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size and shape
to accommodate said use, and all yards, walls, parking, loading, land-
scaping and other features required to adjust said use with the land
and uses in the neighborhood.
4. The Bite abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed
use.
5. The granting of such conditional use permit will not adver-
. sely, affect the comprehensive General Plan.

6. The use applied for will not have a substantial adverse
impact on the envi~onment.
Section 3. That for the foregoing reasons, subject to the
approval of the City Council, this Commission grants a conditional
use permit to operate an eating establishment upon the following
conditions:

HISTORY
The commercial complex was constructed in 1978.

PROPOSAL
The applicants are proposing to add three tables with total seating
for 6 persons. Currently the Cheese Box is a retail establishment
with a delicatessen. The addition of the tables changes the use to
an eating establishment which requires a conditional use permit. The
applicant would also like to serve wine to accommodate the lunch
customers.
BUILDING INFORMATION
The commercial complex contains 5,400 square feet of floor area.

The Cheese Box contained 750 ~quare feet of floor area. The applicant
is proposing to add three 30" table which will accommodate 6 people.
This would allow customers to eat at the premises.
The proposed change in use will result in a change in the off-street
parking requirements. Eating establishments require 20 parking spaces
per 1,001 square feet of gross floor area. This requirement is
irrespective of the number of tables or seating provided in the
eating establishment.
Based on this requirement the 54 off-street parking spaces would be
required for the commercial complex; 19 spaces for the retail
activities and 35 parking spaces for the eating establishment (Baskin-
Robbins and the Cheese Box).
A modification would be necessary to allow 27 parking spaces in lieu
of 54 required for the entire site.
ANALYSIS
An eating establishment is a permitted use in the C-2 zone with an
approved Conditional Use Permit.
It is staff's opinion that the addition of three tables with seating
for six persons would not have an impact on the parking or on the
other businesses on the site. The addition of the tables will not
increase the business currently generated by the existing oepration
and is incidental to the operation of the Cheese Box and provides a
convenience for the customers.

Pursuant to the prov1sions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for the
proposed project. Said initial study did not disclose any substan-
tial or potentially substantial adverse change in any of the physical
conditions within the area affected by the project including land"
air, water, minerals, flora, fauna, ambient noise, and objects of '
historical or aesthetic significance. Therefore, a Negative Declara-
tion has been prepared for this project.
Before the Planning Commission takes action on this project, the
Commission should "move to approve and file the Negative Declaration
and find that the project will not have a significant effect on the
environment!'.
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 83-7 subject to
the tollowing conditions.
1. That there shall be a maximum of three tables with total seating
for six persons.
2. That a modification shall be granted for 27 parking spaces in
lieu of 54 required.
3.
That C.U.P. 83-7 shall not take effect until the owners and
applicant have executed a form available at the Planning Depart-
ment indicating awareness and acceptance of the conditions of
approval.
After taking action on this application, the Planning Commission should
direct staff to prepare a resolution for adoption at its next meeting.
The appeal period for this action commences at the time the Commission
adopts said resolution.
