RESOLUTION NO. 1229 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING APPROVAL OF ZONE CHANGE 83-2 FROM CPD-1 & H (HIGH RISE) TO CPD-1 FOR THE PROPERTY AT 333-421 EAST HUNTINGTON DRIVE. WHEREAS, the City of Arcadia ini tiated,ZoneChange Z-83-1, requesting a Zone Change from CPD-1 & H (Commercial Planned Develop~ ment-1) for the property at 333-421 East Huntington Drive, more particularly described in attached Exhibit "A". WHEREAS, a public hearing was held on February 22, 1983 at which time all interested persons were given full opportunity to be heard and co present evidence. NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION MAKES THE FOLLOWING RECOMMENDATIONS AND FINDS AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached staff report i~ true and correct. Section 2. That the Planning Commission noted, at Che time . that the "H" (High Rise) overlay was being considered for the property, that the Environmental Impact Report addressed a limited amount of high rise development for the area and that there were other parcels in the general vicinity which would qualify eq'1811y well for the "H" zoning, and chat it would be unfair to put a permanent "H" zoning on the pro- perty if for any reason the project proposed in Conditional Use Permit 81-13 were not completed. Section 3. That the Planning Commission finds that the develop- ment of the subject area has not progressed in an expeditious manner, and that to retain the "H" (high Rise) overlay on this property without such development inhibits the potential development of other properties (n the general vicinity. Section 4.:" 'The Planning Commission recommends to the City Council approval of Zone Change 83-2 from CPD-1 & H to CPD-1 for the property at 333~421 East Huntington Drive. - 1 - . 1229 .. \ . Page 1 . . . On February 24, 1982, the Planning Commission adopted Resolution 1157 (C.P. 80-1) recommending amendments to the General Plan which would establish ~ Planned Development Area-l land use designation arid change the General Plan Map designations from Commercial and Industrial to Planne9 Development Area-l for the above-described area. The City Council on May 5, 1981 adopted Resolution 4955 which amended the land use element, establishing a Planned Development Area-1 (PDA-1) land use designation and amending the General Plan Map designation to PDA-1 for the subjec~ area. ' On May 5, 1981 the City Council adopted Ordinance 1720 (Text Amendment 81-1) which,established a CPD-l (Commercial Planned Development-II Zone and regulations for said Zone. The Planning Commission on June 23, 1981 adopted Resolution 1165 recommending denial of Zone Change Z-81-2 from M-1, C-2 & D to CPD-1 for the area bounded by the 210 Freeway, on the north, the AT&SF Rail- road on the south, Fifth Avenue on the east and Second Avenue on the west. The Commission recommended denial of this Zone Change because upon review of the CPD-l zone regulations adopted by the City Council (T.A. 81-1) they did not see the need for allowing residential uses within this area and thought this would lead to land speculation and they also expressed concern that the minimum lot area requirement was too small. Based upon these CPD-1regulations, it was the consensus of the commission that this zone change was not appropriate. 'The City Council, however, adopted Ordinance 1728 which rezoned the above area to CPD-1 and added an "H" (High Rise) overlay to the northeast corner of Huntington Drive and Second Avenue (proposed hctel site) . In November, 1981 Mr. Robert J. Low filed zone change application No. Z-81-5, to add a "H" (High Rise) overlay to the subject properties. The Planning Commission at its December 8, 1981 mEeting held a public hearing on the requested zone change (Minute~ attached as Exhibit iIAlI). ' The Commission felt that the "H" overlay would b,e appropriate if conditioned upon the proposed project's being constructed substantially as presented. The developer had indicated to the Commission that the project was set to g0 without delay. The Commission concurred with the ad hoc Committee finding ~hich had been considering high rise development potential) that in order to discourage speculation which might inhibi~ p~oper deyelopment of the site, approval of the zone change should be-conditioned upon development of the property as per the' plans on file for Conditional Use Permit 81-13. The Commission rioted that the Environmental Impact Report addressed a limited amount of high rise deVelopment for the area and that there were other parcels in the area, which wculd qualify equally well for the "H" zoning, and that it would be unfair to put a permanent "H" zoning on the property if for any reason the project were not completed. The Commission subsequently adopted RE,solution No. 1184 (attached a's Exhibit "B") recommending approval of the zone change, cor.ditioned upon the development of the property as per the plans on file on Con- ditional Use Permit 81-13. The City Cocncil at its January 5, 1982 Qeeting held a public hearing on the requested zone change and subsequently approved .said zone change subject to the condition that an Owr.er Participation Agreement (OPA) be executed and recor0ed. Ordinance No. 1742 adding the "H" overlaywas adopted by thE City Council on april 6, 1982 (attached as Exhibit "C"). The City Cocncil Et its regular meeting of February 1, 1983 directed staff to initiate this zone change for the consideration of removing the existing "H" (High Rise) overlay zone. ANALYSIS Staff does not believe that the development of the subject area has progressed in an expeditious manner, and that to retain the "H" (High Rise) overlay on this property without such development inhibits the potential development of other properties in the area. The existing zoning allo~s building heights up to a maximum of 8 stories, not to exceed 85 feet. With the removal of the "H" overlay, the maxi- ~ mum allowable height would be 3 stories, not to exceed 40 feet. Pursuant to the provisions of the California'Environmental Quality Act, the Planning Department has prepared an initial study fOT the proposed project. Said initial study did not disclose any substan- tial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declara- tion has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of this zone change removing the "H"' (High Rise) overlay zone, . He felt the conditions as listed on the staff report to be excessively stringent. 7he consensus of the Commission was that the Zone Change does closely relate to the C,U.P, and to the Precise Plan, and therefore there is justification for making the zone change conditional upen the proposed project's being constructed substantially as presented. Other Areas The Com~ittee recognized that there were other sites within the Central Ar:~dia and West Arcadia area which might have the potential for high rise development. However, the committee felt that these areas should be evaluated as proposals are submitted. Approval of high rise within the areas would then depend on the outCOme of an ErR which might be preparec for a specific project and should be condi- 'cioned upon specific plans submitted for that site." . Commissioner Kuyper commented, as Chairman or the "WI overlay Ad Hoc. Commit- tee that the ErR limited the amount of high rise recommended for the redevelopment area for which it was writt~n. With this in mind the Committee felt it would be unfair to put a permanent "Hit zoning on one specific lot because they felt there were other parcels in the area which would qualify equally '.....ell for the "H" zoning if this project were for any reason not completed. Commissioner Sargis also emphasized that the limitation on the number of high rise buildings recommended in the EIR would mean that to put a permanent high rise zoning on a property whether or not a proposed project was completed would be unfair to other property owners in the area who might b? able to use the zoning. Commissioner Hegg commended the Ad Hoc Committee on their report, produced on short notice, and concurred with their findi~s5. He would be in favor of proceeding with the zone change and conditioning the change to the C.U.P.
