AN ORDINANCE OF TilE CITY OF ARCADIA N-1ENDING
ARc;\Dli\ 1-1UNICIPAL CODE SECTION 9233.8 OF THE
ZONING ORDINANCE TO RECLASSIFY PROPERTY AT
333 - 421 Ei\ST HUNTINGTON DRIVE FROI,I CPO-I TO
CPO-I & H (HIGIl RISE OVERLAY) .
IVllERE7\S, an application \"as filed by Robert J. Lo\V requestinq
Zone Change 81-5 from CPO-I (Commercial Planned Development-I) to
Cpo-I & H (High Rise Overlay) for the property at 333 - 421 East
Huntington Drive, more particularly described in attached Exhibit
'IAI', hereinafter referred to as IIProperty".
I-IHERE!\S, public hearing \Vas held on January 5, 1982, at \Vhich
time all interested persons were given full opportunity to be heard
and to present evidence.
NOl'I, THEREFORE, the City Council of the City of Arcadia does
hereby ordain as follows:
SECTION 1. That Section 9233.8 of the Arcadia Municipal Code
. is hereby amended, by amending the zoning map contained therein so
the Property as described in Exhibit A attached hereto and by this
reference incorporated herein, presently classified as CPO-I shall
hereafter be classified as Cpo-I & H.
SECTlml 2.
\'Ie find and determine that all written documenta-
tion presented
the hearing on
by the Planning Depa~tment to the City Council for
this zone change is true and correct; that tpis zone
change is consistent with the general plan; that this zone change
would allow for a more harmonious, flexible and desirable develop-
ment of the area; that the public convenience, necessity, general
welfare and good zoning practice justify the proposed zone change;
that the new zoning is the highest and best use of property consis-
tent with piesent zoning classifications.
SECTION 3. That this ordinance shall not become operative
until the City Clerk certifies in her records that an owner
partici~ation agreement has been fully executed by and between
applicant and the Arcadia Redevelopment Agency.

SECTIO:J 4. If any section, subsection, sentence, cl.:llIse,
phrase or por~ion of this ordinance is, for any reason, held to be
invalid or unconstitutional by the decision of any court of compe-
tent jurisdiction, such decision shall not affect the validity of
the remaining portions of this ordinance. The City Council of the
City of "rca(~ia hereby declares thjt it \'lould have adopted this
ordin311cc al1d c~ch section, subsection, SClltencc, clause, phrase or
portion thereof irrespective of the fact that anyone or more
sections, subsectiollS, SCl1tcnccs, clauses, pllrases or portions be
decl.:lred im:.:Jlid or unconstitutional.
SECTIO~ 5. Neither the adoption of this ordinance nor
the repeal hereby of any ordinance shall in any manner affect the
prosecution for violation of ordinances, which violations were
co~~itted prior to the effective date hereof, nor be construed as
affecting any of the provisions of such ordinance relating to the
COllection of any such license or penalty or the penal provisions
applicable to any violation thereof, nor to affect the validity of
any bond or cash deposit in lieu thereof, required to be posted,
filed or deposited pursuant to any ordinance and all rights and
obligations thereunder appertaining shall continue in full force
and effect.
SECTIO~ 6. The Clerk of the Council shall certify to the
passage and adoation of this ordinance and shall cause the same to
be publisbed in"the official ne\'lspaper of the City of Arcadia with-
in fifteen (15) days after its adoption.

Consideration of removing the existing

property.
The staff report was presented, the public hearing was opened.
No persons desired to speak to this application. -.
MOTION:
It was moved by Commissioner Sargis, seconded by Commissioner Ja~nke, to
close the public hearing; the motion passed by voice vote with ~one dissenting.
General discussion ensued.

It was moved by Commissioner Kuyper, seconded by Commissioner Jahnke, to
approve and file the Negative Declaration and find the project will not have
a significant effect on the environment, and further moved to approve
Z-83-2 subject to the recomme~dations of the Planning Department.
