PLANNING COMMISSION RESOLUTION NO. 1228 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA DENYING CONDITIONAL USE PERMIT 83-2 TO ALLOW A CHANGE IN USE OF AN EXISTING TAKE-OUT FOOD ESTABLISHMENT TO AN EATING ESTABLISHMENT AT 1002 SOUTH BALDWIN AVENUE (DBA ARCADIA DONUT SHOP) WHEREAS, on January 20, 1983, Mr. Giuseppe Angiuli filed an application for an eating establishment, Pl~nning Department Case No. C.U.P. 83-2, on property commonly known as 1002 South Baldwin Avenue, more particularly described as follows: Lot 35 of Tract No, 3430, in the City of Arcadia, County of Los Angeles, State of California, as pe.r Map recorded in Book 42, Page 32, of Maps in the Office of said County Recorder, WHEREAS, a public hearing was held on March 8, 1983 at which time all. interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANN1NG COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct. Section 2. This Commission finds: That there is insufficient on-site parking for the proposed use. Section 3. A. To permit 33 existing on-site parking spaces in lieu of 58 required (9269.5), B. Deletion of the commercial landscaping require- ments: 3% of the parking area shall be landscaped. one tree for every 10 parking spaces or any fraction thereof. a 5'_3" wide landscaped buffer with a 5'-11" high solid masonry wall to separate the parking area from the adjacent residentially zoned property to the south and east, and a 5'-3" wide landscaped buffer between the parking area and the public street (9269.13). The subject site is developed with several retail businesses and a general office use, zoned C-2 & H and PR-3. LOT AREA: FRONTAGE: Approximately 20,000 square feet (.46 acres) 75.41 on Baldwin Avenue 204.91 on Fairview Avenue GENERAL PLAN. DESIGNATION: Commercial BUILDING AND SITE INFORMATION The existing commercial buildings were constructed in 1962. There are two separate building~; a 5625: square foot building fronting on Bald- win Avenue and a 1120- square foot building fronting on Fairview Ave- nue (see. attached site plan for the breakdown of uses and square footage) PROPOSAL/ANALYSIS The applicant is proposing to locate five tables (table size 24' x 36") with seating capacity for twenty people (4 attached seats per table) within an existing donut shop. The addition of the tables/seating changes the use to an eating establishment which requires a Conditional Use Permit. Thirty-four on-site parking spaces are required for the existing office and retail businesses (560 square feet of office @ 4 parking spaces per 1001 square feet of gross floor area, and 6,185 square feet of retail @'5 parking spaces per 1001 square feet of gross floor area). There exist 33 on-site parking spaces. The proposed change in use would increase the on-site parking require- ment from thirty-four to fifty-eight spaces. The proposed eating establishment would require thirty-one spaces; 1525 square feet @ 20 parking spaces per 1001 square feet of gross floor area. The site does not comply with the present landscaping requirements for a commercial lot as the aforementioned modification notes. Requir- ing the applicant to comply with the commercial landscaping require- ments is not recommended due to the need for maintaining adequate back-out aisle width. Based on the parking deficiency it is staff's opinion that the pro- posed seating for twenty people is excessive. Only by limiting the seating to a maximum of twelve (12) chairs can staff determine that the vehicular circulation and parking would be adequate to accommodate the use and that the parking deficiency would not be detrimental to the site or surrounding properties. ,Attached for your information are the site plan and the floor plan. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the C,U.P. 83-2 2/22/83 Page 2 . . . proposed project. Said initial study did not disclose any substan- tial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declara- tion has been prepared for this project. Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment". RECOMMENDATION The Planning Department recommends approval of C.U.P. 83-2 subject to the following conditions: 1. That the eating area (square footage) shall not be enlarged beyond the area shown on the floor plan on file in the Planning Depart- ment. Any change in design shall be subject to the review and approval of the Planning Department. 2. That there shall be a maximum of five rectangular (24"x36") tables with seating not to exceed twelve chairs. 3. That this approval shall not constitute an approval for a general reduction in parking for the total site. That any modification granted for parking shall only be for the use approved by C.U.P. 83-2. That a modification is granted allowing 33 parking spaces in lieu of 58 spaces required. 4. That the area within the building which is occupied by the business shall maintain a continuous aisle of 36" in \vidth as per the attached Exhibit "A". 5. That C.U.P. 83-2 shall not take effect until the owner and appli- cant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. After taking action on this application, the Planning Commission should direct staff to prepare a resolution for adoption at its next meeting. The Planning Commission's action shall not be final until adoption of the resolution. The appeal period for this action commences at the time the Commission adopts said resolution (five working days).
