PLANNING COMMISSION RESOLUTION NO. 1226
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR
THE CONVERSION OF AN AUTOMOBILE SERVICE STATION INTO
AUTOMOBILE SELF-SERVICE STATION AT 5 WEST FOOTHILL
BOULEVARD,
WHEREAS, on January 28, 1982, Atlantic Richfield Company filed
an application for an automobile self-service station, Planning Depart-
ment Case No. C.U.P. 83-5, on property commonly known as 5 West
Foothill Boulevard, more particularly described as follows:
Parcell of Parcel Map 10960, in the City of
Arcadia, County of Los Angeles, State of
California, as per Map recorded in Book 114,
Page 39 of Maps in the Office of said County
Recorder.

Section 1. That the factual data submitted by the Planning
Department in the attached report is true and correct.
Section 2. This Commission finds that:
1. The granting of such Conditional Use Permit as hereinafter
provided will not be detrimental to the public health or welfare or
injurious to the property or improvements in such zone or vicinity.
2. The use applied for at the location indicated is properly
one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size and shape
to accommodate said use including all yards, parking, loading, 1and-
scaping and other features required to adjust said use with the land
and uses in the neighborhood.
4. The site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed
use.

5. The granting of such conditional use permit will not ad-
versely affect the General Plan.
6. The use applied for will not have a substantial adverse
impact on the environment.
7. The proposed use will not substantially increase vehicular
traffic on any street in a residentially zoned district.
8. The proposed use will not lessen the suitability of any nearby
commercially zoned property for commercial use by interfering with
pedestrian traffic.
9. The proposed use will not create increased traffic hazards
to pedestrians when located near a school, church, auditorium, theater
or other place of assembly.
Section 3. That for the foregoing reasons, subject to the
approval of the City Council, this Commission grants a conditional use
permit for an automobile self-service station upon the following
conditions:
1.
That "No Smoking" signs be placed on each island and a
fire extinguisher be placed within seventy-five feet of all
areas. This shall be subject to the review and approval of
Department.
That C.U.P. 83-5 shall comply with Arcadia Municipal Code
9275.4 - 9275.4.18, which include the following (except for
9275.4.9) :

A. No permanent parking of vehicles shall be permitted except
when such use is for commercial parking purposes.
B. No vehicles may temporarily park on sidewalks, parkways,
or alleys.
C. No vehicles may be parked on the premises and offered for
sale, lease, or rent.
D. There shall be at leas.t one qualified attendant on duty at
all times while the station is open to the public, for each 16
single dispensing units or combination thereof. It shall be the
responsibility of the attendant to supervise, observe and control
the dispensing of gasoline, to prevent the dispensing of gasoline
into portable containers that are not approved as per Section
15.703(d) of the Fire Code, control sources of ignition, to

immediately handle accidental spills and fire extinguishers if
needed and to lend assistance to handicapped persons in the
dispensing of gasoline.
3. Before C.U.P. 83-5 shall become effective, the trash container
and metal ca~opy at the northwest corner of the subject lot shall be
removed. This shall be subject to the review and approval of the
Planning Department. The site shall be maintained as per the plans
on file in the Planning Department.
4. That C.U.P. 83-5 shall not take effect until the owner and
applicant have executed a form available at the Planning Department
indicating aware~ess and acceptance of the conditions of approval,

HISTORY
On November 16, 1976 the City Council adopted Ordinance 1575 which
permitted automobile self-service stations with an approved Condi-
tional Use Permit.
On June 23, 1981 the Planning Commission determined that a service
station may utili2e 50% (fifty percent) of its gasoline dispensing
units for self-service purposes before being considered a self-service
station requiring a separate conditional use permit.

The Planning Commission at its November 23, 1971 meeting
approved Resolution No. 757, a Conditional Use Permit to

reconstruct a service station at the subject location.
All conditions of approval have been met.
The applicant proposes to convert the existing gasoline
dispensers for self-service use by patrons. Section
9275.4.7.3 requires one attendant on duty at all times
while toe station is open, for each 16 single dispensing
units.
The proposed self-service station will comply with the
regulations set forth for a drive-in business, including
but not limited to lot area, accessways, and landscaping
(9275.4 - 9275.4.11). Since a parking lot abuts the site to
the north, staff feel s a 6' -0" high masonry wall would
not be necessary along the northerly property line,
At the northwest corner of the lot is a trailer-size trash
container under a metal canopy, The original building
plans and the plans on file for C,U,P, 71-20 do not show
said canopy or approve this type of container. The canopy
and trash container should be removed.

An automobile self-service station is a permitted use
in the C-2 zone with an approved conditional use permit.
It is staff's opinion that the proposed self-service
station is an appropriate use of the property and that
the proposal complies with the following conditions
required for granting a conditional use permit for a
drive-in business:
1. That the granting of such Conditional Use Permit
will not be detrimental to the public health or
welfare or injurious to the property or improve-
ments in such zone or vicinity.
2. That the use applied for at the location indicated
is properly one for which a Conditional Use permit
is authorized.
3. That the site for the proposed use is adequate in
size and shape to accommodate said use, and all
yards, spaces, walls, fences, parking, loading,
landscaping and other features required to adjust
said use with the land and uses in the neighborhood.
4. That the site abuts streets and highways adequate
in width and pavement type to carry the kind of
traffic generated by the proposed use.
5.
That the granting of such Conditional Use permit
will not adversely affect the comprehensive general
plan.

6. The proposed use will not substantially increase
veh~cular traffic on any street in a residentially
zoned district.

The p~oposed use will not lessen the suitability

mercial use by interfering with pedestrian traffic.

Pursuant to the Provisions of the California Environmental
Quality Act, the Planning Department has prepared an initial
study for the proposed project, Said initial study did not
disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area
affected by the project including land, air. water, minerals,
flora, fauna, ambient noise, and objects of historical or
aesthetic significance. Therefore, a Negative Declaration
has been prepared for this project.
Before the Planning Commission takes action on this project,
the Commission should "move to approve and file the Negative
Declaration and find that the project will not have a sig-
nificant effect on the environment."

RECOMMENDATION
The Planning Department recommends approval of C.U,P. 83-5
subject to the following conditions:
1. That no smoking signs be placed on each island and
a mounted fire extinguisher be placed within
seventy-five feet of all working areas, This shall
be subject to the review and approval of the Fire
Department.
2. That C.U.P. 83-5 shall comply with Arcadia Municipal
Code Sections 9275.4 - 9275.4.11, which include the
following (except for Section 9275.4.9):
A. No permanent parking of vehicles shall be permitted
except when such use is for commercial parking
purposes.
B.
No vehicles may t'emporarily park on sidewalks,
parkways or alleys.
No vehicles may be parked on the premises and
offered for sale, lease, or rent.

D. There shall be at le3st one qualified attendant

sibility of the attendant to supervise, observe
and control the dispensing of gasoline, to prevent
the dispensing of gasoline into portable containers
that are not approved as per Section 15.703(d) of
the Fire Code, control sources of ignition, to
immediately handle accidental spills and fire
extinguishers if needed and to lend assistance to
handicapped persons in the dispensing of gasoline,
Before C.U.P. 83-5 shall become effective, the trash
container and metal canopy at the northwest corner

subject to the review and approval of the Planning

4. That C.U.P. 83-5 shall not cake effect until the owner
and applicant have executed a form available at the
Planning Department indicating awareness and acceptance
of the conditions of approval.

After action on this application, the Planning Commission
should direct staff to prepare a resolution for adoption
at its next meeting, The Planning Commission's action
shall not be final until adoption of the Resolution, The
appeal period for this action commences at the time the
Commission adopts said Resolution (five working days).
