A RESOLUTION OF THE PLANNING COMMISSIOJ ,:), 9 d
OF ARCADIA GRANTING CONDITIONAL USE PEl ~ 0__
OEPRATE AN EATING ESTABLISHMENT (BAKERY WITH TABLES)
AT 11 EAST FOOTHILL BOULEVARD.
WHEREAS, on February 14, 1983. Simon G. Zervos filed an appli-
cation to operate an eating establishment (bakery with tables and
chairs) Planning Department Case No, C.U.P, 83-6, on property
commonly known as 11 East Foothill Blvd., more particularly described
as follows:
Lots 5, 6, 7,and 8, Block 1 of Tract 4129 in the City of
Arcadia, County of Los Angeles, State of California, as
per Map Book 75, Pages 48 and 49.
WHEREAS, a public hearing was held on March 8, 1983 at which
time all interested persons were. given full opportunity to be heard
and present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning
Department in the attached report is true and correct.
Section 2. This Commission finds that:
1. The granting of this Conditional Use Permit will not be
detrimental to the public health or welfare or injurious to the
property of improvements in such zone or vicinity.
2. The use applied for at the location indicated is properly
one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size and shape
to accommodate said use, and all yards, walls, parking, loading,land-
scaping and other features required to adjust said use with the land
and uses in the neighborhood.
4. The site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed
use.
5. The granting of such conditional use permit will not
adversely affect the comprehensive General Plan.

6. The use applied for will not have a substantial adverse
impact on the environment.
Section 3. That for the foregoing reasons, subject to the
approval of the City Council, this Commission grants a conditional
use permit to operate an eating establishment upon the following
conditions:
1. That plans shall be in substantial compliance with the plans
on file in the subject case.
2. .That the eating area shall not be enlarged beyond the area
shown on the floor plan on file in the Planning Department. Any
change in design shall be subject to the review and approval of the
Planning Department.
3. That there shall be a maximum of twelve 18" tables with
seating not to exceed 12 chairs,
4: That this approval shall not constitute an approval for a
general reduction in parking for the total site. That any modification
granted for parking shall only be for the use approved by C.U.P. 83-6.
That a modification is granted to allow 63 parking spaces in lieu of
93 required.
5. Fire protectio~ shall be provided to the satisfaction of
the Fire Department.
6. That C.U.P. 83-6 sh~ll not take effect until the owner and
the applicant have executed a form available at the Planning Depart-
ment indicating awareness and acceptance of the conditions of approval.

Resolution and shall cause a copy to be forwarded to the City Council
of the City of Arcadia.

Commercial
The building was constructed in 1979. On April 8, 1980, a modification
(M-80-49) was granted for 63 parking spaces in lieu of67 parking spaces
required to allow for the expansion of the Savings and Loan use.

... BUILDING 'INFORMATION
The building contains 12,684 square feet and is divided into the
following uses: ~avings & Loan association, computer sale., a
travel agency, an escrow office and vacant building space. The
bakery is proposing to occupy the vacant portion of the building
which co~t~l~~ 1,700 sq. ft.
The applicant is requesting the conditional use permit to place
twelve 18" tables which could accommodate 12 to 24 customers in the
bakery. This would allow customers to eat on the premises. The
addition of the tables and chairs changes the use from a retail
activity to an eating establishment which requires a conditional use
permit.
A total of 67 parking spaces would be required based on all the existing
uses and the vacant portion of the building being utilized for a
retail activity. The addition of tables to the bakery increases the
parking requirements to 93 spaces; 33 parking spaces for the savings &
loan, 9 for the office uses, 17 for the retail uses and 34 for the
bakery with tables (eating establishments require 20 parking spaces
per 1,001 square feet of gross floor area). There are currently 63
parking spaces on the property (M-80-49l. The site complies with all
the other code requirements.

ANALYSIS
Based on the parking deficiency of 30 spaces, it is staff's oplnlon
that seating for 24 persons is excessive. Staff would recommend that
seating be limited to a maximum of 12 persons. This would be consis-
tent with conditional use permits which have been recently granted for
similar establishments.
Staff does not believe that the seating for 12 persons would have an
impact on the parking or other businesses occupying the building,
because the seating becomes an incidental use to the bakery and is for
the convenience of the customers. .
Pursuant to the provisions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for the
proposed project. S~id initial study did not disclose any substan-
tial or potentially substantial adverse change in any of the physical
conditions within the area affected by the project including land,
air, water, minerals, flora, fauna, ambient noise, and objects of
historical or aesthetic significance. Therefore, a Negative Declara-
tion has been prepared for this project.

Before the Planning Commission takes action on this project, the
Commission should "move to approve and file the Negative Declaration
and find that the project will not have a significant effect on the
environment".

RECOMMENDATION
The Planning Department recommends approval of C.U.P. 83-6 subject to
the following conditions:
1. That the eating area shall not be enlarged beyond the area shown.

not to exceed 12 chairs.
3. That this approval shall not constitute an approval for a general

After taking action on this application, the Planning Commission
should direct staff to prepare a resolution for adoption at its next
meeting. The Planning Commission's action shall not be final until
adoption of the resolution. The appeal period for this action commences
at the time the Commission adopts said resolution (five working days).

This is a one story building consisting of
five stores or offices located at the N/E
corner of Foothill Blvd., and Santa Anita
Ave., The immediate surroundings consist
of office and commercial buildings.
The only alteration to be made will be in
the interior of the leased space in question
to accommodate the installation of fixtures
and equipment including an approximate 36"
wide, 48" in height walkway in the inside
of the room thereby making it easier for
costumers who park in the parking lot to
access of the room through the rear door.
There will be no alterations, building or
development to the exterior of the building
structure or near by properties.
The above information is given in answer to
