A ~ESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA MAKING FINDINGS OF FACT AND DETER~aNING
THAT OUTSIDE WORK ON A MOBILE THEATRICAL SET TRAILER
IS A PERMITTED USE IN A C-M ZONE.
WHEREAS, the City received a request to determine if outside
work on a mobile theatrical set is a permitted use in a C-M zone: and
WHEREAS, the Planning Commission has made findings and determined.
in accordance with Section 9265.1.21 and Section 9213 as follows'

That outside work on a mobile theatrical set
which is not obnoxious or offensive by reason of odor: dust, smoke,
gas, noise or other similar characteristics is hereby determined to
be an acceptable use in the C-N zone if located a minimum distance
of 60' from residentially zoned property.

Attached is a letter from Kare Youth League requesting the City's
permission to utilize the property at 136 West Las Tunas Drive for
parking its busses and large vehicles and for making modifications
on the scenes of its mobile play (drama) set trailer.
This site is zoned C-M, Commercial-Manufacturing. The C-M zone would
allow the parking of the vehicles but does not have any provision for
the outside work on the mobile play set. Section 9265.1.21 of the
C-M zone reads: .
"Other kinds of manufacture, processing or treatment of
products other than those which may be obnoxious or offensive
by reason of emission of odor, dust, smoke, gas, noise, or
other similar characteristics, including hazards, provided that
the determination of the character of any use as defined in this
subsection shall be arrived at as set forth in Section 9213."
Section 9213 states in part: "If any use is for any reason omitted
from the lists of those specified as permissible in each of the
various zones herein designed.. ,it shall be the duty of the Planning
Commission to ascertain all pertinent facts concerning said use and by
resolution of record set forth its findings and reasons therefore,. ,"
The two letters submitted by the Kare Youth League outline the activities
which will take place on the site. This site fronts on Live Oak Avenue
and is enclosed by a chain link fence (see attached photographs),
Because of the size of the mobile play set work must be done outdoors,
The Kare Youth League is requesting that the Commission and Council
determine that this type of activity is a permitted use in the C-M zone.
If the Commission determines that this should be a permitted use in
the C-M zone, staff would recommend that the Planning Commission limit
the outside work to the mobile play set only and not motor vehicle
repair,

Dear Mr. Woolard:
I appreciated your response dated February I st as to our request for the Planning
Commission to approve the use of modifying scenes on a school mobile play (drama) set, in
the C-M zone.
It is very important to us to secure these arrangements as quickly as possible for the
reasons that I listed in my letter dated January 28th.
The answers to your questions are as follows:
1.
Enclosed is a plot plan showing the entire parking area and our proposed location
for making the scene modifications. As shown in the pictures I submitted on
January 28th, the parking area is not presently in use. As is indicated on the plot
plan all area not designated for scene modification will be used strictly for parking.

2. As it shows on the plot plan, there is room for six parking spaces in the area we are
renting. We will be parking six of the following in these spaces as need
necessitates: Two tractor trailers, one 18' box truck, one Chevy step van (28' long),
one GMC "greyhound" bus, or four 54 passenger school buses.
3. To make the scene modifications requires the use of drills, saws, welding equipment
and hand tools. There will be no effect on odor, vibrations, dust, smoke or any
unpleasant gas, and the only noise will be those associ a ted with the tools mentioned
above.
4. All material used in the scene modifications will be stored out of sight under the
drama set.
5. Regular working hours for the crew making the modifications are 9:00 a.m. to 5:00
p.m. anyday between Monday and Saturday. Normally, the modifications take three
months. We will begin in the month of October and continue in November and
January. We will not be worki~ng on modifications on December because all
available help is needed at our Christmas tree lots. This year, however, because we
have spent the last months trying to find a location we will need to start working
immediately through the month of June to get the changes completed in time.

Each summer Kare Youth League and Rio Hondo Prep presents a play on a tour across the
United States and Canada for ten to fourteen weeks. We have presently received over
1000 requests from people who have seen our plays and wish to know where we will be
next year. Besides these contacts, thousands more have either read of our travels in local
newspapers or heard of our productions via local radio and TV stations which frequently
cover our arrival. In every contact we are referred to as "Rio Hondo Prep from Arcadia,
California." We feel that with the exception of the race track and the Rose Parade float,
no other activity consistently spreads the name and goodwill of the city of Arcadia as we
have for the last twenty-nine years on our Summer Tours.
I hope my answers to your questions are satisfactory and will inable you to make a
recommendation to the commission as quickly as possible to include modifying scenes on a
school mobile play (drama) set in the C-M zone.

of the rear parking area of 136 West Las Tunas.
Before forwarding your request to the Planning Commission, you should provide
answers to the following questions in order for the Commission to be able t~
analyze and determine the appropriateness and compatibility of the proposed
use:
1. Provide a scaled plot plan showing the entire site, existing uses, parking,
and the specific location of your proposed use.
2. Explain in detail your proposed use, re the type, number and size of
vehicles, specific activities, type of equipment to be used, hours, days.
etc.
3. Explain any noise, odor, vibrations, dust, smoke, gas, etc. characteristics
(if any) which may be associated with the proposed use,
4. Describe the location and proposed method of screening of any materials
which may be stored outdoors,

Dear Planning Commission:

Kare Youth League - Rio Hondo Prep is interested in using a portion of
the unused parking area located in the rear of 136 W. Las Tunas Dr. for parking
its buses and large vehicles, and for making seasonal modifications on the scenes
of its mobile playset trailer. Although the parking of vehicles is permissible,
we understand that this last usage is presently undefined in Arcadia City code,
and requires that the Planning Commission approve this usage in the C-M zone
which encompasses this area.
In regards to this request, it will take three men working a forty
hour week, four months to make the necessary modifications.
For the last nine months Kare Youth League has been actively searching
to find a suitable location off its site at 5150 Farna Ave. to park its vehicles
and to modify the set scenes. It is obviously important that this location
be in the immediate area of the League.
Approval of this request would provide the following advantages:

Provide more existing space at Kare Youth League's facilities located

2. Alleviate said activities from an R-I zone and place them in a C-M
zone.
3. Eliminate the danger to children during the period when the modi-
fications are being made.
4. Provide children with more and safer playground space at the existing
Kare Youth League facility.
5. Improve the aesthetic appearance at Kare Youth League's existing
facility.
As you know, Kare Youth League is in the .-nidst of redeveloping its property
to better serve our members and the community.
Due to these reasons we request that scene modifications of school mobile
playsets be included in the C-M zone.

Section 3. That for the foregoing reasons, subject to the
approval of the City Council, this Commission grants a Conditional
Use Permit for outdoor storage of equipment at 121 and 127 LaPorte
Street upon the following conditions:
1. All conditions as outlined in the attached memo from the
Department of Public Works shall be complied with to the satisfaction
of the Director of Public Works.
2. That all conditions as outlined in the attached memo from
the Building Department shall be complied with to the satisfaction of
the Chief Building Official.
3. That a lot consolidation or covenant and agreement to hold
the property as one parcel be recorded prior to C.U.P. 83-1 becoming
effective. The covenant will be permitted only with the approval of.
the City Attorney.
4. That materials, equipment and tools shall not be visible
above the \vall and shall not exceed 6' -0" in height. Enclosed
trailers, trucks and motor vehicles shall b~ permitted to exceed said
6'-0" height limitation.
5. That the outside storage area shall be compl"tely enclosed
by six foot high solid decorative masonry walls. This shall be sub-
ject to the review and approval of the Planning Department.
6. Parking spaces for each employee shall be provided on the
site. These ~paces shall be per City standards (9269.7.B., 9269.8.B.,
9269.9.B.) and shall be subject to the review and approval of the
Planning Departmen~.
7. That C.U.P. 83-1 shall not take effect until all conditions
of approval are met to the satisfaction of the Planning Department.
8. That C.U,P. 83-1 shall not take effect until the owner and
applicant have executed a form available at the Planning Department
indicating awareness and acceptance of the conditions of approval.
9. That a permanent landscape and irrigation plan be submitted
for the front yard area. This plan shall include additional landscaping
other than proposed by the applicants, to buffer the storage area. All
trees shall be a minimum can size of 15 gallons, and shrubs 5 gallons.

The dwelling at 121 La Porte was built prior to 1939 and the dwelling
at 127 La Porte was constructed in 1937
PROPOSAL/ANALYSIS

The applicants propose to remove the dwelling at 127 La Port7 and the
garage 2t 121 La Porte. The remaining dwelling and ?arage wlll be
~onverted into storage buildin&s for tools and materlals.
Staff would Iecom~end that the outside storage are2 be completely
enclosed by six foot high solid decorative mase-nry walls. Prior to
the conditional use permit requirement for outside storage, properties
used the requested chain link fencing with wooden slats, which staff
has found to be inadequate for long term storage. Also, the use of
three different fencing materials to screen the storage area would
not be appropriate since this part of the City is gradually being up-
graded by new industrial buildings.
If the applicant states that the outside storage is temporary and if
the Planning Commission concurs, the Planning Departmert would recommend
that the storage be permitted no longer than twenty-four (24) months
(See footnote A under Recommendation Section). The Commission should
decermine the appropriate length of timeco allow the fencing as proposed.
North cf the subject site are multiple-family units with parking
directly off the alley. Since the site can be accessed from La Porte
Street, staff wocld like to minimize the vehicular traffic within the
alley by only allowing ingress and ~gress from La Porte Street
(Ccndition 9).
The M-1 zone requires a minimum lot size of 15,000 square feet, thus a
lot consolidation or covenant holding the property as o~e parcel must
be be recorded prio~ to C.U.P. 83-1 becoming effective (Condition 3.).
Outside storage is a permitted use in the M-l zone with an approved
Conditional Use Permit. It is staff~s opinion that the proposed cut-
side storage would be an appropriate use of the property if adequate
conditions of approval are required.
Pursuant to the provisions of the California Environmental Quality
Act, the Flanning Cepartment has prepared an initial study for the
proposed project. Said initial study did not disclose any substan-
tial or potentially substantial adverse change in any of the physical
conditions within the area affected by the project including land,
air, water, minerals, flora, fauna, ambient noise, and objects of
historical or aesthetic significance. Therefore, a Negacive Declara-
tion has been prepared for this project.
Before the Planning Commission takes action on this projecc, the
Commission should "move to approve and file the Negative Declaration
and find that the project will not have a significant effect on the
environment".
