RESOLUTION NO. 1220
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT (C.U.P. 83-3) TO OPERATE A BEER
AND WINE TAVERN AT 500~ EAST LIVE OAK AVENUE.
WHEREAS, on January 21, 1983 Ray Lock, Norm Ritchie. John
Nicomede and Roy Quesenberry filed an application to operate a
beer and wine tavern (also the serving of sandwiches), Planning
Department Case No. C.U.P. 83-3, on property commonly known as
500~ East Live Oak Avenue, more particularly described as follows:
Part of Lot 12, Rancho San Franciquito Tract, in the
City of Arcadia, County of Los Angeles, State of Cali-
fornia, as per Map recorded in Book 42, Pages 93 and 94
of Miscellaneous Records in the Office of said County
Recorder.
WHEREAS. a public hearing was held on February 8, 1983.
at which time all interested persons were.given full opportunity
to be heard and present evidence;
NOW, THEREFORE. THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Plan-
ning Department in the atached report is true and correct.
Section 2. This Commission finds that:
1. The granting of this Conditional Use Permit will
not be detrimental to the public health or welfare or injurious
to the property or improvements in such zone or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to accommodate said use, and all yards, walls, parking,
loading, landscaping, and other features required to adjust said
use with the land ~nd uses in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated
by the proposed use.

~ 5. The granting of such conditional use permit will
not adversely affect the comprehensive General Plan.
6. The use applied for will not have a substantial
adverse impact on the environment.
Section 3. That for the foregoing reasons, subject to the
approval of the City Council, this Commission grants a Conditional
Use Permit for the operation of a beer and wine tavern (also the
serving of sandwiches) upon the following conditions:
1. That a trash enclosure be constructed per Section
9263.6.6. The location shall be subject to the review and approval
of the Planning Department. A plot plan shall be submitted and
the work completed 'prior to C.U.P. 83-3 becoming effective.
2. That striping for only one parallel parking space
be provided adjacent to the planter at the northwest corner of
the lot. This shall be subject to the review and approval of the
Planning Department.
3. That there shall be recorded in the office of the
. County Recorder a Covenant in the form and content approved by
the City Attorney that such owner or owners will continue to
maintain the parking lot south of the alley for parking purposes
as long as the retail center is maintained.
4. That plans for fire protection be submitted and
approved by the Fire Department prior to the opening of the
tavern.

5. That all required building permits be obtained and
finaled prior to C.U.P. 83-3 becoming effective.
6. That a modification be granted for 23 parking
spaces in lieu of 56.parking spaces required.
7. That a modification be granted deleting the commer-
cial landscaping requirements for the following:
5'-3" landscaped buffer between parking area and property
lines adjacent to public streets, 5'-3" wide landscaped
buffer adjacent to residentially zoned property with

4'-0" high block\wall in lieu of 6'-0" in height (south
property line adjacent to parking lot zoned PR-2)

8. That all conditions of approval shall be complied
with prior to C.U.P. 83-3 becoming effective.
9. This C.U.P. shall not take effect until the owner
and applicant have executed a form available at the Plan-
ning Department indicating awareness and acceptance of
the conditions of approval.
Section 4. The Secretary shall certify to the adoption
of this Resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia;

at a regular meeting of the Planning Commission held on the 8th

PROPOSAL/ANALYSIS
The proposed 1,088 square foot tavern is located within a 9,066 square
foot retail center which was built in 1963. Since the center's opening,
the Red Fox Bar operated from this location until it closed some time
between July 1982 and September 2, 1982 (date water service terminated),
In 1967 rhe City began requiring conditional use permits for new bars
and cockrail lounges, thus making the Red Fox Bar a nonconforming use.
The applicants propose to open a beer and wine tavern at the same
location as the Red Fox Bar. Since the property owner did not ask
for a continuation of the nonconforming use (Red Fox Bar), the appli-
cants were required to apply for a conditional use permit.
Property owners are not always aware of Arcadia Municipal Code Section
9248, which. defines the discontinuation of a nonconforming use as the
cessation from active participation of said use for a period in excess
of ninety (90) days shall conclusively be presumed to constitute th8
abandonment of such nonconforming use, unless within the said ninety
(90) days, a declaration is filed with the City Clerk containing among
other things a stctement that the cessation of the nonconforming use
is temporary, the reason for such cessation, and the estimated duration
of such cessation. The City Council shall approve the declaration.as
filed, unless it orders a public hearing to determine the validity of
the declaration (9248.1).
The applicants inquired about opening at the bar location during the
first week of January, 1983.
Requiring the retail center to comply with the landscaping requirements
would cause the loss of two parking spaces in the interior parking lot.
and all eleven spaces south of the alley to become deficient in stall
length. Also, staff feels that it is not necessary to provide landsca-
ping or a 6'-0" high wall to buffer parking spaces from a parking lot.

The Police Department noted that they had a problem several years ago
with some undesirable clientele being attracted to the Red Fox Bar.
This situation was correcte~ with the cooperation of the then owner.
The Police Department would not be opposed to a beer and wine tavern
opening at the same location.
Staff would recommend the construction of a trash enclosure south of
the alley, the restriping for one one parallel parking space adjacent
to the planter at the northwest corner of the lot, and tbe recordation
of a covenant holding the lot south of the alley tor parking purposes
as long as the retail center is maintained.
A beer and wine tavern is a permitted use in the C-2 zone with an
approved conditional use permit. It is staff's opinion that the
proposed tavern is an appropriate use of the property. and that the
parking deficiency would not be injurious to the property or improve-
ments in such zone or vicinity, that the site is adequate in size and
shape to accommodate said use and to adjust said use with the land
and uses in the neighborhood, and that the site abuts streets and high-
ways adequate in width and pavement type to carry the kind of traffic
generated by the proposed use.
Pursuant to the provisions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for the
proposed project. Said initial study did not disclose any s~bstan-
tial or potentially substantial adverse change in any of the physical
conditions within the area affected by the project including land,
air, water, minerals, flora, fauna, ambient r.oise, and objects of
historical or aesthetic significance. Therefore, a Negative Declara-
tion has been prepared for this project.
Before the Planning Commission takes action on this project, the
Commission should "move to approve and file the Negative Declaration
and find that the project will not have a Eignificant effect Of! the
environmentl' .
RECOMMENDATION
The Planning Department recommends approval of C.D.P. 83-3 subject to
the following conditions:
1. That a trash enclosure be constructed per Section 9263.6.6. The
location shall be subject to the review and approval of the P1an-
'ning Department. A plot,plan shall be submitted and the work
complet~d prior to C.U.P. 83-3 becoming effective.

applicant have executed a form available at the Planning Gepart-
ment indicating awareness and acceptance of the conditions of
approval. .
After taking action on this application, the Planning Commissio~ should
direct staff to prepare a resolution for adoption at its next meeting.
The Planning Commissio~'s action shall not be final until adoption of
the Resolution. The appeal period for this action commences at the time
the Commission adopts said Resolution (five working days).
