";~I; RESOLUTION NO. 1218 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOt-lMENDING APPROVAL OF TEXT AMENDMENT 83-1 AMENDING THE ARCADIA MUNICIPAL CODE BY ADDING SECTION 9600 WHICH ADDS PROVISIONS FOR CITY COUNCIL APPEALS TO DECISIONS OR DETERMINATIONS OF THE PLANNING CmlmSSION. WHEREAS, a text amendment was initiated by the City Council for the consideration of amending the Arcadia Municipal Code to add provisions for City Council appeals to decisions or determinations of the Planning Commission, and WHEREAS, a putlic hearing was held time all interested persons were given and to present evidence, NOW THEREFORE THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RECOM~lENDS TO THE CITY COUNCIL THAT THE FOLLOWING AMEND101ENT BE MADE TO THE ARCADIA MUNICIPAL CODE: on January 11, 1983 full opportunity to at which be heard Section 1. Code as follows: "ARTICLE IX CHAPTER 6 That Section 9600 be added to the Arcadia Municipal DIVISION AND USE OF LAND APPEALS OF PLANNING COMMISSION DECISIONS 9600. Notwithstanding any other Section of this Article IX, the City Councilor any member thereof may, at their own discretion and without the filing of any fee, appeal any decision or determin- ation of the Planning Commission made pursuant to this Article within five (5) working days after the date of said decision or determin- ation or at the next City Council meeting, whichever is later." Section 2. The Planning Commission finds that the public necessity, convenience and general welfare justify the above recommendation. Section 3. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. - 1,- 1218 , "-"', ,.." 0; .' PREPARED BY: GENERAL INFORMATION APPLICANT: REQUEST: HISTORY AND ANALYSIS ,'Ii /'1 I" lL,'L'\ ARCADIA PLANNING COMMISSION PLANNING DEPARTMENT TEXT AMENDMENT 83-1 WILLIAM WOOLARD DIRECTOR OF PLANNING City of Arcadia Text Amendment to amend the Arcadia Municipal Code by adding Sectior. 9600 which adds provisions for City Council appeals to decisions or deter- minations of the' Planning Commission. The City Council at its November 16, 1982 meeting directed staff to initiate a text amendment which would clearly set forth the ability of the Councilor any Council member' to appeal the decision of the Planning-Commission. PROPOSAL The following proposed Section, if adopted, would permit the City Councilor any Council member to appeal (without the filing of any feel any Planning Commission decision or determination made pursuant to Zoning Ordinance provisions. Any such appeal would have to be filed within five (5) working days of the Commission's decision or at the next City Council meeting, whichever is later. Page 1 . . . - ;. , Pursuant to the prov~s~ons of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical con- ditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of histor- ical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Department recommends approval of this proposed text amendment. If the Planning Commission decides to recommend approval or denial of this text amendment, the Commission should direct staff to prepare the appropriate resolution for adoption by the Commission, at its next regular meeting.
