RESOLUTION NO. 1213 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF 'ARCADIA RECOMMENDING APPROVAL OF T.A. 82-7 AMENDING THE ARCADIA MUNICIPAL CODE TO PROVIDE FOR REGULATIONS GOVERNING IDENTIFICATION AND TEMPORARY SIGNS IN THE CITY"S RESIDENTIAL ZONES. WHEREAS, a text amendment was initiated by the City Council for the consideration of amending the Arcadia Municipal Code to provide for regulations governing identification and temporary sign in the City's residential zones; and WHEREAS, a public hearing was held on November 9, 1982 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RECOMMENDS TO THE CITY COUNCIL THAT THE FOLLOWING AME~DMENT BE . MADE TO THE ARCADIA MUNICIPAL CODE: Section 1. That Section 9250.2.4.2.7. of the Arcadia Muni- cipal Code be deleted. Section 2. That Sections 9250.2.4 through 9250.2.4.2.6. of the Arcadia Municipal Code be amended to read as ~et forth in attached Exhibit A. Section 3. That Sections 9251.1.7, 9251.1.8, 9251.1.9, 9251.1.9.1., 9251.1.9.2, 9251.1.9,3., 9251.1.10, and 9251.1.11 of the Arcadia Municipal Code be deleted. Section 4. That Section 9251.1.6. of the Arcadia Municipal Code be amended to read as set forth in attached Exhibit B. Section 5. That Sections 9251.1.6.1., 9251.1.6.2., through 9251.1.6.2.6. be added to the Arcadia Municipal Code as set forth . -1- 1213 in . attached Exhibit B. Section 6. That Section 9253.1.5. of the Arcadia Municip.al Code be amended to read as set forth in attached Exhibit C. Section 7. That Sections 9253.1.5.1. through 9253.1.5.2.7. be added to the Arcadia Municipal Code as set forth in attached Exhibit C. Section 8. That Section 9255.1.4. of the Arcadia Municipal Code be amended to read as set forth in attached Exhibit D, Section 9~ That Sectio~s 9255.1.4.1. through 9255.1.4.2.7. be added to the Arcadia Municipal Code as set forth in attached Exhibit D. No signs, sign structures or sign devices of any character shall be permitted in any R-M Residential Mountain- ous Single-Family Zone, except unlighted signs as hereinafter in this Title specified. '- 9250.2.4.l. IDENTIFICATION SIGNS. Each dwelling unit shall have its street number posted so as to be easily seen from, the street. One (l) sign of not to exceed one (l) square foot in area and containing only the name and address of the occupant shall be allowed. 9250.2.4.2. TEMPORARY SIGNS. The following signs shall be permitted on a temporary basis only and shall be located at least ten (lO) feet from adjoining premises and at least five (5) feet from a paved roadway, provided that where any sidewalk exists, the location shall be at -least three (3) feet from the sidewalk in the direction of the residence. If a wall 'or hedge prevents a sign from being located as provided in this Division, the sign may be placed immediately adjacent to the wall or hedge. No sign shall be placed in a location which interferes with the visibility of vehicular ingress or egress to the property or adjoining properties as per the standards on file with the Planning Department or where such signs may interfere with or be confused with any traffic signal or device. ~ 9250.2.4.2.l. ' November 9 , 1982 FROM: PLANNING COMMISSION CITY OF ARCADIA PLANNING 'DEPARTMENT TEXT AMENDMENT 82-7 TO: CASE NO.: PREPARED BY: WILLIAM WOOLARD DIRECTOR OF PLANNING GENERAL INFORMATION APPLICANT: City of Arcadia REQUEST: Text Amendment to amend the Arcadia Municipal Code to provide for regulations governing identification and temporary signs in the City's residential zones. BACKGROUND . The City Council, at its meeting of October 5, 1982, directed staff to prepare a text amendment for the Council's consideration which would allow for additional arrow-type real estate signs and for larger subdivision-type signs for new multiple-family residential projects. A request for the changes was made to the City Council by the Arcadia Board of Realtors (letter attached). ANALYSIS . The existing R-M, R-O, and R-l zoning sign regulations are essen- tially the same, and "where property is located on a cul-de-sac, one (l) directional arrow-type sign not to exceed one toot by two feet (l'x2 ') may be placed on private property located at the next through'street intersection pointing toward the "Open House" during daylight hours. This sign shall only be permitted if: (l) the owner of said property consents to such use of his property, and (2) the house offered for sale is open and attended by the owner or an authorized representative of the owner during any time the,sign is in place." (emphasis added) The proposed amendment would permit ~n arrow-type sign to be used as well for properties which are not located on a cul-de-sac. (i.e., a house for sale on Longden Avenue may have an arrow-type open house sign located on private property at the intersection of Longden Avenue and Santa Anita Avenue.) . . . c c T.A. 82-7 November 9, 1982 Page 2 The arrow-type sign would not be permitted in either City parkway areas or street medians. Only one such arrow-type sign would be permitted on the private property pointing to the property offered for sale, Each open house would only be permitted to have one (ll such arrow- type sign located on property other than the property offered for sale. Flags, pennants, etc. still remain prohibited. The existing R-M, R-O and R-l zoning sign regulations allow for "two temporary signs each not to exceed thirty-two (32) square feet in area per face, advertising the property for sale, erected and maintained in a new subdivision during the period an active sales campaign is being conducted for such subdivision but in no event for a period longer than six (6) months." The proposed amendment would permit a larger sign in the R-2 and R-3 zones for new multiple-family residential projects during the active sales, lease or rental campaign but no longer than six (6) months. The proposed amendment allows the standard real estate signs and arrow-type signs to be used during subsequent sales, etc. The proposed amendment would permit a sign of sixteen (l6) square feet for new multiple-family projects containing more than one (l) dwelling unit but less than five (5) dwelling units, and a thirty- two (32) square feet sign for projects containing five (5) or more dwelling units. The language has been clarified and made consistent from one zone to another in an attempt to simplify the interpretation and en- forcement of the:regulations. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed text amendment. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the'project including land, air, water, minerals" flora, fauna, ambient noise .---~._-~-------' -_..~------.--. ---.-.....---.-.. -,,,.._----~.__._-----""-~-- . . . To approve this text amendment the City Council should "move to approve and file the Negative Declaration 'and find that the project will not have a significant effect on the environment and direct the City Attorney to prepare the ordinance for adoption". RECOMMENDATION The following sets forth the specific code additions, deletions and amendments for each residential zone classification. R-M Residential Mountainous Single-Family Zone Section 9250.2.4.2.7 is proposed to be deleted. Sections 9250.2.4. through 9250.2.4.2.6 are proposed to be amended as per attached Exhibit "A". R-O First One-Family Zone Sections 925l.l.7., 925l.l.8., 925l.l.9., 925l.l.9.l., 925l.l.9.2., 925l.l.9.3., 925l.l.l0., and 925l.l.ll. are proposed to be deleted. Section 925l.l.6 is proposed to be amended as per Exhibit "B". Sections 925l.l.6.l., 925l.l.6.2 through 925l.l.6.2,6 are proposed to be added as per Exhibit "B", R-2 Medium Density Multiple-Family Residential Zone Section 9253.l.5 is proposed to be amended as per Exhibit ':C" . Sections 9253.l.5.l through 9253,l,5,2,7 are proposed to be added as, per Exhi bi t "C". R-3 Multiple-Family Zone Section 9255.1.4 is proposed to be amended as per Exhibit liD". The first request would pertain to that section of the Code which restricts agents or the owner of a property that is for sale, to only one "open house" directional arrow pointing to the premises. We request a change that would allow two "open ,house" signs, one as the code presently allows on the premises and one located at the next through street inter- section pointing toward the "open house" as is presently allowed when a house is located ona cul-de-sac. (A.M.C. 925l. 1. 9 .1) The second request pertains to the code section that restricts a builder of new condominiums in an R-2 and R-3 zone to a sign less that is allowed in a R-l subdivision. We have made a' great effort to comply with these code require- ments, but find them too restrictive.
